AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, DETERMINING A PUBLIC CONVENIENCE AND NECESSITY TO
ACQUIRE FEE SIMPLE TITLE AN EASEMENT FOR THE
CONSTRUCTION OF ROAD, WATER, SEWER AND DRAINAGE
IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBED HEREIN;
AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, AND OTHER
CITY OFFICIALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO
ACQUIRE PROPERTY, LOCATED WITHIN THE CITY, BY DONATION,
PURCHASE, OR BY THE EXERCISE OF THE POWER OF EMINENT
DOMAIN; AND DECLARING AN EMERGENCY AS THE CONSTRUCTION
OF MUNICIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE
HEALTH, SAFETY AND WELFARE OF THE CITIZENRY; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes that a public convenience and necessity
exists for the location, construction, operation, and maintenance of road, utility and
drainage improvements on certain real property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the
public's best interest to acquire fee simple title and an easement to certain property for the
construction of road, utility and drainage improvements on said property; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public
convenience and necessity exists for the construction of road, utility and drainage
improvements on certain real property located in Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of right-
of-way, by donation, purchase, condemnation, or otherwise, of certain real property located
within the City and situated in Brazoria County, more particularly described in Exhibits "A",
"A-1", "B" and "B-1"attached hereto and incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to

acquire the property, described in Exhibits "A", "A-1", "B" and "B-1" any improvements
thereon, either by donation, purchase or the exercise of the power of eminent domain.
Section 4. The City Council hereby declares that a public emergency exists for
the acquisition of said property as the construction of road, utility and drainage
improvements bears directly upon the health, safety, and welfare of the citizenry; therefore
this Ordinance shall be passed finally on its first and only reading and shall take effect
immediately upon its passage and approval by the City Council.

plat thereof as filed in Volume 29, Page 43 Brazoria County Deed Records and being out of H.T.
& B. R.R Company Survey, Abstracts 232 and 542, Pearland, Brazoria County, Texas and being
out of that certain tract as described in a deed dated 11-18-1946 from H. V. Melville to Hastings
Oil Company as filed in Volume 508, Page 383, Brazoria County Deed Records and being more
particularly described by metes and bounds as follows (bearings based on Texas Coordinate
System of 1983, South Central Zone);
Beginning at a point harking the southwest comer of Safeway Addition No. 1 according to the
plat thereof as filed in Volume 16, Page 11-12 Brazoria County Plat Records, from which a
found 5/8" iron rod bears S 28° 23' 11" E - 0.24' from said point and said point being on the
existing north right-of--way line of Orange Street;
l . Thence S 02° 19' 17" E - 36.92' to a point for corner;
2. Thence S 87° 15' 35" W - 273.46' with the south line of said Lots 15 and 16 to a point for
corner;
3. Thence N 16° 30' 00" W - 70.92' with easterly right-of--way line of G.C. & S.F. Railroad
(100' wide) to a set 5/8" iron rod with cap (stamped C.L. DAVIS-RPLS 4464) for corner;
4. Thence S 83° 36' ] 8" E -199.78' with the proposed north right-of-way line of Orange Street
to a to a set 5/8" iron rod with cap (stamped C.L. DAVIS-RPLS 4464) for comer;
5. Thence N 87° 24' 98" E -- 93.15' continuing with the proposed north right-of--way line of
said Orange Street to the POINT OF BEGINNING and containing 0.3060 acre (13,327
square feet) of land more or Less.
