BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Balancing Change Order associated with the Magnolia Expansion Project, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. COKER CITY ATTORNEY Exhibit "A" Resolution 2009-24 T70041 W.W.Webber Magnolia Road Expansion Balancing Change Order City of Pearland Projects Department CHANGE ORDER MAGNOLIA ROAD EXPANSION PEARLAND, TEXAS Date of Issuance: February 9, 2009 Contractor: W.W. Webber Engineer: Othon, Inc. Change Order No: Balancing CoP Project No: T70041 PO No: 072062 Title of Change: Balancing Change Order Explanation• At this time, construction has been deemed substantially complete, and all items of work are accounted for. Attached is a summary of original bid items, change order items and extra work items, and the over run amount and under run amount for each item. Original Bid Item Over Runs: A number of over runs of existing and original bid items were necessary. In some cases the Engineer's bid item quantities were insufficient to cover the work needed, and in some cases, existing bid items were utilized and over run in an effort to keep the contractor productive while change orders for the McLean and Harkey bridges were being approved. The total of Bid Item over runs was off set by items under run for a net total of $445,546.20. Below is a listing and explanation of major original bid item over runs. General Construction: #10 -Remove and Dispose Existing Asphalt Pavement: $88,474.26 -The quantities were exceeded by more than 100% (from 1 1,935 to 26,680.71 SY). This was due to the Engineer not taking into account the detour temporary pavement removals, and asphalt road removals at the Harkey and McLean bridges, and the improper length of existing transition removal calculations at Harkey, McLean bridges and McLean/Magnolia intersection. #12 -Remove and Dispose Existing Driveways: $19,020.26 -The quantities were exceeded by more than 400% (from 640 to 3,357 SY). This may be due to the difference between the actual measurements and the Engineer's measurements of existing driveways causing an underestimate of quantities. The removal of new W.W.Webber Magnolia Road Expansion Balancing Change Order driveways at the new Magnolia Elementary to tie in the roadway may not have been included in the Engineer's quantity. • #13 -Remove and Dispose Existing Storm Culverts: $31,596.00 -The quantities were exceeded by more than 290% (from 902 to 3,535 LF). The Engineer failed to account for many locations that had dual runs of storm pipe and actual field conditions demanded the removal of these in order to complete the work. Paving and Drainage: • # I S &# 16 -Roadway Embankment and Excavation: ($24,931.20) and $148,104.00 respectively -The embankment (fill) quantities were under run by 4,255.20 CY and the excavation (cut) quantities were over run by more than 350% (from 3,411 to 15,753 CY). The quantities for both the embankment and excavation items were incorrectly calculated by the Engineer by not taking into account the volume of roadway excavation by actual pavement elevation and pavement cross section depth, omitting the quantities for areas between the curb and right of way and possibly the quantities needed to complete the bridge embankment at the Harkey and McLean bridges. • #17 -10 in. Concrete pavement: $107,609.55 -The quantities were exceeded by 5.65% (2,753.57 SY) The overrun in quantities can be primarily attributed to the additional commercial concrete driveways that were tied in and replaced at Magnolia Elementary school, and additional removal and replacement of concrete pavement at Audubon Place. Both locations were replaced to match existing thickness. • # 19 and #20 -8 in. Lime stabilized subgrade and Lime for subgrade: $10,349.68 and $25,590.30 respectively. The quantities were over run by 18% and 20% respectively. The lime in roadway median areas at turn lanes appears to have been under accounted for in the Engineer's bid quantity calculations, as narrow areas at turn lanes had to be lime stabilized as well. • #23 -1 '/z in. Asphaltic Concrete Paving (Detour): $34,644.68. The quantities were exceeded by more than 240% (from 2,040 to 6,989.24 SY). The Engineer did not account for all detour paving necessary for the work. In addition to this, the temporary pavement between McLean and Veterans failed and had be replaced due to insufficient temporary pavement cross section design. • #26 -6 ft. wide Concrete Sidewalk: $21,666.69. The quantities were exceeded by 8% because tie-ins to existing sidewalks in adjacent neighborhoods were not accounted for in original bid quantities, and new sidewalk at Harkey Rd at Cypress Village had to be removed and replaced to construct the roadside ditch culvert with SET (Change Order #22). • #39 -24 in. Storm Sewer: $50,475.00. The quantities were exceeded by more than 12%. The Engineer may not have measured pipe lengths from center of manhole to center of manhole resulting under calculation of quantities. In addition to this, additional 24 in. storm sewer was required at the Harkey bridge and this item was utilized while other items could be included in a change order for Council approval. • #44 -54 in Storm Sewer: $50,325.00. The quantities were exceeded by more than 23%. Additional work at Outfall C at Mary's Creek and McLean Rd caused the over run. W.W.Webber Magnolia Road Expansion Balancing Change Order Water Line: • #67 -Fire Hydrant Assembly: $14,868.14. The quantity was over run by more than 20% due to 3 new Fire hydrants being added in the Harkey Bridge area, and a number of fire hydrants being raised due to roadway elevation changes. • #80 -Adjust Water Valve to grade: $26,000.00. The quantity was over run due to the Engineer miscalculating the number of hydrant valves that would be included and in the sidewalk, and not shown on the plans. Bridges: • #96 -Class S Concrete: 36,000.00. This quantity was over run due to sidewalks on the Harkey and McLean bridges being called for as placed with Class S concrete, however, the quantity called for only accounted for the bridge slab quantity. Change Order Over Runs: Change Orders created new bid items as they were called for. Certain new items added by change order were over run to utilize the established unit prices for the items, per the contract, and avoid re-negotiation of bid items at new prices (60 in. Storm pipe, established with Change Order #12). Other items, such as Pavement markings (established with Change Order #11), the Concrete Bike Trail under McLean Bridge (Change Order # 19), 8 in. Crushed Concrete Base (Change Order # 19), Concrete Median Noses (Change Order #20), and Median Nose paint (Change Order #21) were quantities that were over run based on actual quantities needed. The total of change order item over runs was $23,942.77. Extra Work Items: A number of extra work items were performed related to the McLean Bridge area such as water line work and sanitary force main work, and additional traffic control during the bridge closure. Other items included are related to Magnolia Rd, such as the substitution of a tapping sleeve and valve, extra work related to raising a fire hydrant to proper height, additional permanent signs along Magnolia Rd. and reflective bars at the McLean bridge for safety. The total of extra work item over runs is $43,050.19. Below is a detailed listing and description of these extra work items. • Magnolia Rd water line tapping sleeve and valve (TS&V) at STA 71+27: $2,617.66 - At the Magnolia Estates trailer parka 8x8 TS&V was replaced with a 10x10 TS&V. • McLean Bridge closure: $3,394.77 - After reviewing the original traffic control plan for the McLean Road bridge detour shown on Sheet 105, the City and Engineer felt the temporary signage was very inadequate to sufficiently direct the public through the detour during the bridge closure. The Engineer then provided a revised Sheet 105 showing an increase in barricades and signage for the detour. A cost of $3,394.77 is included for additional barricades and signs needed beyond the original Traffic Control plans. • McLean Bridge jiggle bars: $2,468.40 & Permanent signs: $4,413.70 -The Engineer revised the Pavement Markings and Signage Layout Sheets 67-73 to increase the number of permanent signs (stop signs, speed limit signs, etc.) by eight and to include jiggle bars (raised reflective bars) on the McLean bridge deck for traffic safety on the McLean bridge. A proposal for 156 units was requested, but only 85 units were actually placed. W.W.Webber Magnolia Road Expansion Balancing Change Order • McLean Rd. water line/ Centennial Park tap: $3,01 1.40 -While performing water line work along McLean Rd, the City found that the adjacent project, Centennial Park Splash Pad work was ongoing and found that W.W.Webber could perform the water line tap and extension to the park project more efficiently than having two contractors work in the same area and coordinating neighborhood water line shut downs. • Magnolia Rd. STA 73+30 fire hydrant adjustment:$926.75 -While placing fire hydrants, it was found necessary to adjust a fire hydrant height to bring the hydrant into compliance, however, the existing storm sewer below the hydrant caused a unique field adjustment and extra work. The City assisted in providing the allowable adjustment in the field. • McLean Rd. water line work: $1 1,487.99 -While working at McLean bridge, and replacing the water line crossing, it was found that the location for the new water line to tie onto the existing line north of the bridge needed to be adjusted and extended so that the new valves could be relocated out of the new roadway asphalt transition. Additionally, the water line work involved placing the water line under new storm placed during the bridge construction. The City requested W.W. Webber to perform this work on a time and material basis, and the materials were supplied by the City in order to speed the progress of the work. • McLean sanitary line work: $7,945.93 -The Engineer had not included the replacement of the sanitary forcemain along the McLean Bridge. Change Order #19 had addressed the attachments and replacement pipe material, however, the pipe bends and connection lengths were not included in order to adjust and reattach the forcemain. The additional material was provided by the City in an effort to keep W.W. Webber productive. • Inlet Risers: $515.00 -Inlet risers had been purchased by W. W. Webber in anticipation of inlet apron work along the project. When the City elected to self perform this work, with the sidewalk re-work, and the material was purchased from the contractor and placed by the City. • Water Line: $4,238.90 - 46 LF of 10 inch schedule 80 water line, purchased by W. W. Webber for the McLean Bridge water line work was found to be in excess, and due to this material being used by the City on repairs, the City opted to purchase the excess material and receive it into inventory, rather than pay a re-stocking fee. • Relocate/Re-set storm inlet at STA 18+11 on McLean Rd: $1,541.49 -Due to the depth of the side slope, sanitary forcemain and newly installed guardrail system on the NW side of the McLean bridge, the storm inlet at STA 18+1 1 had to be relocated to for clearance and to avoid conflicts. • Ryan Acres Gate Knox Lock: $112.18 -The plans called for a Knox lock at the Ryan Acres gate, however, due to the revised gate design a different type of lock had to be purchased. The Knox Lock is considered a unique item/lock. The total price for this change order includes all labor, equipment, materials, supervision and traffic control required to complete the aforementioned work.
