A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
EXECUTE A SETTLEMENT AGREEMENT AND DONATION DEEDS
BETWEEN THE CITY AND 313 ACRES PEARLAND JOINT VENTURE,
FRANK S. LADIN, INDIVIDUALLY AND AS TRUSTEE OF THE ROSALIE
H. LADIN FAMILY TRUST, CREATED UNDER THE LAST WILL AND
TESTAMENT OF ROSALIE H. LADIN, DECEASED, AND PHILLIP LADIN,
RONALD LADIN, ROBIN DORN, LENORA T. LADIN, EVELYN YELLEN, AS
CO-TRUSTEES OF THE TRUSTS CREATED UNDER THE LAST WILL AND
TESTAMENT OF SIDNEY S. LADIN, DECEASED, AND LENORA T. LADIN,
INDIVIDUALLY.
WHEREAS, to avoid further litigation and expense, the City of Pearland ("City")
and 31 3 Acres Pearland Joint Venture, Frank S. Ladin, Individually and as Trustee of
the Rosalie H. Ladin Family Trust, created under the Last Will and Testament of
Rosalie H. Ladin, Deceased, and Phillip Ladin, Ronald Ladin, Robin Dorn, Lenora T.
Ladin, Evelyn Yellen, as Co-Trustees of the Trusts created under the Last Will and
Testament of Sidney S. Ladin, Deceased, and Lenora T. Ladin, Individually
(collectively, the "Landowners") have entered into an agreement to settle pending
condemnation for the acquisition of property to be used for the construction,
operation, maintenance, and/or widening of a public roadway that will be known as
Centennial Boulevard; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City Manager or his designee is hereby authorized to
execute the Settlement Agreement and Donation Deeds, attached hereto as
Exhibits "A" and "B" respectively, and incorporated herein for all purposes, and to
execute all other documents necessary to accomplish the purposes of said Agreement.
