Ord. 0110D-3 1980-08-25ORDINANCE NO. 110D-3 AN ORDINANCE AMENDING CHAPTER 9, OF THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, TEXAS, BY ADDING AND DELETING SPECIFIC SECTIONS AND DIVI- SIONS CONTAINED THEREIN, PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. That Section 9-39, Article III, Chapter 9, entitled Duties generally, of the Code of Ordinances of the City of Pearland, Texas, be and the same is hereby amended to read as follows: "Section 9-39. Duties generally. The duties and functions of the board of electricians shall be to convene at the request of the City Council to review the electri- cal code and recommend amendments to the Council as needed for unusual problems. The board and electrical inspector shall compose and admin- ister examinations to determine the issuance of licenses to electrical contractors, master and journeyman electricans. Interpretation of the Code and Ordinances shall be by the Board of Electricians or the City Attorney. Section II. That Section 9-59 and 9-60, Article IV, Division 1, Chapter 9, entitled Journeyman electrician and apprentice electricians, of the Code of Ordinances of the City of Pearland, Texas, be and the same are hereby deleted in their entirety, and the reserved provisions for Article IV shall read Sections 9-59 - 9-66 Reserved. Section III. That Section 9-70, Article IV, Division 2, Chapter 9, entitled Identification, of the Code of Ordinances of the City of Pearland, Texas, be and the same is hereby amended to read as follows: "Section 9-70. Identification. Each holder of an electrical contractor's license shall display his company name or identification on each vehicle used in conjunction with performing electrical work under this chapter. This identification shall be of a permanent type with a minimum height of three (3) inch letters. No magnetic name plat signs are to be used on vehicle. Section IV. That Article IV, Division 3, Chapter 9, of the Code of Ordinances of the City of Pearland, Texas, be and the same is amended by adding thereto a new section 9-82 to be entitled Duties generally, and shall read as follows: "Section 9-82. Duties generally. A Master Electrician shall supervise, direct, and control all electrical work for whomever he works. He must physically in- spect each job for which he has a valid permit to ensure that all work complies with the National Electrical Code and ordinances of the City. He must furnish a semi-annual report to the City Electrical Inspection Department including the names of all electricians who worked for him or his employer. The Master Electrician is held responsible for obtaining licenses for his employees. He must make sure that not more than two apprentices for each journeyman are working on residential jobs and not more than one apprentice for each two journeymen are working on commercial jobs. An apprentice may not work without the presence of a journeyman. The Master Electrician must also be available to meet with the Electrical Inspector during the Electrical Inspector's regular working hours. Section V. That Article IV, Chapter 9, of the Code of Ordinances of the City of Pearland, Texas, be and the same is amended by adding thereto a new Division 6 to be entitled Journeyman Electrician, Sections 9-104 through 9-109, and shall read as follows: "DIVISION 6. Journeyman Electrician. "Section 9-104. When required. A person desiring to do work as an electrician for the holder of an electrical contractor's or electrical sign contractor's license and under the direct supervision of the holder of a master electrician's or master sign electrician's license according to the provisions of this chapter shall first obtain a journeyman electrician's license or journeyman sign electrician's license. "Section 9-105. Qualifica ions. Applicants for a journeyman electrician's license shall be not less than twenty-one (21) years of age; show four years experience and schooling approved by the State and/or a four year federally approv- ed apprentice program. "Section 9-106. Examinati on required. Every applicant for a journeyman electrician's license shall successfully pass a written examination on the practical aspects of electrical wiring based on the ational Electrical Code. The examina- tion shall be offered at the ti'e that the applicant makes application for a journeyman electrician's license. "Section 9-107. Notice of intent to take examination. Persons desiring to take the examination required by this division shall notify the City Secretary of such intention at least twenty-four (24) hours prior to the posted time of such examination. "Section 9-108. Examination fee. Persons desiring to take the examination required by this division shall deposit a fee o ,two dollars ($2.00) with the City Secretary at the time of requesting so to do. Such fee shall be applied to the license fee if issued, but in no case will it be refund- ed. "Section 9-109. Apprentice electricians. Except as is otherwise provided herein, those persons - 2 undertaking electrical work under the direction and constant con- trol of a licensed master or journeyman electrician, and who have been properly registered with the city, shall be known as appren- tice electricians. "Section 9-110. Reserved. Section VI. That Section 9-114, Article V, Chapter 9, entitled Homeowner's rights, of the Code of Ordinances of the City of Pearland, Texas, be and the same is hereby amended to read as follows: "Section 9-114. Homeowner's rights. (a) Nothing herein contained shall prohibit any bona fide homeowner from personally installing electrical conductors or equipment within his own home provided that the owner shall file with the electrical inspector plans and specifications; sat- isfy the electrical inspector and/or the Board of Electricians as to his ability to install electrical wiring; apply for and secure a permit; pay required fee; do work in accordance with this chapter; apply for an inspection, and receive a certificate of approval. This excludes all commercial property. (b) Personal installation by an owner under these homeowner's rights shall be by himself, for himself, on his own homestead premises, without compensation, and no person shall be employed to assist him in any way on such work. Section VII. That Section 9-116, Article V, Chapter 9, entitled Fees, of the Code of Ordinances of the Cityof Pearland, Texas, be and the same is amended to read as follows: "Section 9-116. Fees. (a) Permits shall not be issued under this Article by the electrical inspector until the following fees have been paid; provided, however, the minimum fee for issuance of a per- mit shall be ten dollars ($10.00). (1) Services: All services, each $ 3.00 All meter loops, each 3.00 (2) Outlets: (First four are included in service and meter loop fees), each 0.25 (All light, switch and receptacle openings and bell ringing transformers are classed as outlets.) (3) Lighting fixtures: Fixtures of one circuit or under and combination of ceiling fan and lights, each 0.15 Each additional circuit, per fixture, each 0.60 (Any current -consuming device permanently attached to an outlet for illuminating purposes shall be classed as a fixture.) (4) Electrical appliances, domestic: Range receptacles, each Clothes driers, each - 3 - 1.25 1.25 (5) Cooking tops, each $ 1.25 Ovens, each 1.25 Garbage disposals, each 1.25 Dishwashers, each 1.25 Window air conditioner receptacles, each 1.25 Motors, permanently installed: Up to but not including 1/2 hp 0.60 1.2 hp and less than 10 hp 2.50 10 hp and less than SO hp 4.00 S0 hp and less than 100 hp 7.50 100 hp and less than 150 hp 10.00 150 hp and over 12.00 Motor control equipment is included in motor fees. When future motor outlets are installed they shall be charged for at one-half the regular motor rates applying. The other one-half shall be paid at the time the motors are installed. (6) Miscellaneous: Fee for issuing permit 1.00 Motion picture machines, each 5.00 Commercial sound equipment, each 2.50 Electric ranges, each 1.25 Electric water heaters, each 1.25 X-ray machines, each 4.00 Incandescent electric signs and incandescent gas or vacuum tube signs (shop inspection, per kva 4.00 Sign installation inspection, per kva 3.00 Streamers and festoon lighting, per circuit, each1.25 Permanently connected electrical appliances and equipment of any nature not otherwise specified shall be charged as follows: 0 to S kw, each 0.60 Over 5 kw, per kw 0.15 Temporary installations, such as wood, saws, floor - surfacing machines, paint -spraying apparatus, and the like, per installation 5.00 Plus regular service and loop charge Temporary lighting installations, per installation5.00 Temporary installations, such as carnivals, or similar installations for amusement, show, display, or similar uses: For the installation of 10 kva or less 15.00 All load above 10 kva, per kva 0.75 For the purposes of this classification one horsepower of motor load shall be considered as one kva. Temporary saw pole, per installation 10.00 Temporary cut -in made permanent 10.00 Additions to old work shall be charged for at the same rate as new work. Reconnection fee 10.00 (b) For the purposes of this section, to regulate the issuing of permits, and in fixing the fees covering same, each re- cording watt hour meter and all sign feeder wires and branch cir- cuit wires connecting the same shall be considered as one service and a separate permit must be issued for each service. (c) Penalty fees. All electrical permit, inspection, fixture and appliance fees shall apply except that if any person shall make application for permit as provided herein, after the work has been started or after the workhas been partially com- pleted or concealed, such person shall pay four times the fee or fees which would ordinarly be required. - 4 Section VIII. That Section 9-157, Article VII, Chapter 9, entitled Wiring generally, of the Code of Ordinances of the City of Pearland, Texas, be and the same is amended to read as follows: "Section 9-157. Wiring generally. (a) Approved metallic raceways (such as rigid conduit or steel tubing), under floor cast -in -place raceways, shall be re- quired for all wires used to conduct current for light, heat, or power, in the wiring of all new buildings and in all old buildings or additions thereof within the fire limits of the City, as they are now or may hereafter be established, and in apartments, churches, schools, hotels, theaters, and commercial buildings within the jurisdiction of the City. (d) The use of pancake boxes are not permitted except for bathrooms and cornice overhangs. (e) Ground Fault Circuit Interupter will be required in of public assembly. That Section 9-159, Subsection (c), Article entitled Installation of service conduit, wires, of Ordinances of the City of Pearland, Texas, be amended to read as follows: "Section 9-159. VII, Chapter etc., of the and the same 9, Code is Installation of service conduit, wires, etc. (c) No service wire of size smaller than 4/0 A.W.G. Alumi- num or 3/0 A.W.G. copper THW (225 buss amp panel service) or equiva- lent will be allowed between the point where the service drops of the power company terminate on the owner's premises and the main line entrance switch, and such wire will be enclosed in not less than two inch (2") rigid metal conduit or Schedule 40 PVC underground conduit, or EMT above ground. All grounds must be driven or made ground size and depth according to the National Electrical Code. Section X. That Section 9-160, Subsection (a), Chapter 9, entitled Installa- tion of meters, of the Code of Ordinances of the City of Pearland, Texas, be and the same is amended to read as follows: "Section 9-160. Installation of meters. (a) All meter loops for the installation of electric meters to measure the service rendered by the public service company shall be in meter cabinets furnished by the public service company and in- stalled by the owner or his agent. The meter loop must be ahead of or on the line side of the main line switches. Each apartment in an apartment complex must be individually metered. - 5 Section XI. It is the intention of the City Council, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Pearland, Texas. Section XII. This ordinance shall take effect and be in full force and effect ten (10) days from its publication in the official City newspaper of the City of Pearland, Texas, and the City Secretary is directed to cause the caption of this ordinance, including the penalty, to be published in the official newspaper of the City of Pearland at least once within ten days after the passage of said ordinance.
