R99-106 12-13-99RESOLUTION NO. R99-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AWARDING BID NO. B98-001 FOR CONSTRUCTION OF THE VETERANS/MAGNOLIA SANITARY SEWER LINE AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO A CONTRACT FOR SAID CONSTRUCTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1.. That the City opened bids for Bid No. B98-001 on December 1, 1999, and such bids have been reviewed and tabulated. Section2. That the City Council hereby awards Bid No. B98-001 to Pate & Pate Enterprises, Inc., for construction of the Veterans/Magnolia sanitary sewer line in the amount of $1,592,371.70. Section 3. The City Manager or his designee is hereby authorized to execute a contract for construction of the Veterans/Magnolia sanitary sewer line. and ADOPTED this the 13th day of APPROVED , A.D., 1999. At that time the apparent low bidder was Pate & Pate Enterprises, Inc., in the amount of $1,592,371.70. Since that time the City's consultant (Carter & Burgess, Inc.) has reviewed and tabulated the bids and checked references on the low bidder. A copy of the engineer's recommendation letter is attached for reference. During the consultants evaluation of the contract documents it was detemained that some of the estimated quantities may be lower than what will actually be encountered in the field during construction (see attached letter). Therefore the consultant is recommending that the City approve a 5% project contingency in the amount of $79,618.59 to cover any quantity deficit. Obviously this contingency would not be used unless warranted. The funding for this project is available in account number 057-7700-577.03-00. This project is one of the Texas Water Development Board (TWDB) State Revolving Fund (SRF) Tier 11I projects; therefore the final bid award is contingent on the TWDB's approval. Recommendation: Staff recommends acceptance of the low bid and award of the contract to Pate & Pate Enterprises, Inc., in the amotmt of $1,592,371.70. We recommend that the construction phase, of this project be awarded to Pate & Pate Enterprises, Inc., based on the bid amount of $1,592,371.70. Gray, Inc. - Bid Item No. 2 which resulted in an increase in Total Price from $2,354.00 to $12,354.00. No change to Total Base Bid Price. E. P. Brady, Inc. - Total Base Bid Price was incorrectly calculated which resulted in an increase from $1,738,327.70 to $1,752,946.50. Calco, Inc. - Total Base Bid Price was incorrectly calculated which resulted in a decrease from $1,766,379.00 to $1,766,374.00. Bids submitted on this project were unit price bids and the total contract amount is based on estimated quantities. During an evaluation of the contract documents it was determined that some of the estimated quantities may be lower than what will actually be encountered in the field. We are requesting that the City of Pearland set aside an additional 5% ($79,618.59) of the bid amount to be used as a contingency should the final quantities installed differ from the original estimated quantities. This amount will not be added into the contract at this time; however, it should be reserved for a change order to adjust the quantities at the end of construction.
