R2008-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DECLARING A MORATORIUM ON PLATTING REQUIREMENTS FOR OWNERS OF EXISTING LOTS ZONED AND USED AS SINGLE FAMILY RESIDENTIAL WHO SEEK TO CONSTRUCT NEW ACCESSORY STRUCTURES OR TO IMPROVE, EXPAND, OR REPLACE STRUCTURES ALREADY LOCATED THEREON. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City Council hereby declares a moratorium on platting requirements for owners of existing lots zoned and used as single family residential who seek a building permit to construct new accessory structures or to improve, expand, or replace structures already located thereon. Section 2. Any structure sought to be replaced shall not have been destroyed or demolished more than six (6) months prior to the making of application for a building permit to rebuild said structure. Section 3. Nothing contained herein shall be construed to waive any other requirement of the Unified Development Code, applicable building codes or other regulations of the City, or to contradict the platting requirements of Texas Local Government Code Chapter 212 applicable to the subdividing of land. Section 4. The Moratorium established herein shall automatically expire on the earlier date of January 31, 2009 or the date of adoption of new regulations amending the provisions of the Unified Development Code requiring plats to be filed prior to issuance of a building permit to improve or expand existing structures located on lots zoned and used as single family residential.
