R97-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING, DIRECTING, AND SUPPORTING THE IMPLEMENTATION OF THE GOVERNMENT ACCESS CHANNEL AS AN EFFECTIVE COMMUNICATION MEDIUM FROM THE CITY TO ITS CITIZENRY; ADOPTING PEARLAND CITYVIEW 40 GUIDELINES; AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO PURCHASE EQUIPMENT NECESSARY TO BROADCAST ON THE GOVERNMENT ACCESS CHANNEL. WHEREAS, a community-wide strategic planning process was initiated in 1995 to plan Pearland's future; and WHEREAS, one of the immediate goals identified in the planning process was to increase citizen awareness and commitment; and WHEREAS, the Government Access Channel has been identified as an available and effective medium through which Pearland residents, who may not access other communication mediums, may be reached; and WHEREAS, a project team of citizens has developed a plan of action for these proposed telecommunications and is prepared to implement the plan, thereby moving the community closer to achieving their immediate goal; now, therefore, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City Council hereby authorizes, directs, and supports the implementation of the Government Access Channel to improve citizen awareness and commitment. Section 2. That the City Council hereby adopts the Pearland CityView 40 Guidelines attached hereto as Exhibit "A" and incorporated herein for all purposes. RESOLUTION NO. R97-4 Section 3. That the City Council hereby authorizes the City Manager or his designee to purchase equipment required to utilize the channel in cooperation with TCI. This 24 hour channel is available to all TCI cable television subscribers within the City of Pearland, at no additional charge. The potential audience for the channel is 12,000 households - and growing. The channel originates from City Hall on SuperVHS and a tape is transported to the TCI offices on Bisbee Street in Houston for broadcast throughout the City of Pearland on coaxial cable. The purpose of the channel is to educate and inform the public about civic, school, and government activities in the City of Pearland. Pearland City View 40 was spearheaded by the Pearland 20/20 Let Pearland Know project team. The government channel is provided by TCI pursuant to its franchise with the City. The equipment is made available by the City of Pearland. Mission Statement The mission of the Pearland government channel is to serve the people of Pearland by providing accurate and current information about services and activities of City government; provide information about activities of non-profit organizations and agencies; provide information about Pearland Independent School District ("PISD"); stimulate and encourage citizens of Pearland to involve themselves in local government and community services and activities. Goals and Objectives To achieve its mission, the following goals for Pearland City View 40 have been established: ho B. C. D. E. F. To provide information affecting residents' health or safety during emergencies. To provide information regarding city services, activities, and policies. To increase community awareness of important issues affecting the City. To provide information about PISD activities. Provide information about non-profit organizations and community activities. Create a library of Pearland City View 40 programming for historical preservation. IV. Content Guidelines Programming on municipal channel 40 shall be non-commercial and shall meet all applicable federal, state, and local laws. Pearland City View 40 permits programming that will inform, educate, enlighten and encourage citizen participation in local government and community services. Eligible programming includes information promoting community events and services, limited emergency information, public safety information, PISD news and information, and public service announcements from non- profit organizations. No obscene, indecent, libelous, slanderous or illegal material is allowed on the channel. Non-profit organization events open to the general public may be promoted on the channel. No political announcements or advertisements are permitted. Direct or indirect solicitation for funds is not permitted. Disclaimer VI. VII. The City of Pearland, its officers, employees and agents shall not warrant the accuracy of any information cablecast over Pearland City View 40, and reserves the right to cablecast appropriate disclaimers as necessary. The City does not promote or endorse non-profit agencies represented on the Pearland City View 40. Pearland City View '40 officials reserve the right to review, edit, and censor any and all material submitted for broadcast on the government channel. All Pearland City View 40 messages must meet channel content guidelines and all other applicable rules and policies of Pearland City View 40. Sponsoring Agency Responsibilities Responsibility for acquiring copyrights and/or permission to cablecast any material is the responsibility of the sponsoring agency. Requests for Pearland City View 40 Time The Pearland City View 40 is a graphic video bulletin board publicizing city, school, and community services, events, and announcements pertaining to the public. It is available free of charge to eligible users. Messages generally are displayed for 5 to 10 seconds 2 and repeated in a rotation cycle as time permits. Requests for time on the Pearland City View 40 may be made on a "CityView Request" form. The forms are available from the Management Information Systems Department at City Hall. Requests for information to appear on Pearland City View 40 must be received three weeks in advance of the desired start date of airing. The City will attempt to grant all appropriate requests. Materials for events will be scheduled as promptly as possible and will be given priority according to timeliness when feasible. The City staff shall use its best efforts to put public meeting notice on the channel as soon as possible; however, notice on Pearland City View 40 will NOT suffice for compliance with the public notice requirement of the Brown Act. Pearland City View 40 will prioritize announcements according to its Goals and Objectives. The Pearland Channel Review Board as established by Ordinance No. 773, will review requests that do not strictly meet Pearland City View 40 guidelines and determine whether these requests are cablecast. Appeals may be made to the City Manager. The City Manager's ruling with be final.
