R97-10 02-10-97RESOLUTION NO. R97-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, SUPPORTING CERTAIN AMENDMENTS TO H.B. 3179, WHICH CREATED THE CLEAR CREEK WATERSHED REGIONAL FLOOD CONTROL DISTRICT, AS PROPOSED BY THE BOARD OF DIRECTORS OF SAID DISTRICT AND THE CLEAR CREEK WATERSHED STEERING COMMITTEE; AND PROVIDING OTHER MATTERS RELATING TO THE SUBJECT. WHEREAS, H.B. 3179, as adopted by the 74th Legislature of the State of Texas, provided for the creation of the Clear Creek Watershed Regional Flood Control District ("CCWRFCD"); and WHEREAS, the purpose of said H.B. 3179 was to establish a mechanism by which a cooperative regional effort could be made to reduce damage caused by flooding in the Clear Creek watershed in Harris, Galveston, Brazoria, and Fort Bend Counties; and WHEREAS, the Board of Directors of CCWRFCD and the Clear Creek Watershed Steering Committee believe that any regional effort to control flooding within the Clear Creek watershed must include the involvement of all affected governmental authorities, therefore necessitating an alteration of the boundaries of the CCWRFCD to include all such affected entities; and WHEREAS, such needed changes in the boundaries of the CCWRFCD, alteration of implementation schedules, and other minor amendments to H.B. 3179 are necessary to ensure accomplishment of the legislative intent and goals for the CCWRFCD; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The facts and matters set forth in the preamble of this Resolution are hereby found to be true and correct. RESOLUTION NO. R97-10 Section 2. The City Council of the City of Pearland, Texas, fully supports the amendment of H.B. 3179 as adopted by the 74th Legislature of the State of Texas, as recommended by the Clear Creek Watershed Regional Flood Control District and the Clear Creek Watershed Steering Committee, said proposed amendments being attached hereto as Exhibit "A" and incorporated herein for all purposes. Section 3. The City Secretary or her designee is hereby authorized and directed to cause a certified copy of this Resolution to be served on the presiding officers of the Clear Creek Watershed Regional Flood Control District and the Clear Creek Watershed Steering Committee and each member of the legislative delegation representing the City of Pearland in the Texas Legislature. NO. ;~179 AS RECOMMENDED BY CLEAR CREEK WATERSHED REGIONAL FLOOD CONTROL DISTRICT AND CLEAR CREEK WATERSHED STEERING COMMITTEE. Replace Section 3, page 2, Boundaries of District with the attached metes and bounds. Change Section 5, Page 6 and 7 from "not later than "two" years after the effective date .... "to "not later than three* years after the effective date .... ". Change Section 37, Maintenance Tax. Switch (a) with (b) and begin the new "a" (formerly "b") with "if approved by the voters". The new wording should read as follows: (a) (formerly b) an ad valorem Maintenance Tax under Subsection (a) must be authorized by a majority vote of the voters qualified to vote and voting in the district at an election called and held for the purpose. (b) (formerly a) if approved bV the voters,** the district may levy, assess and collect an annual ad valorem tax on all taxable property in the district for the maintenance, operation, upkeep, and improvement of the district and it's facilities, properties, and improvements. * changes ** addition to current bill
