Ord. 0645 10-12-92ORDINANCE NO. 645 AN ORDINANCE OF CITY OF PEARLAND, TEXAS, ESTABLISHING FEES TO RECOVER THE ACTUAL COSTS INCURRED IN PROCESSING RETURNED CHECKS, GIVEN IN SATISFACTION OF ANY FINE, FEE, PERMIT, LICENSE, OR OTHER GOODS OR SERVICES OF THE CITY; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, A REPEALER CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION AND AN EFFECTIVE DATE. WHEREAS, significant Staff time and City equipment are expended in the processing of checks which have been tendered to the City for any fine, fee, permit, license, or other goods or services when such checks are returned unpaid by the payor bank; and WHEREAS, it is deemed in the best interests of the City of Pearland, to recoup its actual costs resulting from this expenditure of Staff time and equipment; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: A, Section 1. The City Council finds and determines that a charge of Fifteen ($15.00) Dollars should be added to the face amount of any returned check tendered to the City in payment of any fine, fee, permit, license, or other City goods or services, and that such Fifteen ($15.00) Dollar fee represents the reasonable and necessary costs incurred by the City in the handling and processing of such returned instruments. Section 2. Any department of the City which shall hereafter receive a draft, check, or other such instrument which is subsequently dishonored and/or returned to the City unpaid is hereby authorized and directed to add to the amount of any fee, fine, or charge for which the instrument is given in satisfaction, or partial satisfaction, the additional amount of Fifteen ($15.00) Dollars as provided in Section 1 of this Ordinance. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. but only to the extent of such provision and such holding shall not affect the validity cof the remaining portions thereof. Section 5. All rights and remedies which have accrnied on behalf of the City are hereby preserved. Section 6. It is the intent of the City Council of title City of Pearland, Texas, that this Ordinance shall be codified in the City's official Code of Ordinances as provided hereinabove.. Section 7. The City Secretary shall cause this Ordinanace, or its caption and penalty, to be published in the official newspaper of the City of Pearland, upon passage of such Ordinance.. The Ordinance shall then become effective ten (10) days from and' after its publication, or the publication of its caption and penality, in the official City newspaper.
