RESOLUTION NO. R2009-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING THE CITY'S EMPLOYEE HANDBOOK. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City Council hereby amends the City's Employee Handbook in accordance with Exhibit "A" attached hereto. COKER CITY ATTORNEY APPROVED AS TO FORM: Exhibit "A" Resolution No. R2009-51 Section 3.00 Re-defines the Part-Time Classification to comply with the Texas Municipal Retirement System Act. CHAPTER 3 COMPENSATION POLICIES SECTION 3.00 CLASSIFICATIONS OF EMPLOYMENT Purpose It is the policy of the City of Pearland to classify employees as full- time, part-time, temporary, seasonal, and as exempt or non-exempt for the purposes of compensation administration. In addition, the City of Pearland may supplement the regular workforce, as needed, with other forms of flexible staffing. Discussion The Human Resources Department is responsible for classifying employees as Regular Full-Time, Part-Time, Temporary, or Seasonal, and for the purpose of salary administration and eligibility for overtime payments and employee benefits, non-exempt or exempt. There are four (4) categories of at-will employment with the City of Pearland. Regular Full-Time Employee: A regular full-time employee fills an authorized position for an indefinite period of time and is expected to work a minimum of 40 hours a week or 2,080 hours annually in a full-time position. These employees are eligible for all City benefits. Full-time employees may be hourly or salaried, exempt or non-exempt, as defined below. All are at- will with the exception of Classified police. Part-Time Employee: A part-time employee must be designated as such by the department head and approved by Human Resources and the City Manager. There are two (2) types of part-time employees. 4/8/2009 Page 1 of 3 Section 3.00 The first type is one who is scheduled on a regular basis to work 999 hours or less per calendar year. Department heads/Supervisors are responsible for controlling the number of hours worked by a part-time employee, and shall be held accountable for managing these hours. The second type of part-time employee is one who is mandated by the Texas Municipal Retirement Act to participate in the retirement system based on the number of hours required to provide services for the City. These positions will be identified and funded through the budget process and will be positions that are regularly scheduled to work 1000 hours or more per calendar year. Part-time employees may be hourly or salaried, exempt or non- exempt as defined below. All are at-will. Temporary Employee: A temporary employee is defined as an employee who, regardless of the number of hours worked per week, will not exceed 999 hours in a calendar year and may only work periodically for a specific season or project. Employees hired for intern positions are included in this category. These employees are not eligible for any City benefits. In addition, there are no expectations of continued employment beyond the completion of the project or assignment for which the temporary employee is originally hired, unless application is made for a posted position and procedures for filling that position have been followed. A temporary employee may be offered and may accept a new temporary assignment with the City of Pearland and still retain temporary status. Such employees may work apart-time schedule or a full-time schedule and may be "exempt" or "non- exempt" as defined below. Seasonal Employee: A seasonal employee is an individual who has been hired to fill a position for a period of less than six (6) months, usually during the summer months; May through September, and regardless of the number of hours worked per week, will not exceed 999 hours in a fiscal year. Seasonal employees are not eligible for any City benefits and are paid on an hourly basis. They are employed at-will during the period of employment. 4/8/2009 Page 2 of 3 Section 3.00 The City of Pearland may use students and other similar applicants for flexible staffing purposes, as allowed by law. Minor applicants generally will be required to provide a certificate of age, and must be at least sixteen (16) years of age. Non-exempt Employee: Referred to as "hourly", these are employees who are subject to the minimum wage and overtime provisions of the Fair Labor Standards Act ("ELBA") and are paid on an hourly basis. Exempt Employee: These employees are exempt from the provisions of the FLSA and are not entitled to overtime payments. Exempt employees typically are paid on a salary basis and include administrative, executive, professional employees, and highly-skilled computer professionals. The Human Resources Department is responsible for the staffing of employees at the City of Pearland, including seasonal and temporary employees from outside agencies. Employees will be informed during the initial formal interview of their employment classification and of their status as an exempt or non-exempt employee. If an employee changes positions during their employment as a result of a promotion, transfer, or otherwise, he/she will be informed by the Human Resources Department of any change in their exemption status. All employees, regardless of classification, are generally considered to be employed "at-will" and may resign or are terminated at any time and for any reason.
