Ord. 0110F 1993-04-12ORDINANCE NO. 110-F AN ORDINANCE AMENDING CHAPTER 9 OF THE CODE OF ORDINANCES, SECTION 9-34, SUBSECTION (E); SECTIONS 9-39, 9-78, 9-79, AND 9-80; SECTION 9-105, SUBSECTION (A); SECTION 9-106; SECTION 9-153, 1993 EDITION OF THE RULES AND REGULATIONS OF THE NATIONAL FIRE PROTECTION ASSOCIATION (NATIONAL ELECTRICAL CODE), SUBSECTIONS (A) AND (B); SECTION 9-157, SUBSECTION (E); SECTION 9-159, SUBSECTIONS (C), (E), (H), AND (I); AND ADDING SECTION 9- 162; HAVING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, A REPEALER CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1: That Section 9-34 (e) of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "(e) One (1) registered professional engineer." Section 2: That Section 9-39 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-39. Duties generally. The duties and functions of the board of electricians shall be to convene at the request of the city council to review the electrical code and recommend amendments to the council as needed for unusual problems. The board and electrical inspector shall compose and administer examinations or appoint an approved testing facility to determine the issuance of licenses to electrical contractors, master and journeyman electricians. Interpretation of the code and ordinance shall be by the board of electricians or the city attorney." Section 3. That Section 9-78 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-78. Qualifications. Applicants for a master electrician's license shall be not less than twenty-one (21) years of age; and be a journeyman electrician licensed by the city or have a valid master electrician's license of another city in this state with at least five (5) years, actual experience, such experience to be practical experience in installing wires, conductors and electrical equipment used inside of buildings for the transmission of electrical current for light, heat or power purposes, and must satisfy the board of electricians as to his qualifications; or he must be a graduate electrical engineer of a recognized college or university with at least two (2) years, actual practical experience directly preceding the date of application." Section 4. That Section 9-79 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-79. Examination required. Every applicant for a master electrician's license shall successfully pass a written examination on the contents of this chapter, of the National Electrical Code, and on the practical aspects of electrical wiring. The examination shall be offered at least quarterly by the designated electrical testing agent. Examination dates and the designated testing agent shall be announced by posting in the city hall a minimum of thirty (30) days prior to the examination date." Section 5. That Section 9-80 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-80. Notice of intent to take examination. Persons desiring to take the examination required by this division shall notify the city secretary or the testing agency of such intention at least twelve (12) days prior to the posted time of such examination." Section 6. That Section 9-105, Subsection (a) of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-105. Qualifications. (a) Applicants for a journeyman electrician's license shall be not less than twenty-one (21) years of age and show four (4) years' actual experience directly preceding and date of the application, such experience to be practical experience in installing wires, conductors and electrical equipment used inside of buildings for the transmission of electrical current for light, heat or power purposes, and must satisfy the board of electricians as to his/her qualifications and present a letter from a licensed master electrician, licensed in the City of Pearland, showing proof of employment." Section 7. That Section 9-106 of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-106. Examination required. Every applicant for a journeyman electrician's license shall successfully pass a written examination on the practical aspects of electrical wiring based on the National Electrical Code. The examination shall be offered at least quarterly by the Electrical Board or by a duly qualified and designated electrical testing agent. Examination dates and the designated testing agent shall be announced by posting in the city hall a minimum of thirty (30) days prior to the examination date." Section 8. That Section 9-153, Subsections (a) and (b) of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-153. Adopted. (a) All electrical construction and all materials and appliances used in connection with the installation, maintenance and operation of electrical wiring, apparatus or equipment for utilization of the service for the supply company in providing electrical energy for light, heat or power, inside or attached to buildings or property within the jurisdiction of the city shall conform to such special rules and regulations as may be embodied in this or other ordinances of the city and to the 1993 Edition of the rules and regulations of the National Fire Protection Association (National Electrical Code) for the installation of wiring and apparatus for electrical purposes, as they are now established; and such rules and regulations are hereby adopted and approved as part of this chapter. (b) The 1993 Edition of the National Electrical Code is amended as follows: Delete (a) 230-70, Location." Section 9. That Section 9-157, Subsection (e) of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-157. Wiring generally. (e) Ground fault circuit interrupter protection will be required in places of public assembly. A place of assembly is a building or other structure designed or intended for the assembly of fifty (50) or more persons." Section 10. That Section 9-159, Subsections (c), (e), (h) and (i) of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 9-159. Installation of service conduit, wires, etc. (c) No service wire of size smaller than 2 awg aluminum or 2 awg copper (125 buss amp panel service) will be allowed between the point where the service drops of the power company terminate on the owner's premises and the main company line entrance switch, and such wire will be enclosed in not less than a 2 inch schedule 40 PVC underground conduit. All underground services shall be completely installed in conduit from the meter can to the Houston Lighting & Power (HL&P) transformer or HL&P underground tap box, at that point the conduit may stop as per HL&P specifications. (e) The service entrance conduit shall not be smaller than 1- 1/4 inch conduit above ground level or 2 inch schedule 40 PVC conduit for underground installation. (h) Aluminum U.S.E. conductors are permitted for use only on underground residential service and shall be installed in conduit. The aluminum wire shall be allowed to extend only as far as the line side of the service disconnecting means. (i) All electrical service disconnecting means for all occupancies shall be installed on the exterior of all buildings. Exception: A commercial service disconnecting means shall only be allowed to be located in the interior of a building provided that: (1) an exterior lockable doorway approved by the Fire Marshal is available providing access to the disconnecting means. (2) approval is granted by the electrical inspector and the Fire Marshal. (3) a key is made available to the Fire Marshal. Section 11. That Chapter 9 of the Code of Ordinances is hereby amended by the inclusion of Section 9-162, which reads as follows: "Sec. 9-162. Electrical load calculations. (a) For any new electrical construction or additions to existing structures a diagram and load calculation based on Article 220 of the National Electrical Code shall be submitted to the City Building Inspection Department for approval. (b) For buildings or structures of less than 5000 square feet in area or not exceeding two (2) floors above ground level, it shall be permissible for a licensed master electrician to submit the load calculation. Included with this load calculation will be his signature and license number. (c) For buildings or structures of greater than 5000 square feet in area or exceeding two (2) floors above ground level, a licensed professional engineer shall submit the load calculation, per the Texas Engineering Practice Act, Sections 19 and 20 (f)." Section 12. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by a court of competent jurisdiction, such part shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 13. all Ordinances in conflict herewith are hereby repealed, but only to the extent of such conflict. Section 14. It is the intent of the City Council of the City of Pearland, Texas, that the provisions of this Ordinance shall be codified as herein provided. Section 15. The City Secretary shall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City at least once within ten (10) days after its passage on second and final reading. This Ordinance shall thereafter become effective ten (10) flays from and after its publication, or the publication of its caption and penalty, in the official City newspaper.
