1984-01-18 CIVIL SERVICE COMMISSION REGULAR MEETING MINUTES MINUTES OF THE REGULAR MEETING OF THE CIVIL SERVICE COMMISSION OF THE CITY OF PEARLAND, TEXAS HELD ON JANUARY 18, 1984, AT 7:00_ P.M. IN THE CITY SERVICE CENTER, 3501 E. ORANGE, PEARLAND, TEXAS. J The regular meeting was called to order with the following members present: Gail Birdsong - Vice Chairperson James Gilbert - Commissioner Mary Hickling - Director **** APPROVAL OF MINUTES Vice-Chairperson Birdsong declared the minutes of the December. l2, 1983 meeting to be approved. as circulated. The Commission agreed. ACTIVITY Vice-Chairperson Birdsong requested that-the agenda format be shortened.. Commissioner Gilbert agreed. The Commission received as information, a copy of a letter from Henrietta Miistead to Chief Stanford. Vice-Chairperson Birdsong moved that the Commission adopt the proposed procedure dated December 15, 1983, for receiving .and handling all personnel correspondence.- Motion carried. Commissioner Gilbert made a motion that the meeting date be moved to the 2nd Tuesday of the month.. The Commission agreed. The February meeting will be rescheduled until February 22, due to a previous committment by one of the commissioners. New officers were elected: Dan Keller was re-elected as Chairperson, and James Gilbert was elected as Vice Chairperson. The Commission decided to postpone their discussion and review ` of the revisions to 1269m due to Chairperson Keller's absence. ADJOURN ^~ The meeting was adjourned at 7:35 P.M. Therefore, the reading list has been revised, in that, .the criminal and motor vehicle law books published by the Department of Public Safety are now the 1983-1984 editions rather than the old 1981-1982 editions. Lay, Attorney at Law RE: Article 1269 (Amendments by last Legislature) DATE: February 15, 1984 Certain amendments to Article 1269N were adopted by the recent session of the legislature and these are substantially as follows: 1. Section 6 was amended so that the Director of Civil Service now has the same qualifications as the commission members except for the residency requirement. The residency requirement has been deleted for cities the size of Pearland. 2. The classification and appointments of certain policemen ~-,, was changed by Section 8A in response to a program adopted by the City of Houston to remove their Assistant Chiefs from the appointment by the Civil Service Commission to appointment by the Mayor was adopted. This section substantially provides that if there are more than four classifications under that of the Chief of Police, the City Council may, by ordinance, provide for the appointment of the classification just under the Chief of Police by the Chief or the City Council as the case may be. There are a number of restrictions on how many you can have in this classification, as well as how they shall be paid and their rights in the event of sus- pension. This Article further authorizes the City Council to award educational incentive pay in addition to regular pay for those policemen who successfully complete courses at an accredited college or university if the criteria for the educational incentive pay are clearly established, /^ in writing, and applied equally to all policemen meeting the criteria. The next applicable section is Section SD which covers assignment pay and authorizes the City Council to award assignment pay for police officers performing specialized functions in their department as set by ordinance. 4. Section 9 pertaining to elegibility is mended to allow a person who has reached his thirty-sixth (36th) birthday to be certified as eligible for beginning position if he has at least five years prior experience as a peace officer or five years of military experience. 5. Section )4 pertaining to promotions and filing vacancies is amended to provide that the City, upon the recommendation of the chief, and a majority vote of the sworn police officers, adopt an alternate promotional system to select persons to occupy non-entry level positions, other than those filled by appointment by the Chief. The manner in which the election is to be conducted is set out and provides for a change if the department decides to vote for a change. The next major change concerns the disciplinary sus- pensions and the fields therefrom. Taking these two changes together we find that there are changes in the amount of suspension that can be accepted by an officer and although a suspension for longer than 15 days is an indefinite suspension and equivalent to permanent dismissal, if ~' offered by the chief, the officer may agree in writing to voluntarily Memorandum Page 3 accept with no right of appeal, a suspension of not less than sixteen or more than ninety calendar days for violation of civil service rules. The officer must accept the offer not later than the fifth working day after the offer is made and the Chief shall, not later than the 120th hour after the hour of suspen3ion, file a written statement with the commission giving the reasons for suspension, with a copy to the suspended officer. The right of appeal, if the officer refuses to accept the offer of suspension in not less than 16 nor more than 90 calendar days, must be filed in writing with the commission no later than 15 days after the date he receives the statement and the commission shall hold a hearing and render a decision in writing not later than the thirtieth day after the date on which it receives the notice of the appeal. It is also provided that if the officer elects to appeal an indefinite suspension, a promotional Passover, or recommended demotion, he may elect to appeal to an independent third party hearing examiner, instead of to the commission. To exercise his choice he submits a letter to the director stating his decision to appeal to an independent third party hearing examiner. The decision of the hearing examiner is final and binding on all parties and the employee automatically waives his right to waive his appeal to district court. There are certain provisions included in the act for the selection of the examiner and the time for hearing the appeal. `~- Seeti©~ 9 adds a section which covers procedures after ~` Memorandum Page 4 criminal indictment, and if an officer is indicted for a felony or a class A or B misdemeanor he may be temporarily suspended until 30 days after the final disposition. This suspension may be with or without pay and with or without benefits and if convicted of a felony, may be cause for dismissal while a misdemeanor is cause for discplinary action. It is further provided that dismissal of the actions or acquittal does not necessarily mean the employee should not be discplined if rules were violated. Bastion 10 amends Section 20 to allow the Chief to assign an officer to uncompensated duty as punishment. The consent of the officer is required and it may be in place of or in combination of the period of discplinary suspension without pay. The total of uncompensated duty days may-not exceed 15.
