IN THE CITY SERVICE CENTER,3501 E. ORANGE, PEARLAND, TEXAS. The regular meeting was called to order with the following present: Dan Keller - Chairperson Gail Birdsong - Vice Chairperson • James Gilbert - Commissioner Mary Hickling - Director **** APPROVAL OF MINUTES Chairperson Keller declared the minutes of the October 3, 1983 meeting to be approved as circulated.. ~ ACTIVITY Discussion of the confidentiality of postponed until the November meeting. The Commission agreed. a suspension letter was The Commission approved hours of Director and moved that they be forwarded to .Dorothy Thompson for payment. The Commission went into executive session at 7:10 p.m. and returned to regular business at 7:30 p.m. Director Hickling was instructed to mark the 1984 calendar to review personnel matters at the September meeting annually.. This would include the director's salary and performance. Article 1269m, Sec. 20, provides that whenever the department head suspends any officer or employee under his juris- diction, he shall file a written statement of such action with the Commission within 120 hours thereof. The Commission need not hold a hearing thereon. Other matters may occur between a department head and ,~ an employee that go into a personnel file. These need not be filed with the Commission. However, Section 5a provides that the Commission may make investigations "concerning, and report upon all matters touching, the enforcement and effect of the provisions of this Act". This gives the Commission pretty wide latitude in obtaining information and it is my opinion that the Commission would have the right to see this information if it was required in connection with their duties. The opinion of the City Attorney should be obtained if the Commission and the Department Head disagree as to how this should be handled. Respectfully submitted, ~~ Thomas F.
