AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING SECTIONS 9-55 AND 9-56 OF CHAPTER 9 OF
THE CITY OF PEARLAND CODE OF ORDINANCES, ELECTRICITY,
FOR PURPOSES OF CLARIFYING RENEWAL PROCEDURES AND
INCREASING THE FEE FOR INACTIVE STATUS; HAVING A SAVINGS
CLAUSE, A SEVERABILITY CLAUSE, A REPEALER CLAUSE,
PROVIDING FOR CODIFICATION, PUBLICATION AND AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That Section 9-55 of the Code of Ordinances of the
City of Pearland, Texas, shall be and the same is hereby amended to
read as follows:
"Sec. 9-55. Renewal.
Each license issued under this article shall be renewed
annually on or before the thirty-first (31st) day of December
of each year. A grace period of thirty (30) days shall be
allowed for renewal. After this grace period, the licensee
must pay one and one-half (1-1/2) times the normal fee. If
licenses are not renewed by the last day of February of each
year, the licensee will be subject to all of the requirements
for obtaining a new license including, but not limited to, the
retaking of any required test and reapplying for a license.
No electrical work shall be performed by a person or company
whose license is not in a current status."
Section 2. That Section 9-56 of the Code of Ordinances of the
City of Pearland, Texas, shall be and the same is hereby amended to
read as follows:
"Sec. 9-56. Inactive status for master electricians.
If, within the thirty (30) day grace period for renewal, the
holder of a master electrician license desires to place his
license on an inactive status, he may do so by paying a
twenty-five dollar ($25.00) fee. This fee shall entitle the
holder thereof to maintain his master electrician license on
an inactive status through the thirty-first (31st) day of
December of each year by paying such fee. The holder of an
inactive master electrician license may return his license to
an active status by paying the yearly fee for renewal. The
inactive status fee shall not be applied to the renewal fee."
Section 3. All Ordinances in conflict herewith are hereby
repealed, but only to the extent of such conflict.
Section 4. All rights and remedies which have accrued in
favor of the City under this Chapter and amendments thereto shall
be and are preserved for the benefit of the City.
Section 5. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held invalid,
unconstitutional or otherwise unenforceable by any court of

competent jurisdiction, such portion shall be deemed a separate,
distinct, and independent provision and such holding shall not
affect the validity of the remaining portions thereof.
Section 6. It is the intent of the City Council of the City
of Pearland, Texas, that the provisions of this Ordinance shall be
codified as herein provided.
Section 7. The City Secretary shall cause this Ordinance, or
its caption and penalty, to be published in the official newspaper
of the City at least once within ten (10) days after its passage on
second and final reading. This Ordinance shall thereafter become
effective ten (10) days from and after its publication, or the
publication of its caption and penalty, in the official City
newspaper.
