Ord. 509-106-1 12-13-99ORDINANCE NO. 509-106-1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509-106 OF THE LAND USEAND URBAN DEVELOPMENT ORDINANCE, OF THE CITY OF PEARLAND CODE OF ORDINANCES, FOR THE PURPOSE OF EXTENDING THE TERM OF SPECIFIC USE PERMIT NO. 46 UNTIL DECEMBER 3'1,200'1; HAVING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; AND OTHER PROVISIONS RELATED TO THE SUBJECT. WHEREAS, the City Council passed Ordinance No. 509-106 on November 25, 1996, allowing the erection of subdivision direction signs in the City; and WHEREAS, the Peadand Area Homebuilders and Developers Association has petitioned the City to extend the term of Specific Use Permit No. 46 until December 31,2001; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. There is hereby issued a Specific Use Permit, valid until December 31, 2001, to allow for Pregrem Signs to be located within the main corridors of the City, as defined in Section 22.17(1) of Ordinance No. 509, as amended, the Land Use and Urban Development Ordinance, of the City. Section 2. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid pretest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. 1 ORDINANCE NO. 509-106-1 Section 3. The City Council of the City of Pearland finds and determines that the Specific Use Permit granted herein promotes the health, safety, and welfare of the public, and is a proper, valid exercise of the City's police powers. Section 4. Savings. All rights and remedies which have accrued in favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. Section 5. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 6. Effective Date. This ordinance shall become effective upon passage and approval of its second reading. PASSED and APPROVED ON FIRST READING December , A.
