Ord. 0737-01 11-25-96ORDINANCE NO. 737-1 AN ORDINANCE AMENDING ORDINANCE NO. 737, THE BUDGET ORDINANCE, BY AUTHORIZING CERTAIN ADDITIONS AND REDUCTIONS IN GENERAL FUND AND WATER & SEWER FUND LINE ITEMS; PROVIDING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE AND DECLARING AN EMERGENCY BECAUSE THE NEED TO ADJUST THE CITY BUDGET BEARS DIRECTLY UPON THE HEALTH, SAFETY AND PUBLIC WELFARE OF THE CITIZENRY. WHEREAS, the City Charter of the City of Pearland, Texas, Article 8, Section 8.16 provides that the City Council may, by ordinance adopted by the majority vote of the Council members at one special or regular meeting, make emergency appropriations to meet a pressing need for public expenditure to protect the public health, safety and welfare; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, THAT: Section 1. The City Manager is authorized to make the 'following additions and reductions in General Fund and Water and Sewer Fund line items: Add $15,000 to line item 010-3390-555.11; Add $ 5,000 to line item 010-1020-531.03; Add $1,000 to line item 010-1020-565.71; Add $ 9,000 to line item 010-3340-565.23; Add $ 9,000 to line item 010-3340-555.11; Add $17,500 to line item 010-3340-565.40; Add $60,000 to line item 010-1120-555.11; Add $16,500 to line item 010-2230-656.80; Add $45,000 to line item 010-2250-565.23; Add $40,000 to line item 010-3360-531.23; Add $ 3,000 to line item 010-3550-553.04; Deduct $221,000 from line item 010-3350-555.11; Add a total of $264,807.04 to the General Fund line items, and a total of $22,727.09 to the Water & Sewer Fund line items as indicated on the Encumbrance Master Listing by P.O. Number, labeled Exhibit "A" and attached hereto and made a part hereof; Deduct $264,807.04 from General Fund line item 010-0000-270-01-00; and, Deduct $22,727.09 from Water & Sewer Fund line item 030-0000-270-01-00. Section 2. All rights and remedies which have accrued in favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. Section 3. If any section, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4. This Ordinance shall be effective upon passage and approval of its first and only reading. Section 5. The Council finds and determines that the need to adjust the City's budget bears directly upon the health, safety and welfare of the citizenry, and that this Ordinance shall be adopted as an emergency measure. ~OVED ON FIRST AND ONLY READING this the ~ day of , A.D., 1996.
