Ord. 0110E 1990-01-08ORDINANCE NO. 11O-E AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING SECTIONS 9-53, 9-69, 9-81, 9-90, 9-105, 9-107, 9-108, 9-116, 9-137, 9-140, 9-153, 9-157 AND 9-159 OF CHAPTER 9, ELECTRICITY, OF THE CODE OF ORDINANCES OF THE CITY, PROVIDING A PENALTY FOR VIOLATION; SAVINGS CLAUSE, REPEALER CLAUSE; PROVIDING FOR CODIFICATION, PUB- LICATION AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Section 9-53 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-53. Fees. There shall be charged fees as established by the City Council from time to time by minute order, and a fee schedule shall be kept in the office of the City Secretary. Section 2. That Section 9-69 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-69. Bond and insurance. To apply for a license, an applicant must provide evidence of the following to the Electrical Board: (a) That the applicant is a master electrician, line master electrician or a sign master electrician or has such a person in his employment as a full-time employee. (b) License and permit bond in the amount of $1,000.00 payable to the City of Pearland. Such bond shall be conditioned to bind the principal to comply with this code, and: (1) Indemnify the city for any loss or damages occasioned by the violation of these laws and ordinances. (2) Provide for payment to any injured third party or parties for any damages, cost and expense caused by the electrical contractor's or his employees' or agents' negligence or failure to comply with the terms of such laws and ordinances. (3) Provide that such bond shall remain in full force and effect so long as the principal holds such license and any renewal license unless the sureties shall notify the building official of their desire to be released from any liability arising from any future acts or omissions of the principal, or his employees or agents. In the event the sureties shall request release, they shall be released from any liability arising from any future acts or omissions of the principal, his agents and his employees thirty (30) days after the receipt of such notice. Unless the licensee, within such period, furnishes a new bond duly approved as provided in this section, such 1 license shall no longer permit the licensee to engage in business as an electrical contractor. (c) Minimum insurance requirements: (1) Workers' Compensation Insurance in accordance with Texas state law. (2) Comprehensive general liability insurance coverage with limits of not less than $300,000 per occurrence for bodily injury and $100,000 per occurrence for property damage, with coverages extended as follows: Operations -premises liability; Independent contractor's liability -broad form; Contractual liability -broad form; Completed operations and products liability. All such insurance shall be issued by a company duly authorized to write such insurance in the State of Texas. Compliance with this section shall be considered as having been met when the policy, a copy thereof, or a certificate of insurance has been filed with and approved by the building official. Such policy shall include an endorsement thereon that the building official will be notified at least ten (10) days in advance in the event the policy or policies are cancelled or permitted to lapse by nonrenewal before the expiration date of the license. (d) Each contractor must provide evidence that all work will be performed by his designated master and properly licensed journeyman and apprentices in accordance with this code. (e) Scope of license. In the event that the applicant is or has employed a line master electrician or a sign master electrician in lieu of a master electrician then the scope of this electrical contractor license will be restricted to that work for which he or his master is licensed. Section 3. That Section 9-81 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: See. 9-81. Examination fee. Examination fees shall be set in accordance to Sec. 9-53. Section 4. That Section 9-90 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-90. Bond. Each applicant for an electrical sign contractor's license shall as a condition for the issuance of same furnish a license and permit bond and proof of minimum insurance requirements as stated in Sec. 9-69 as the Mayor and City Council shall approve, and in a form approved by the City Attorney. The bond shall state that the bonded electrical sign contractor will comply with the provisions of this Code, state laws and ordinances relating to the wiring and installation of electric signs. Section 5. That Section 9-105 of the Code of Ordinances of the 2 City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-105. Qualifications. (a) Applicants for a journeyman electrician's license shall be not less than twenty-one (21) years of age; show four (4) years' actual experience directly preceding date of application, such experience to be practical experience in installing wires, conductors and electrical equipment used inside of buildings for the transmission of electrical current for light, heat or power purposes; and must satisfy the board of electricians as to his/her qualifications. (b) Applicants for a journeyman sign electrician's license shall be not less than twenty-one (21) years of age; show two (2) years' actual experience directly preceding date of application, such experience to be practical experience in installing, repairing and maintaining wires, conductors, electrical signs, including gas and tube signs; and other equipment used for the internal transmission of electrical current for signs, and must satisfy the board of electricians as to his/her qualifications. Section 6. That Section 9-107 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-107. Notice of intent to take examination. Persons desiring to take the examination required by this division shall notify the Building Inspection Division of such intention at least twenty-four (24) hours prior to the posted time of such examination. Section 7. That Section 9-108 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-108. Examination fee. Examination fees shall be set in accordance to Sec. 9-53. Section 8. That Section 9-116 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-116. Fees. (a) Generally. Permits shall not be issued under this article by the electrical inspector until the fees as established from time to time by City Council have been paid. Section 9. That Section 9-137 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: 3 Sec. 9-137. Reinspections. If, after the first visit to a job on written notice to inspect same, it is necessary for the electrical inspector to reinspect the same, or it is necessary to reinspect any work, whether from a defect or the work not being ready, the inspector will return only on another written notice, and not less than twenty-four (24) hours thereafter, and shall charge a reinspection fee as established by City Council for each trip thereafter, all other notices taking precedence. Section 10. That Section 9-140 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-140. Same -Prerequisite for service. It shall be unlawful for any electrical supply company operating under a franchise granted by the city or from any person furnishing electric current for light, heat and power to connect his system with any installation of wiring apparatus or fixtures installed after this chapter becomes effective in, or to any building or other structure within the jurisdiction of the city without having first received permission from the electrical inspector to furnish current for such wiring, apparatus or fixtures; such permission shall be given by the electrical inspector at any time after the certificate of insurance shall have been issued. Section 11. That Section 9-153 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-153. Adopted. (a) All electrical construction, and all materials and appliances used in connection with the installation, maintenance and operation of electrical wiring, apparatus or equipment for utilization of the service for the supply company in providing electrical energy for light, heat or power, inside or attached to buildings or property within the jurisdiction of the city shall conform to such special rules and regulations as may be embodied in this or other ordinances of the City of Pearland, and to the 1990 edition of the rules and regulations of the National Fire Protection Association (National Electrical Code) for the installation of wiring and apparatus for electrical purposes, as they are now established and such rules and regulations are hereby adopted and approved as part of this chapter. (b) The 1990 edition of the National Electrical Code is amended as follows: Delete (a) of 230-70, Location. Section 12. That Section 9-157 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-157. Wiring generally. (b) Gasoline filling stations will be wired according to the latest rules and regulations of the National Fire Protection Association. 4 Section••13. That Section 9-159 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: Sec. 9-159. Installation of service conduit, wires, etc. (i) The service disconnecting means shall be installed outside of a building or other structure at a readily accessible location nearest the point of entrance of the service conductors. Section 14. Any person, firm or corporation who shall violate or fail to comply with the requirements of any provisions of the Code herein adopted shall be guilty of a misdemeanor, and shall, upon con- viction by a court of competent jurisdiction, be punished as provided in Section 1-11 of the City Code of Ordinances. Section 15. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 16. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed, but only to the extent of such conflict. Section 17. It is the intent of the City Council of the City of Pearland, Texas, that this Ordinance shall be codified in the City's official Code of Ordinances as provided hereinabove. Section 18. The City Secretary shall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City of Pearland, upon passage of such Ordinance. The Ordinance shall then become effective ten (10) days from and after its publica- tion, or the publication of its caption and penalty, in the official City newspaper. 5 PASSED and APPROVED on first reading this /a day of pilPCEo , A.
