Engineer: Bridge Farmer & KKI Change Order No: 3 CoP Project No: T70041 PO#: 091598/091599 Explanation• Texas Sterling Construction, on 5/12/09, was preparing and stripping right of way along the proposed outfall channel between Sta. 22+00 and Sta. 24+50. They discovered a large amount of concrete and rebar debris buried in the ROW. They performed exploratory excavation to provide preliminary limits and depth of the debris field and issued RFI 13 to request direction and compensation for the unforeseen condition. A site meeting was held, on 5/12/09, between the Construction manager, City, and the Contractor at the location of the debris to formulate a plan as to what to do with the debris. It was agreed that all the material within the ROW was to be removed as much as possible and proper fill placed to the proposed line and grade within 2-3 feet of the bottom of the proposed concrete channel. The limits in which the contractor would excavate and haul and dispose of the debris were estimated to be 250' L x 100' W x 13; deep, and approximately 14,000 CY to dispose. The Brazoria Drainage District #4 agreed to provide equipment and labor to excavate, transport, and bury the debris below the final elevation of the Veterans Pond, while the contractor would excavate, load the debris, compact the required soil cap, and haul dirt for use on the proposed embankments as needed. The Contractor provided a proposed price to perform the work for a total value of $64,737.43, and 21 Calendar day time extension. The proposal has been reviewed and recommended by the Construction Manager, Jacobs Engineering, Inc. This Change order encompasses the following; Description of Work Cost Time With RFP 02A, the City has requested the contractor excavate approximately 13,000 CY of material, Between Sta. 22+00 and Sta.24+50, 100' wide and approximately 13' deep, load into BDD4 trucks, provide compaction of soil cap, and reshape the ROW to final line and grade with fill provided from the Veterans Pond area. This work is required in order to remove the debris and replace the soil lost to the unforeseen conditions for the project. This Change Order includes a lump sum value (A) of $19,234.97 for work performed in the preliminary investigation of the debris field and a unit price cost (B) for excavation and disposal of the remaining material for $455.02/HR for a not to exceed budget of $45,502.46.and 21 calendar days for removal of up to 13,000 CY of in-place material. The limits were roughly estimated to be 250' L x 100'W x 13; deep, and approximately 14,000 CY to dispose. The Contractor provided a proposal on 5126109, to dispose of the material for $174,663.45. The City's project manager issued RFP 02A on 5/22/09, in which BDD #4 offered to have the material buried within the confines of the Veteran's Pond, adjacent to the site. The Contractor proposed to use the existing Bid Item 26 - Excavation & Backfill for Structures Drainage Excavation at a unit price of $9.10/CY for 14,000 CY. This would be an overrun of the quantity of $127,400.00. The contractor requested 30 calendar day time extension. On 6!16109, a meeting was held with representatives of BDD#4, City, Contractor and Construction Manager to view the debris field and discuss the drainage district's further assistance to dispose of the debris. The District agreed to provide equipment and labor to excavate, transport, an bury the debris below the final elevation of the Veterans Pond, and the contractor would toad, the debris, compact the required soil cap, and haul dirt for use on the proposed embankments as needed. The Contractor was requested to revise his proposal for 2A based on this information. He provided a revised proposal on 6/18/09 for a lump sum value of $73,473.62 and 21 Calendar day time extension. On 6/19/09, the contractor was requested to provide a breakout of his initial costs incurred during investigation of the debris field and handling of that material and to provide a unit price for a crew rate to excavate and dispose of the material utilizing BDD4's assistance. The contractor on 6130/09 revised his proposal to inGude a lump sum value (A) of $19,234.97 for work performed in the preliminary investigation of the debris field and a unit price cost (B) for excavation and disposal of the remaining material for $455.02/HR for a not to exceed budget of $45,502.46.and 21 calendar days for removal of up to 13,000 CY of in-place material. The scope was reviewed and appears acceptable. A parallel estimate was prepared that indicated the costs are acceptable. It is recommended that the City approve the proposal for an additional cost of $64,737.43. The 21 day time extension is acceptable as the work is part of the major critical path item to complete the major drainage path for the project and to gain dirt for the embankments. The second proposal inlcudes what we are to provide for removing and burying the debris with the assistance of the Brazoria County Drainage District at an hourly rate based on an estimated ten days and fourteen thousand cubic yards of excavation. The following is a brief rundown of what our understanding is of what we are to provide as well as the Brazoria County Drainage District: Texas Sterling is to provide: Excavator to load debris 815 Sheeps foot compactor to compact dirt over the debris D-5 Bulldozer manipulating embankment in channel replacing debris removed pond. As you can see on the second page of the proposal we quoted it lump sum and we requested 21 days. We quoted this lump sum because of the difficulties there will be quantifying the debris. Between the time we've spent on excavating and separating the debris and the time we are going to spend once we start working on it again I feel like time wise it wilt be an accurate estimate regardless of whether it is 10,000 cubic yards or 13,000 cubic yards. I would be much more hesitant to do this if we were providing the trucks but since BDD4 is providing them we are willing to take on this risk. We can do a unit price and do plan quantity measurement if you would rather da that but I feel like we're in the ballpark estimating 14,000 yards.
