II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Light Industrial District (M-1) to Heavy Industrial District (M-2) on the following described property, to wit: Legal Description: Being 26.88 acres out of the H. T. & B. R.R. Co. survey, Section II, A-239, Brazoria Co., TX (Veterans Road) Owner: Liquid Transporters, Inc. 3939 Atkinson Drive Louisville, KY 40218 Agent: Mr. Mark Nicholas/The Staubach Company Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location map. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST 23, IV. Mark Nicholas, 1 Riverway Suite 1850, Houston, presented aerial photographs of the site. He explained that most of the zoning in the area is already zoned M-2. Randy Woochie of Vulcan Materials, stated that they are the proposed buyer for this stone distribution yard. He explained that materials would come in by rail from the Brownwood area. He stated that they would initially have two full time employees and ten to fifteen trucks, He hopes eventually to have twenty-five to forty trucks. He stated that this site includes four thousand foot of railroad track. The overall cost of the project is twenty five million dollars. He added that they are the largest quarry company in North America and they are U.S. owned, Mr. Woochie also stated that there are 330 operations under the Vulcan name. He showed pictures of other sites and quarry where rock comes from. Will Benson of Peariand Economic Development Corporation explained that he has visited their existing site. He stated that it is a very beautiful site with a landscaped entry. He added that the requested zoning is consistent with the zoning in the area. He also stated that the neighbor to the North of this property is an existing concrete company. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Mac Collins of Magnolia Place Mobile Home Park, 4317 Magnolia Oaks, stated that he is concerned about Veterans Road being destroyed by the heavy truck traffic, He also stated that the school bus picks up and drops off children in front of their park four times a day. He is concerned for the children's safety, Mr, Collins also expressed concern for the noise and dust from this type of business. He explained that a large number of their residents are elderly. He stated that when the area was originally developed, the mobile home park was to serve as a buffer between residential and light industrial. He added that they would have never developed the mobile home park next to a heavy industrial site, He asked that if this zoning is approved that a large sound wall be required to barricade the surrounding development. Dwain Evans, 6110 Piping Rock, Houston, explained that he currently has proposal before Council to change zoning on the property at the corner of Veterans and Magnolia to residential. He stated that they have another property located across from a concrete batch plant and they have many problems with residue and dust. Cynthia Smith, 4506 Cornerstone, explained that out of the immediate five tracks of land, only one is zoned M-2. She stated that the concrete facility on that property was there long before they built their homes. She expressed concern for children in the area traveling to and from the Exxon station. She also stated that the roads are too narrow for heavy truck traffic. Paul McCann, 4521 Fox Run, stated that the roads are already very damaged with normal traffic. He explained that the dust is already bad from the existing concrete plant. 235 Lynn Dixon, Magnolia Place Mobile Home Park, explained that her trailer backs up to Magnolia. She expressed concern that the heavy trucks would damage the streets more then they already are, She also added that she does not want her babies breathing the dust from this type of business. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Planning and ZOning Commissioner Charles Viktorin aSked how many people the company will employ. Mr. Woochie stated that in the next four years, they will employ approximately forty people. VI. ADJOURNMENT The Joint Public Hearing to consider Zone Change Application No. 824 adjourned at 7:00 PM. Application No. 834 I. CALL TO ORDER The meeting was called to order at 7:01 PM. I1. PURPOSE OF HEARING IlL Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C) on the following described property, to wit: Legal Description:Lot A, Block 1, Garden Acres, Section 2, Brazoria Co., TX (Broadway Street between Lazy Bend & Garden Road) Owners: Blumenthal Investments Partners P.O. Box 1196 Edwards, CO 81632 Agent: David S. Miller Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location map. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST David S. Miller, 3007 E. Broadway, stated that he is representing Dr. Jack Blumenthal who lives in California. He explained that this is approximately 4.3 acres of land with 750' of frontage and approximately 250' deep. He also stated that most of the property -3- across from and East of the property is zoned Commercial. He stated that approximately two acres located at Lazybend and Broadway is for a proposed restaurant with an outside barbeque grill and eating, The middle piece of land is proposed for some type of automobile related business, And, the remaining one acre is a proposed retail store. He explained that they are asking for Commercial because the retail store will have some outside display during the day. Orlen O'Day,. 14405 O'Day Road, explained that he owns interest on three different corners of property adjoining this. He spoke in support of the zone change. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Michael Pattert, 2541 Lazybend, asked that if this property is rezoned for General Business or Commercial that the City prevent them from having a driveway on Lazybend. He also asked that they be required to install a privacy fence between them and the residential area. He explained that they already have UPS trucks making daily deliveries and heavy trucks making material deliveries to Lescon and Leslie Plumbing. V. He stated that this area is the storage facility, detention pond and support utilities for the R.V. park. Fred Duncan, 2409 Baycrest, Nassau Bay, stated that he is part Owner in the Proposed R.V. Park. He spoke in support of the zone change. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Ed Weatherall, 710 Greenbriar, Friendswood, stated that they are proposing to master plan this property with a full service convenience store and co-tenant food establishment and a Recreational Vehicle park. He presented the master plan drawing of the proposed development. He stated that the R.V. parking is approximately two hundred fifty to three hundred feet off of the road with the Commercial facilities in front of it. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Tom Alexander, 3208 Nottingham, stated that he represents Frank Barringer and Tom Alexander, Jr. He explained that they want to match the existing zoning in the area. He stated that General Business zoning would make the property much easier to sell because of a wider range of uses. David Miller, 3007 E. Broadway, spoke in support of the zone change. He stated that this zone.change would comply with the surrounding property. He explained that NS fits tightly into subdivision areas, however, this is away from the subdivision. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Daniel Hall, 2701 Livingston, explained that he lives on one of the four lots that back up to this property. He expressed concern about the safety of the children in the area and for the value of his property. He also expressed concern about any type of business causing a stench and noise. He asked that the City require proper drainage, proper separation and a noise barrier. Jim Bergstrom, 6503 Carmona Lane, expressed concern with what type of business might be built on the property. He reiterated the need for a wall to separate the business from the residential area.
