PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance ofsaid City from classification Suburban Development District (SD) to Heavy Industrial (M- 2) on the following described property to wit: Legal Description: Being 2.50 acres out of the E %2 of Lot 44, Allison Richey Gulf Coast Home Co. subdivision, H.T.& B. R.R. Co. survey A-292, sect. 29, recorded in Vol. 2, pg. 101, plat records of Brazoria Co., TX (CR 128) Owners: Steven E. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Mayor Pro -Tem William Berger read a letter from Steven Estep, owner, who had to be out of town. The letter stated that the property has been used for industrial use for years. It also explained that the property is surrounded by industrial type businesses. Also, in the letter Mr. Estep stated that he will comply with all Environmental Protection Agency codes and will improve the property once it is rezoned. IV PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Jim Benton, 8575 CR 128, explained that his property is adjacent to this. He stated that he has attempted to contact Mr. Estep on several occassions to see what he intends to do with the property. He added that the property is in very bad shape. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mayor Pro -Tem William Berger stated that Mr. Benton would have several weeks to meet with Mr. Estep before this request is considered by Council. VI. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Light Industrial (M- 1) on the following described property to wit: Legal Description: Being 1.1671 acre tract out of Lot 3, Allison Richey Gulf Home Co. subdivision, Section 85, H.T. & B.R.R. Co. survey, A-304, recorded in Vol. 2, pg 107,plat records ofBrazoria Co., TX (2401 Smith Ranch Road) Owner: John H. Director of Community Development and Services Gene Tumlinson showed the location map. He stated that this is presently Diamond Ice Packaging Company. He explained that the owner had originally applied for M-1, however, this business would be allowed in General Business. Therefore, the owner has agreed to change his request to General Business. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST John Gehring, 12601 Stone Road, explained that his company distributes ice to convenience stores. He added that he did not realize originally that this would be allowed in a General Business zone. Richard Atchison, 15022 Hughes Ranch Road, stated that he is Mr. Gehring's neighbor on the North side. He added that Mr. Gehring takes very good care of the property. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification General Business (GB) to Commercial District (C) on the following described property to wit: -3- 15n Legal Description: Being approximately 8.23 acres out of an 11.74 acre tract, part of Lots 49 & 50, Allison Richey Gulf Coast Home Co. subdivision, Section 85, H.T.&B. Director of Community Development and Services Gene Tumlinson showed the location map. He explained that they are proposing a climate controlled storage units and outdoor R.V. and boat storage. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Dan Cheek of W.C. Properties, stated that they are proposing a first class shopping center on the front of the property with a storage complex in back. He added that the warehouses will be completely shielded from view from FM 518. Bobby Stevener, 1905 Sleepy Hollow, explained that he originally spoke against the request for this property to be zone Commercial, however, now he knows their plans. He added that he has no opposition to this property being zoned Commercial. He stated that his property borders this property to the East. IV. Hall survey, A-70, Brazoria Co., TX (1920 E. Broadway) Owner: Beverly Brown 2640 E. Broadway #112 Pearland, TX 77581 Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location map. He explained that he had incorrectly told Ms. Brown that this property was zoned Neighborhood Services. However, it was discovered in a development meeting after she purchased the property that it was zoned R-1. He stated that Office Professional will make a nice transition between surrounding R-1 and Neighborhood Services zoned. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Beverly Brown, 1920 Broadway, stated that her business, Hired Hands, has been in business for three years. She explained that she now employs ten people. She stated that she would like to expand to a day spa. Jack McGuff of McGuff & Associates Architects, explained that they have drawn very nice plans for this new facility. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none V. Amy, Deerpark, explained that this is another section of Sunrise Lake subdivision. He stated that the property is bordered by an apartment complex on the Southwest side, the cemetery to the East, Hickory Slough to the North, the cemetery to the East and Commercial zoned property fronting FM 518. He added that Pulte Homes will be the main builder for this development. A IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember Klaus Seeger stated that this is a large block of homes. He added that he would like to see how the traffic will be routed. -6- 153 Ken Caffey explained that the main entrance, Sunrise Boulevard, accesses FM 518 and there will be a second entrance off of CR 93. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Commercial District (C) to Single Family Dwelling District (R-2) on the following described property to wit: Legal Description: Being approximately 60 acres out of Section 12, H.T.& B. R.R. Co. survey, A-508, according to the plat records of Brazoria Co., TX (S.E. Corner of Magnolia and Veterans) Owner: Flyma Thompson, Elliott Cage, & Catherine Cage Burns 2121 Sage Rd, Suite 300 Houston, TX 77056 Agent: Dwain Evans 4615 Southwest Freeway, #1025 Houston, TX 77027 Chairperson Mary Starr read the purpose of the hearing into the record. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Dwain Evans, 6110 Piping Rock, Houston, explained that they have requested a zone change on this property twice before. He stated that they had previously requested an R-3; however, they are now requesting an R-2. He showed a layout of the proposed development. He explained that they provided a Commercial buffer fronting Magnolia. -7- 154 Shelly Kelly of Caldwell Bankers, stated that she represents the owners of the property. She stated that she continually recieves inquiries for a residential development on this property. Gary Snowder, 4503 Stonebridge, explained that he would like to continue residential growth in the area. He stated that they had recieved almost one hundred signatures from their neighborhood in support of this request.. Barbara Heathrobe, 3501 Whitestone, stated that she would rather see residential development than Commercial. She explained that she feels that this will enhance the area and keep the property values high. Mark Norman, 3502 Whitestone, spoke in support of the request. Cynthia Smith, 4506 Cornerstone, stated that she would be concerned about the safety of the children in the area if this property were to be developed as Commercial. Paula McKay, 4521 Fox Run, spoke in support of this proposed zone change. Frank Tropea, 4524 Teal Glen, stated that he would much rather have a new subdivision than a Commercial development on this property. Larry Sutton, 4528 Teal Glen, expressed his support for this request. Curtis Holden, 4518 Cornerstone, spoke in support of the request, however, he did express some concern over the traffic with the new development. Leanne Carol, 3506 Whitestone, stated that she is in favor of the zone change. Tanja Harris, 3504 Stonegate Circle, expressed her support. Leon Young, 4505 Teal Glen, spoke in support of the request. Rudolph Williams, 3502 Stonegate Circle, stated that he is in support of more residential development in the area. He expressed several concerns with a Commercial development if this property is not rezoned for residential. Nona Charvarea, 4527 Fox Run, spoke in support of the zone change. Carmen Young, 4505 Teal Glen, expressed her support. Sandra Christopher, 4508 Cornerstone, stated that she is in favor of more residential development because of the kids in the area. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember Beckman stated that she sympathizes with the residents of Cobblestone, however, she fears that the M-2 zoning between this property and the railroad tracks would create a problem for future residents. Mayor Tom Reid stated that there needs to be some sort of buffer zone between the two zones. VI. ADJOURNMENT The Joint Public Hearing to consider Zone Change Application No. 820 adjourned at 7:30 PM.
