IN THE CITY SERVICE CENTER, 3501 E. ORANGE, PEARLAND, TEXAS. C~ The regular meeting was called to order with the following members present: James Gilbert - Chairperson Jim Wood - Commissioner Gail Birdsong - Commissioner Mary Hickling - Director Guests: Sgt. Cuna **** APPROVAL OF MINUTES Minutes from the June 25, 1985 meeting were approved as received. ACTIVITY New Commission member Jim Wood was present for his first meeting. Chairperson Gilbert requested that Mr. Wood be sworn in at the next regular Civil Service Meeting if the City Council does not do so before. The Commission requested that Director Hickling inform the City Manager and Personnel Manager that the procedure for medical examinations to entrance level and promotional personnel will remain the same. Director Hickling was asked to confer with Mr. Lay, legal advisor to the Commission, regarding the appropriateness of Pearland Civil Service Rule # 28 (revised), and report back to the Commission. (See enclosed letter - Mr. Lay refers to these reports as efficiency reports, as they were once called. Note: these are not efficiency reports as we know them today). Box 818 Pearland, Texas 77581 Dear Mrs. Hickling: ~~ i.~~ `~ 2' You have asked me to review Article 1269m and your Rules and Regulations to determine what procedures could be taken if efficiency reports are not filed with your Commission. It is my belief that the requirement for efficiency reports should be made, if you intend to require them, a rule of the Commission promulgated in the same way as your other rules. Once this is done, any official of the City who refuses to comply with your rules, if found guilty, can be punished by a fine of not less than $100.00 nor more than $200.00, as set out in Section 25a of the statute. -- Section 5 says "Failure to comply with the provisions of this section shall be deemed a violation of this Act and punishable as such." It may be necessay to file charges with the Justice of the Peace or some other appropriate Court to enforce your rules. You should follow the statute explicitly in the adoption of any such rule, and its notice of adoption, and it would be appropriate to give a warning letter to the official whose duty it is to furnish these reports. You will recall that under other provisions of the statute the Commission has the right to investigate whether or not its rules are being complied with and the power of subpoena. The Commission may choose to investigate whether or not this rule is being complied with, subpoena the official involved, and any records pertaining to the efficiency reports to see if your rules are being followed. It would seem that each day's failure to comply with the rules would be a separate offense, and this might be pointed out in a meeting with the official involved.
