1983-03-07 CIVIL SERVICE COMMISSION REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE CIVIL SERVICE COMMISSION OF THE CITY OF PEARLAND, TEXAS HELD ON MARCH 7, 1983, AT 6:20 P.M. IN THE CITY SERVICE CENTER, 3501 E. ORANGE, PEARLAND, - TEXAS. The regular meeting was called to order with the following present: Dan Keller - Chairperson Gail Birdsong - Vice Chairperson Roy Sanchez - Commissioner Mary Hickling - Director **** Guests: Bob Cuna APPROVAL OF MINUTES: Chairperson Keller declared the minutes of the January 31, 1982 meeting to be approved as circulated.. The Commission agreed. ~,.~ ACTIVITY Motion made by Chairperson Keller, that no further .action be taken in regard to memo discussed in Mr. Lay's...letter dated 3-1-83. Motion carried. The Commission approved for payment a statement dated 12-31-82 from Mr. Tom Lay, Commission's legal council. Statement of expense for hours worked during the month of January by Director Hickling was received as information. Continued discussion of revisions to Civil Service Rule #28 was held and a-final memo was .drawn up by Keller and approved by the Commission. " At it's meeting of March 7, 1983, the Civil Service .Commission labored over the subject and agreed upon the following points: (Please reference my prior draft memo on this same subject) 1. Page 2, II., {j) is changed as follows: Any changes in duties as described in job descriptions, and any. departmental organizational changes affecting covered employees. r^ E 2 . Pa~_e 2 , I I . , (1) is changed as follows Ali negative communications which have been investigated and any positive communication wherein.... (the balance. .remains unchanged.) Substitute-all other report frequency and report format draft memo with the following: I. Aal reports, (a) through (m) of revised rule #28 are due within 120 hours of event occurance. II. Ail reports, (a) through (m) may be submitted in form and format of your choice. III. All reports .shall bear the original signature, and date, of the Chief of Police. In the event of the Chief of P~a3.ice's absence from the City, reports may bear the signature, date and title of his designee. IV. Ted addition to reports submitted within 120 hours of - .-~-. event occurance one report will be submitted for each covered employee at each month's end. (See attached form) Those reports, "Civil Service Personnel monthly summary", are due within 120 hours of the final day of each month. r V. Effective date for these proceedures, is the date of your receipt of this memo. VI. First "Summary" reports-for March, 1983 are due April 5, 1983. VII. "Summary" reports for November 1982 through February, 1983 are due May 5, 1983. We sincerely hope these modifications will make the need for reporting compliance more compatible. Attached to this submission is a letter to the officer containing a list of the acts which I,~as Department Head, allege constitute violations. of the Commissions rules by the suspended officer, specifically; Violation of Civil Service Rule 21-12 = "Violation of (any) rule or regulation of the (Pearland) Police Department and of Special Orders;. to wit: General Order 82-5 of Pearland Police Department and Standing Orders, Q. 1, Paragraph 3. Specifically, the acts of the employee (Officer Garvey) which violate the Civil Service Rules areas follows: 1. Officer Garnet' was driving his city police vehicle at an unsafe speed and in an unsafe manner for conditions existing in the shopping center area. 2. Officer Garvey was operating his vehicle in a code 3 condition, red lights and siren, when Such code 3 traffic was not authorized. 3.
