AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, DETERMINING A PUBLIC CONVENIENCE AND NECESSITY TO
ACQUIRE AN EASEMENT FOR THE CONSTRUCTION OF WATERLINE
IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBED HEREIN;
AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, AND OTHER
CITY OFFICIALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO
ACQUIRE PROPERTY, LOCATED WITHIN THE CITY, BY DONATION,
PURCHASE, OR BY THE EXERCISE OF THE POWER OF EMINENT
DOMAIN; AND DECLARING AN EMERGENCY AS THE CONSTRUCTION
OF MUNICIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE
HEALTH, SAFETY AND WELFARE OF THE CITIZENRY; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes that a public convenience and necessity
exists for the location, construction, operation, and maintenance of waterline improvements
on certain real property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the
public's best interest to acquire an easement for the construction of water line
improvements on said property; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public
convenience and necessity exists forthe construction of waterline improvements on certain
real property located in Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of right-
of-way, by donation, purchase, condemnation, or otherwise, of certain real property located
within the City and situated in Brazoria County, more particularly described in Exhibits "A"
and "B" attached hereto and incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to

acquire the easement, described in Exhibits "A" and "B" and any improvements thereon,
either by donation, purchase or the exercise of the power of eminent domain.
Section 4. The City Council hereby declares that a public emergency exists for
the acquisition of said easement as the construction of waterline improvements bears
directly upon the health, safety, and welfare of the citizenry; therefore this Ordinance shall
be passed finally on its first and only reading and shall take effect immediately upon its
passage and approval by the City Council.

metes and bounds as follows (bearings
Beginning at the west end of a cut back corner at the intersection of the south right of-way line of
1VIcHard Road (150' wide) and the west right-of-way line of OId Alvin Road (100' wide), west right of-
way line established by that certain tract as descnibed in a deed dated 07-15-2004 from City of Pearland to
City of Pearland as filed in the Official Records of Real Property of Brazoria County at Clerk's File
Number 2004-044745;
1. Thence S 47° 40' 42" E - 28.27' with said cut back corner at the southwest intersection of said
McI3ard Road and said Old Alvin Road to a found 5/S" iron rod with cap. (stamped WII,SON) for
comer;
2. Thence S 87° 17' 15" W - 76924' to a point marking the beginning of a curve to the left having a
radius of 2,005.00' and a central angle of 14° 19' 46";
3. Thence with said curve an arc distance of 501.45' and a chord bearing and distance of
S 80° 07' 23" W - 500.14' to a point for comer,
4. Thence N 02° 33' 15" W - 20.65' with the east line of that certain tract as described in a deed dated
03-01-2006 from Alvazez Interests, Ltd. et al. to City of Peazland as filed in the Official Records of
Real Property of Brazoria County at Clerk's File Number 2006-016407 to a found 5/8" iron rod with
cap (stamped C.L. DAVIS RPLS 4464) marking a point on a curve to the right having a radius of
2,025.00' and a central angle of 14° 11' 00";
5. Thence with said curve and the south right-of-way line of said McHard Road an arc distance of
501.28' and a chord bearing and distance of N 80° 11' 46" E - 500.00' to a 5/8" iron rod marking the
point of tangency;
6. Thence N 87° 17' 15" E - 749.27' continuing with the south right-of-way line of said McHard Road
to the POINT OF BEGINNING and containing 25,213 square feet (0.5788 acre) of land more or less.
This metes and bounds description is accompanied by a separate plat, drawing or exhibit per Texas Boazd
of Professional Land Surveyor's "General Rules of Procedures and Practices" Section 663.19(9).
