R2004-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING WORK AUTHORIZATION #9 SUPPLEMENT #6 FOR ENGINEERING DESIGN SERVICES ASSOCIATED WITH THE PEARLAND MOBILITY AND DRAINAGE BOND PROGRAM (BARRY ROSE ROAD PROJECT). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain contract by and between the City of Pearland and Turner, Collie and Braden, Inc., ("T C & B) for Program Management of the Pearland Mobility and Drainage Bond Program was authorized by the City Council on December 10, 2001. Section 2. That T C & B has developed work authorization #9 Supplement #6, which is attached hereto as Exhibit "A". Section 3. That work authorization #9 Supplement #6 for engineering design services associated with the Barry Rose Road Project is hereby approved. COKER CITY ATTORNEY APPROVED AS TO FORM: ATTACHMENT D Exhibit "A" Resolution No. R~004-68 WORK AUTHORIZATION NO. 9 SUPPLEMENT NO. 6 This Work Authorization is made pursuant to the terms and conditions of the Pearland Mobility & Drainage Bond Program, hereinafter identified as the "Contract", entered into by and between the City of Pearland ("City"), and Turner Collie & Braden Inc. ("Engineer). PART 1. Work Authorization No. 9 is related to Barry Rose from Broadway (FM 518) to Pearland Parkway. The Engineer will perform Design Engineering services under this Authorization. PART 2. The maximum amount payable for services under this Work Authorization, Supplement No.6 is $29,900.00. This amount is based on the attached fee proposal, dated Apri128, 2004, in the amount of $29,900.00. PART 3. Payment to the Engineer for the services established under this Work Authorization shall be "Lump Sum". PART 4. This Work Authorization shall become effective on May 11, 2004 and shall terminate on November 12, 2005, unless extended by a supplemental work authorization. PART 5. This Work Authorization does not waive the parties' responsibilities and obligations provided under the contract. PART 6. This Work Authorization is hereby accepted and acknowledged below. (TC&B) is pleased to submit this proposal for engineering services associated with preparing an addendum to the Construction Plans prepared for the Barry Rose Project by SBiB Infrastructure, Ltd SCOPE OF SERVICES TC&B will provide Engineering Design Services to prepare an Addendum to the completed construction documents reflecting the following changes in the project. 1. The proposed reverse curve in the road alignment will be moved from east of the Pilgrims Point intersection to east of the London Court intersection. 2. The open ditch section of the project will be extended approximately 400 feet in length to the west. 3. Three 8' x10' box sections will comprise the storm sewer from the outfall into the open ditch section to the intersection of London Court. 4. A junction box transmission from two to three 8' x10' box section will be provided at London Court. 5. Two 8' x 10' box section will comprise the storm sewer from the intersection of London Court to the intersection with the box culverts from the Regency Ditch. 6. The junction box design at the Regency Ditch intersection will be redesigned to accommodate the change in configuration. The pavement of Pilgrims Point will be extended to meet the new location of Barry Rose. 8. No changes will be made to the Traffic Control Plans, SWPPP or Stripping Plans, as the proposed project modifications will not change payment quantities for these items. Reference to required changes will be made in the text of the Addendum. OWNER'S PAYMENTS TO THE ENGINEER 1. General a. Abandoned or Suspended Work: If any work performed by the Engineer is abandoned or suspended in whole or in part, the Engineer shall be paid for services performed on account of it prior to receipt or written notice from the City of such abandonment or suspension, together with any terminal expense resulting there from, and including a reasonable profit. b. Progress Payments: One each month, the City shall pay TC&B for professional services performed under this Agreement in proportion to services performed during the period. c. Nonlabor Expense: For all direct nonlabor expense, including transportation, and telephone toll charges, reproduction, etc., and travel and subsistence of the Engineer's officers and staff, all as required for the proper execution of the work, the charge is the actual invoice cost plus a 10 percent service charge. Travel by vehicles owned or leased by Engineer shall be at no more than 50 cents per mile. 2. Payment for Services of the Engineer: The City shall pay TC&B for the Engineering Services described above in this Agreement, a lump sum basic fee not to exceed $29,900.00 with monthly progress payments as stated above. Compensation for the Engineering Design Services work shall be in accordance with the following schedule: a.
