Page 1 of 27 - 3/13/2000 ,, 189 MAYOR'S ACTIVITY REPORT Mayor Reid and Councilmember Beckman presented a Proclamation to Delores Fenwick, Executive Director of Keep Pearland Beautiful, for the "Great American Cleanup'; Mayor Reid and Councilmember Seeger presented a Proclamation for "Poison Prevention Week in Pearland'; and also Mayor Reid and Councilmember Tetens presented a Proclamation to Nell Fuller for "ABWA 20 years Pear Tree Chapter." Mayor Reid reported that on February 291h he attended the TML Risk Pool Board of Directors Meeting, the Eyecare Boutique Open House, and the Region "H" Water District Public Meeting; March 2"' he attended the Chamber Ribbon Cutting for the Smartshop, Victory Insurance & ProPlay Zone; March 3 I he attended the Books for Kids Auction; March 4`h he attended the ProPlay Zone Opening; March 6'h he attended the PEDC Monthly Meeting; March 7'h he attended the AARP Monthly Meeting, and the District Education Improvement Council Meeting; March 81h he attended the Adult Reading Board Meeting; March 91h and 10`h he attended the Texas Association Regional Council Board of Directors Meeting; March 10'h he also attended the HGAC Annual Meeting & Banquet; March 12'h he spoke at the District Meeting of the Lions Club; March 13`h he attended the Trees for Pearland Board Meeting. COUNCIL ACTIVITY REPORTS Councilmember Beckman stated that the new library building opened this week, and the grand opening is scheduled for March 23, 2000 at 2:00 p.m. Councilmember Beckman invited and encouraged all Citizens to attend. Councilmember Tetens stated that he attended the Annual Meeting for HGAC. Lt. Governor Rick Perry was the guest speaker and spoke on the Pollution in the Houston area and how to clean it up. He also stated that this was the first HGAC Meeting for Brazoria County Judge John Willy is the President. Councilmembers Berger and Seeger did not give a report. CITY MANAGER'S REPORT City Manager, Glen Erwin, stated that the City is currently negotiating with Waste Management for a green waste program, and has almost reached an agreement that would be beneficial for both the City and Waste Management. The recommendation should be coming to Council with a proposal in the near future. He also reported the monthly department activity reports that Council was getting every month has been Page 2 of 27 - 3/13/2000 190 r-- condensed, and will be issued every quarter. R2000-33 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, SUPPORTING THE HOUSTON 2012 FOUNDATION'S EFFORTS TO BRING THE 2012 OLYMPICS TO HOUSTON. Mr. Ed Hersh, Parks and Recreation Director. Councilmember Tetens made the motion, seconded by Councilmember Beckman, to approve Resolution No. R2000-33. In an executive summary given by Parks & Recreation Director Ed Hersh he stated that the Representatives of the Houston 2012 Foundation, the organization seeking to bring the 2012 Olympics to Houston have visited with staff regarding the possibility of Pearland becoming the host venue for the Women's Olympic Softball event should Houston be awarded the Olympics in 2012. The Foundation's Sports Director and architect have toured the Centennial Park softball facilities and are seriously interested in our facilities. The proposed Resolution endorsing Houston as the host City will help to enhance Houston's bid while formally offering our support to the City of Houston and the Houston 2012 Foundation. Staff recommends this resolution for consideration. Mr. Hersh introduced Mr. Tom Lotz, Sports Director, Houston 2012. Mr. Lotz gave a brief presentation regarding Houston 2012 Foundation and their efforts to host the Women's Olympic Softball that will be held in 2012. FIRST READING OF ORDINANCE NO. 959 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, INCREASING THE FEE CHARGED FOR THE INSTALLATION OF BANNERS ACROSS FM 518 AND STATE HIGHWAY 35; HAVING A SAVINGS CLAUSE; HAVING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AND A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Darrin Coker, City Attorney. Mayor Pro -Tem Berger made the motion, seconded by Councilmember Tetens, to approve Ordinance No. 959 on its first reading. Page 4 of 27 - 3/13/2000 192 In an executive summary given by City Attorney, Darrin Coker, he stated that the City has in the past installed banners across FM 518 and State Highway 35 for organizations upon proper application and payment of a fee in the amount of $50.00. Unfortunately, the City's bucket truck that was previously used to install the banners is no longer operable, thus requiring the City to rent a lift vehicle in the amount of approximately $250.00. The proposed ordinance will allow the City to accommodate organizations by renting the vehicle and passing the additional cost to the organizations requesting this special service. Staff recommends consideration of Ordinance No. 959. Voting "Aye" Councilmembers Beckman, Tetens, Berger, and Seeger. Voting "No" None. Motion passed 4 to 0, with Councilmember Wilkins absent. FIRST READING OF ORDINANCE NO. 960 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, REVISING THE CAPITAL IMPROVEMENTS PLAN FOR THE CITY OF PEARLAND; UPDATING IMPACT FEES IN ACCORDANCE WITH STATE LAW; MAKING CERTAIN FINDINGS; PROVIDING A PENALTY FOR VIOLATION; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND A REPEALER CLAUSE; PROVIDING FOR PUBLICATION, CODIFICATION AND AN EFFECTIVE DATE. Mr. Alan Mueller, Deputy City Manager. Councilmember Seeger made the motion, seconded by Councilmember Beckman, to approve Ordinance No. 960 on its first reading. In an executive session given by Deputy City Manager, Alan Mueller, he stated that at the February 28, 2000, Public Hearing on this subject, he stated that the deadline for adoption of the new fee was three years from the adoption of the old fee. Upon further review, it appears that the statute requires adoption of the fee within 30 days of the Public Hearing or another Public Hearing must be held. In an attempt to adopt the fee within the 30 -day period, staff recommends the following schedule to be March 13, 2000, first reading of Ordinance; March 20, 2000, Workshop; March 27, 2000, second and final reading of the Ordinance; making it 60 days after final reading the effective date. The Water Impact Fee based on 6,426 service units is $1,803 which is the eligible Impact Fee. The proposed impact fee on the same number of service connection is $1,403. The Wastewater Impact Fee based on 6,426 equivalent service units is $2,933 which is the eligible fee, and the proposed Impact Fee for wastewater is $2,060. The total Water and Wastewater Impact Fee eligible amount is $4,736 and the proposed Impact Fee is $3,463. Page 5 of 27 - 3/13/2000 +„ 193 Larry Marcott, 3606 Inverness Court, addressed Council and stated that he recommends that Council conduct another hearing on the Impact Fees. He further stated he has a lot of concerns after the last meeting, because the Impact Fees are doubling, and the fees should be looked into before the City adopts them as they are. Dennis Frauenberger, Chairman Pearland Economic Development Corporation, addressed Council and stated the he is representing the board of directors as well as staff. He further stated at their last meeting the board found themselves behind the curve on the Impact Fees Ordinance and did not know that it was as close to being adopted as it is. He also stated that the PEDC has scheduled a special meeting so that they can come up with some recommendation or outlook on the proposed Impact Fees. Mr. Frauenberger said PEDC would like to have a workshop with Council to discuss the proposed Impact Fees. He said that PEDC is working extremely hard for the economic development of the area and the board is not sure what kind of disadvantage the Impact Fees are going to give PEDC if any at all. In closing he asked the Council to consider meeting with the PEDC Board. Mayor Reid stated that he has looked at the Impact Fees of other cities, and they were fortunate to have in place a service infrastructure city. The City of Pearland has grown at such a rapid rate that the small infrastructure that the City has had in place has been stripped. As a result the City is having to catch up with the growth that have now. The City is spending a lot more money for water and sewer than any other City proportionally, because of the rapid growth in population. Mayor Reid further statedaat without Impact Fees the City may have to consider a moratorium on the issuance of building permits, because of the lack of proper infrastructure. He also stated that the purpose of the Impact Fees is for the people who are coming and impacting the system to fund the growth of the infrastructure. Councilmember Tetens stated that when he served on a previous Council, some of the Council felt if the Impact Fees were enacted it would stop growth. The Council did go ahead an enact the Impact Fees, and when they did, it did not have any effect on the building permits. He further stated that he does agree that the recommended increase is really severe, and the City needs to prorate it in, or at least tone it done somewhat. Mayor Pro -Tem Berger stated it is important to keep up with the growth and services and tying one to the other. He further stated he agrees it will be efficient to combine a workshop with the PEDC and Council. Councilmember Beckman stated that she agrees that the workshop will be very helpful, and with one workshop the Council should be ready to vote at the next meeting. Page 6 of 27 - 3/13/2000 194 r— Hopefully with the workshop we will be able to work through a lot of these concerns. She further stated that she does not want to see the fees so high that an undo burden is put on the people who are building in Pearland. However, at the same time the City has to have the services available for them when they build. Councilmember Seeger stated that the Impact Fees are not an arbitrary number. This is number that the City is going to need to maintain to build new infrastructure as new construction requires it. If the City does not meet the project needs for the infrastructure then it is obvious that all home owners are having to pay higher bills in the form water and sewer fees, and it is going to come from one or the other. Therefore, if new construction does not pay the Impact Fees then all the homeowners will have to pay higher and water sewer fees, or the City slows down growth. HALL LEAGUE, A-709 & PARTS OF LOTS 13-24, S.W. NARREGANG SUBDIVISION, VOLUME 1, PAGE 92 & ALSO LOTS 1 & 2, GEORGE W. Councilmember Beckman made the motion, seconded by Councilmember Tetens, to approve Ordinance No. 509-416 (Application No. 885) on its first and only reading. Page 7 of 27 - 3/13/2000 195 Mayor Reid read into the record the Planning & Zoning Commission's recommendation to approve (Application No. 885). In an executive summary given by Director of Community Development and Services Gene Tumlinson he stated that Zone Change Application No. 885 is requesting to change the zoning classification from Single Family Dwelling District (R-1) to Single Family Dwelling District (R2 -PUD). Staff recommends consideration of request. Councilmember Tetens stated twice before this Subdivision has come before Council, and it has had minor revisions to it, with no large change. The Council determined two previous times that R-1 is the highest and best use of this land. It is back again tonight with no substantial change. He also stated that he does not see anything that will change his mind. It is still not R-1 which is the highest and best use. Ken Caffey and Clinton Wong, Amvest Properties, addressed Council and stated the subdivision consist of approximately 120 acres, which is an extension of the existing subdivision that they had started approximately five years ago. It is just north of Dixie Farm Road. Mr. Wong stated that they have conformed to all of the regulations for an R-2 PUD (Planned Unit Development). He further stated that the homes in the subdivision will sell for approximately $140,000 to $200,000. He gave a presentation regarding the proposed subdivision in detail. Larry Marcott, 3606 Inverness Court, addressed Council and stated that it seems to him that Mr. Wong always wants to make his subdivisons a higher concentration. There is nothing that he has seen that is currently an R-1, that Mr. Wong has left an R-1. Mr. Marcott stated that he has a problem with that. He further addressed his concerns regarding down stream flooding which will affect his subdivision. In closing Mr. Marcott stated this property is now an R-1, therefore, it should stay an R-1. There was additional discussion among Staff regarding density, and density requirements. Mayor Pro -Tem Berger stated that this project was started a year ago, and the Council Chamber was full of concerned residents of Shadycrest, and they had two major concerns. One concern was the traffic from the new section of Oakbrook, and second, concerns they had about drainage from the new development. If this land use change had been turned down a year ago, remembering that two-thirds is R-1, one third of the property is R-3 even a higher density that what is being called for on the R-2 PUD (Planned Unit Development) today you would have streets going through Shadycrest with more traffic. Traffic is the biggest concerns that the residents had. Secondly, you would Page 8 of 27 - 3/13/2000 396 not have more than 5 acres of park land today that the City is getting out of this concession, and large lots are bordering Shadycrest. Mayor Reid stated that striking the best balance with the developer and residents of Shadycrest is possible. Councilmember Tetens stated the only reason they put in a park land is because the City requires a park. The land that is designated as park land cannot be developed anyway. The large lots that they are putting next to Shadycrest are 70 foot wide, and that is an R- 2 lot. Councilmember Beckman stated that the term R-2 PUD (Planned Unit Development) is a little misleading. An R-2 PUD (Planned Unit Development) allows you to build on a smaller lot than what an R-2 would, which is a 70 -foot wide lot. There are not any R-1 lots in this subdivision. There are 62 R-2 lots, which are 70 foot wide, all the rest are anything less than 70 foot which is considered an R-3 lot. She said that needs to be taken into consideration as well, and R-1 is still the highest and best use for the property. Additional discussion ensued among Council regarding this land use change. Voting "Aye" Councilmembers Berger and Seeger. Voting "No" Councilmembers Beckman and Tetens. In order to break a tie vote, Mayor Reid must cast his vote. Voting "Aye" Mayor Reid. FIRST READING OF ORDINANCE NO. 450-25 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 450 AS THE SAME MAY HAVE BEEN, FROM TIME TO TIME, AMENDED, FOR THE PURPOSE OF ESTABLISHING AND REESTABLISHING CLASSIFICATIONS AND NUMBER OF AUTHORIZED POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF PEARLAND, PURSUANT TO SECTION 143.021 OF THE LOCAL GOVERNMENT CODE OF THE STATE OF TEXAS; PROVIDING A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A REPEALER CLAUSE, AN EFFECTIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. In an executive summary given by Police Chief J.C. Doyle he stated that Local Government Code § 143.021 requires the City to annually review its number of authorized Civil Service Employees and the Pay Classification Plan for such employees. Additionally, the City must adopt an Ordinance amending any changes in the number of authorized employees and adjustments to their pay scale. To date, there are 61 authorized Civil Service positions and the attached pay scale reflects the current fiscal year's pay increase. Staff recommends consideration of Ordinance No. 450-25. R2000-28 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO AN INTERLOCAL AGREEMENT WITH BRAZORIA COUNTY PERMITTING THE COUNTYTO FURNISH A HERBICIDE SPRAY TRUCK WITH OPERATOR TO THE CITY OF PEARLAND FOR A PERIOD OF FOUR WORK WEEKS IN APRIL, MAY, AND JULY OF 2000, TO SPRAY STREET RIGHTS-OF-WAY IN THE CITY. In an executive summary given by City Attorney Darrin Coker he stated that the City and Brazoria County annually enter into an agreement which allows the County to provide a herbicide spray truck and an operator for two weeks during April and May and for two weeks during July. The purpose of the agreement is to control the growth of weeds and grass on street rights-of-way located within the City. The County will provide all labor and equipment up to $3,000.00, while the City agrees to furnish all materials. Staff recommends consideration of Resolution No. 2000-28. R2000-29 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO AN INTERLOCAL AGREEMENT WITH BRAZORIA COUNTY TO SHARE EQUALLY IN THE COST OF CONDUCTING A TRAFFIC STUDY TO CONSIDER THE INSTALLATION OF A TRAFFIC SIGNAL ON COUNTY ROAD 89 AT COUNTY ROAD 648 (NORTHFORK DRIVE). In an executive summary given by City Attorney Darrin Coker he stated that the County has asked the City to participate and share the cost of a traffic study necessary to consider installation of a traffic signal on County Road 89 at County Road 648 ( Northfork Drive). The City and County agree to share the costs, not to exceed $2,000.00, equally. Staff recommends consideration of Resolution No. 2000-29. R2000-30 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ASSIGNING THE AUTHORITY TO ISSUE SINGLE FAMILY MORTGAGE REVENUE BONDS TO BRAZORIA COUNTY AS A SPONSORING POLITICAL SUBDIVISION OF THE SOUTHEAST TEXAS HOUSING FINANCE CORPORATION. SINGLE FAMILY MORTGAGE REVENUE BONDS. Mr. Darrir Coker, City Attorney. Councilmember Beckman made the motion, seconded by Councilmember Tetens, to approve Resolution No. R2000-30. In an executive summary given by City Attorney Darrin Coker he stated that the Southeast Texas Housing Finance Corporation (SETH) works in Brazoria County to help provide safe, sanitary, and affordable housing in certain cities throughout Southeast Texas. SETH is proposing a financing mechanism that will enable them to offer affordable single family housing in Brazoria County. However, the Texas Housing Finance Corporation Act requires a municipality with a population of greater than 20,000 Page 11 of 27 - 3/13/2000 199 inhabitants to pass a resolution if it desires to participate in the programs offered by SETH. Five consultants were initially selected for interviews. From the five, the field was narrowed to two finalists, which ultimately made GIS presentations to the City's Department Heads. Geographic Technologies, Inc., (GTG) was selected and their references were checked. GTG received top marks from their previous clients. Currently there is $100,000 in this fiscal years GIS budget, with approximately $50,000 allocated for consulting. The remaining balance is set aside for the purchase of the GIS workstation, employee training and miscellaneous GIS data conversion. The scope of services for the consultant will include the development of a needs assessment, and feasibility study and three year phased implementation plan. Additionally, the consultant will begin phase one of the implementation plan that will include on-site technical services and data conversion. Staff recommends that Council approve the attached contract, and subsequent expenditure of $50,000 to GTG for the professional services associated with the City of Pearland's GIS program. In an executive summary given by Project Manager Michael Ross he stated that the Texas Department of Transportation is the process of designing the improvements to SH 35, from Beltway 8 to FM 518. Currently, TxDOT intends to let the project in August of 2002. On November 24 and October 4, 1999 staff met with Council to discuss proposed enhancements to the project. At that time Council agreed on the desire for enhancements along the major thoroughfares in the City, including SH 35. TxDOT has informed staff that the City's selection of enhancements will affect the level of the City's cost participation in the project. For example, if the City chose to select sidewalks throughout the project the City would be responsible for the additional cost above what TxDOT would normally pay. TxDOT requires a formal Council resolution of the desire for enhancements before they will consider them for inclusion in the project. Staff recommends that Council approve the Resolution. The most logical solution was to ask the City for permission to use the southwest corner of the City's property located adjacent to the construction site, Consequently, I prepared a license agreement which permits the use of the southwest corner (200'x 200) for the limited purpose of placing the construction trailer, parking, and storage. The term of the agreement is for five months and the contractor agrees to indemnify the City as well as waive any liability of the City. The contract period is for one year with option to extend for an additional one year. The City will purchase required quantities for new construction and line extensions base on budget availability. Pricing may be adjusted during the contract period based on pass through cost increases or decreases posted by material suppliers. Concrete manholes are installed in sanitary sewer lines every 400 to 500 feet, each roadway intersection and at turn points in the line. They are used for cleaning the system and for inspection. The supply contract bid method was utilized to support department activity for maintenance and for new construction purchases. The supply contract will allow staff to purchase needed material at the unit price with out rebidding and possible delay of projects. The evaluation criteria used to determine the low bidder was based on two standard sized (8' & 12') manholes.
