PURPOSE OF HEARING - PROPOSED ANNEXATION
To consider the proposed annexation of approximately a 204.5101 acre tract of land out of
the W.D.C. Hall Survey Abstract No. 23, Harris County, Texas and being out of the tract of
land described as 373.336 acres as described in a deed to Leonard Rauch and David W.
Berg, Trustees, as recorded under Harris County's Clerks File Number(s) G188537 to
G188552 of the Official Public Records of Real Property of Harris County, Texas and a
120.1381 acre tract of land out of the W.D.C. Hall Survey, Abstract No. 23, Harris County,
Texas, and being out of the 4 (four) tracts of land described as "TRACT NO. ONE" as
conveyed to Inez Vivian Mc Ginnis, individually as per an instrument recorded under Harris
County Clerk's File No. R473344 (Film Code No. 504-47-2224) of the Official Public
Records of Real Property of Harris County, Texas.
STAFF REVIEW OF PROPOSED SERVICE PLAN
Deputy City Manager, Alan Mueller, stated that this annexation consist of consists of two
individual tracts of land one being 204 acre section and a 120 acre property the
approximate total togther 324.6482 acres. This property is in Harris County, bordered on
Clear Creek to the south and the Green Tee Subdivision to the west, and to the City of

Houston ETJ (extraterritorial jurisdiction) to the north. He furthered reported this property
is currently undeveloped and vacant. This hearing is the first of two public hearings as
required by state law for the annexation of the property. This annexation has been
requested by the owners of the property. The notices that are required by state law have
been either mailed or advertised in the Pearland Reporter Newspaper. The second public
hearing is scheduled for January 24, 2000 at 6:30 p.m. Mr. Mueller gave a detail overview
of the service plan for this property.
CITIZEN COMMENTS
Renee West, 2401 Country Club, addressed Council and stated this is going to be an asset
to the City to annex this property. She stated over the next four or five years it will create
$3.0 million in impact fees and $1.0 million a year in taxable income. This annexation will
not have an impact on the School District, because most of it will be retirement community,
in the Clear Brook Independent School District. Ms. West further stated that this will add a
lot of positives things to the City, she cannot think of any determents.
COUNCIUSTAFF DISCUSSION
Councilmember Seeger stated this annexation is going to have a substantial impact on the
neighborhood, particularly on Green Tee. He further stated that he is soliciting any
comments from the residents of Green Tee, at the next public hearing on January 24, 2000.

PURPOSE OF HEARING - TO CONSIDER THE ABANDONMENT OF ROAD RIGHT-OF-
WAY.
LEGAL DESCRIPTION
Abandonment of unused dedicated road right-of-way, being approximately 0.142 acres,
located in the R.B. Lyle Survey, Abstract 543, in Brazoria County, Texas, and being a
portion called Knapp Road that lies between Mykawa and State Highway 35.
STAFF REVIEW OF ABANDONMENT OF ROAD RIGHT-OF-WAY
City Attorney, Darrin Coker, stated that this is where the McHard Road overpass was built,
and as a result of that the Knapp Road crossing at the railroad is going to be closed.
Therefore, this is the abandonment of that right-of-way. Barricades will be constructed when
the closure is complete. The railroad company is paying the City approximately $225,000
for the closing, signage and to barricade each side of side of Knapp Road at the railroad
crossing.

COUNCIUSTAFF DISCUSSION
Mayor Pro -Tem Berger stated the Knapp Road Railroad crossing is one of the most
dangerous that we have had in the City. He further stated that he welcomes that closing
as soon as possible.
Mayor Reid asked if the City has to conduct a second public hearing regarding this?
City Attorney, Darrin Coker, stated that this is the only public hearing required on this
particular abandonment, and on the January 24, 2000 Regular Council Agenda, there will
be an ordinance prepared for the abandonment of this right-of-way, and at that time
Council will have the option of taking action.

PURPOSE OF HEARING - TO CONSIDER THE ABANDONMENT OF UNUSED
DEDICATED. ROAD RIGHT-OF-WAY.
LEGAL DESCRIPTION
Abandonment of unused dedicated road right-of-way, located in the H.T. & B. R.R. Company
Survey, Abstract 239, in Brazoria County, Texas, and being a portion that lies between
Magnolia and State Highway 35.
STAFF REVIEW OF ABANDONMENT OF UNUSED DEDICATED ROAD RIGHT-OF-
WAY
City Attorney, Darrin Coker, conducted a presentation giving the location of this property.
He stated the owner of this property has requested the abandonment of an unused sixty -
foot right-of-way which crosses across the middle of the property. Mr. Coker also stated this
is the property that was recently considered for a zone change application from M-1 to M-2,
which the Council did deny. The property is currently zoned M-1, and the owner of the
property has it on the market. He also stated that this is the only public hearing for this

particular abandonment, and an agenda item will be place on the January 24, 2000, agenda
in order for the Council to take action to abandonment the right-of-way.
CITIZEN COMMENTS
None.
COUNCIL/STAFF DISCUSSION
Mayor Pro -Tem Berger asked since there are not any utilities in the right-of-way is there
a downside for the City abandoning this right-of-way?
City Attorney, Darrin Coker, stated the Staff cannot find any downside in this particular
situation. There are no easements. Typically if there was going to be an abandonment by
the City and there were easements where there were utilities in the area. The City's
requirement would be contingent upon the execution of the easements back to the City,
and that would be required prior to that actual abandonment.
