A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, DIRECTING STAFF TO PRESENT TO THE CITY
COUNCIL PROPOSED AMENDMENTS TO THE CITY'S UNIFIED
DEVELOPMENT CODE TO ALLOW ACCESSORY STRUCTURES TO
BE LOCATED IN THE SIDE YARDS OF RESIDENTIAL LOTS, AND
AUTHORIZING THE ISSUANCE OF BUILDING PERMITS FOR THE
CONSTRUCTION OF ACCESSORY STRUCTURES SO LOCATED.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. That City staff will draft and present to the City Council for its
consideration amendments to the City's Unified Development Code (UDC) to allow
accessory structures to be built in the side yards of residential lots, subject to the
following limitations:
The portion of any accessory structure that is located in the side yard shall:
(1) conform to the minimum side yard set-back requirement applicable
to primary structures for the zoning district in which the property is located;
(2) be no closer to the front property line than the front building line;
and
(3) not exceed five (5) feet in height.
Section 2. That building permit applications for accessory structures located in
the side yards of residential lots may be processed immediately, so long as said
structures comply with the limitations above.
