R97-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO AN AGREEMENT WITH WALSH ENGINEERING, INC. FOR ENGINEERING AND SURVEYING SERVICES FOR A SANITARY SEWER IMPROVEMENT PROJECT, INCLUDING PREPARATION OF PLANS AND SPECIFICATIONS FOR A LIFT STATION AND A FORCE MAIN. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain agreement by and between the City of Pearland and Walsh Engineering, Inc., a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest the three originals of the attached agreement for and on behalf of the City of Pearland for engineering and surveying services for the sanitary sewer improvement project, including preparation of plans and specifications for the lift station and force main. Box 2068 Pearland, Texas 77581-5416 Re: Request for Proposal for Engineering and Surveying Services for Sanitary Sewer Improvement Project consisting of a lift station, approximately 8,300 feet of force main and approximately 300' of 12" gravity line to serve an area south of John Lizer Road in the vicinity of Centennial Blvd. Dear Mr. Burdine: Per your request of February 28, 1997, Walsh Engineering, Inc. is pleased to submit this proposal to provide engineering and surveying services for the referenced project. SCOPE OF WORK A. Preliminary and Deslqn Phases: Meet with the City Staff and select the lift station site and the force main route. Improvements are proposed to be placed within City- owned property/R.O.W. Conduct field survey to gather topographical information for the purpose of design of the lift station and force main. No field or office work will be performed for the easement acquisition since improvements will be within City-owned property/R.O.W. Assist the City in conducting a geotechnical investigation for the purpose of lift station design. With assistance from the City, define the intended lift station service area. Design the gravity line and force main. Prepare construction specifications and contract proposed improvements. plans, technical documents for the Assist the City in acquiring approval from the Brazoria Drainage District No. 4 for the force main crossing at Mary's Creek and a ditch south of John Lizer Road. 9. Prepare a post-design construction cost estimate. 10. Provide the City with ten (10) copies of plans and specifications. Construction Phase: 1. Assist the city in Bidding phase. Assist the City in evaluation the bids and awarding the construction contract. Assist the City during the construction phase with project management, periodic inspection, preparation of monthly estimates, review of inspections, issuance of Certificate of Completion and other items as specified by the most recent publication of TSPE defined services for construction projects. PERIOD OF SERVICE Upon receipt of your written authorization, we will proceed with the performance of the work so as to deliver the plans, quantities, and specifications within ninety (90) days. This time does not include review and approval time by the City, and the Brazoria Drainage District No. 4. BASIS OF COMPENSATION The compensation to the Engineer for the work shall be as follows: A. Preliminary and Design Phase: The compensation to the Engineer for the preliminary and Mr. Richard Burdine March 5, 1997 Page 3 design phase of the work shall be determined as a percentage of the project construction based on the Harris County's Curve for Engineering Compensation, a copy of which is attached hereto as "Exhibit A". Compensation for this phase shall be 85 percent of the fee computed. For the purpose of invoicing a construction cost estimate of $248,600 at a percent fee of 10.2% (12.00% x .85) shall be used. This fee is computed to be $25,357.00. The final fee shall be adjusted based upon the contractor's price for the work. B. Construction Phase: The compensation to the Engineer for construction phase shall be 15% of the total basic fee computed as described in Section A of Basis of Compensation. This estimated fee is computed to be $4,475.00 C. Field Surveying work: A budget not to exceed $7,000.00, is recommended for the field survey work to gather topographical information and defining the existing R.O.W.'s. This budget does not include field and office work for acquisition of any easement. This service shall be invoiced based upon our current Schedule of Per Diem Charges (see attachment). This amount shall not exceed without prior authorization from the City. D. Geotechnical The cost of a geotechnical report is not included in the above fees. We suggest a budget of $2,000.00 be allocated for this service. This service shall be billed at subcontractor's cost, plus 10%. Payments will be made in proportion to that part of the services which have been accomplished as evidenced by monthly statements submitted by our firm. If within 30 days of the date of any such statement, the City shall fail to pay the Engineer the full sum specified in any statement, then the City shall pay to the Engineer, in addition to the sum shown as due by such statement, interest on any unpaid portion thereof, at the current prime rate per annum from the date of such statement until fully paid, which shall fully liquidate any injury to Engineer arising from such delay in payments. Richard Burdine March 14, 1997 Page 4 TERMS AND CONDITIONS It is expected that after services for this project have been initiated, they can proceed as outlined herein without undue interruption caused by lack of essential information required from you. Such interruption, understandably, requires both reassignment of manpower, delay in completion, and will constitute a change of scope. Additional effort required by such delays will be billed on per-diem charges attached to this contract. We propose that this Agreement may be terminated without cause at any time prior to completion of the work either by yourself, or by us, by giving 15 days written notice to the other. Upon termination you would owe us for compensation earned under this Agreement to the date of termination. Copies of all completed or partially completed notes or plans prepared on this project would be delivered to you if this termination occurred. It is understood that this Proposal is valid for thirty (30) days. Subsequent to that date, we reserve the right to review the basis of payment to allow for changing costs as-well-as to adjust starting and completion dates to conform to work load. If this Proposal meets with your approval, we would appreciate your signing one copy below and returning it to us. Salary cost is defined as the cost of base salaries chargeable to the Project, plus 29% for social security contributions, unemployment, excise and payroll taxes, medical and insurance benefits, sick leave, vacation, holiday benefits and like items.
