1999-09-07 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES063 MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD SEPTEMBER 7, 1999, AT 7:00 PM, IN THE COUNCIL CHAMBERS OF CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R-1) on the following described properties, to -wit: Legal Description: Lot 13, Section 2, Bethel Estates subdivision, Section 2, out of a 25.9538 acre unrecorded subdivision, Allison Richey Gulf Coast Home Co. Subdivision, Section 19, H.T. & B. R.R. Co. Survey, A-234, Brazoria Co. map records (13860 Stone Road) Owner: Albert & Gloria Melgoza 1126 Woodbridge Avenue Pearland, Texas 77584 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into record. Chief Building Official Gene Tumlinson showed the location map. -1- 064 Ill. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Gloria Melgoza, 1126 Woodbridge Avenue, explained that they are building a new home on the property. IV. CALL TO ORDER The Joint Public Hearing to consider Zone Change Application No. 806 was called to order at 7:12 PM. 11. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-1) to Single Family Dwelling District -Planned Unit Development (R-2 PUD) on the following described properties, to -wit: Legal Description: Being a 120.417 acre tract in the W.D.C. Hall League, A-70 and part of Lots 13-24, S.W. Narregang subdivision, Vol. 1, pg 92 and also Lots 1 & 2, George W. Jenkins Subdivision, Vol. 79, pg 616, Brazoria Co. Map records Owner: Amvest Properties 7676 Woodway, Suite 238 Houston, Texas 77063 Agent: Ken Caffey Chairperson Mary Starr read the purpose of the hearing into the record. Chief -2- 065 Building Official Gene Tumlinson showed the location map and gave a brief description of each section of the Planned Unit Develoment documents. He stated that staff has reviewed the documents and everything seems to be included. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Clinton Wong, 7676 Woodway, Houston, gave a brief explanation of the proposed request. He stated that they had previously requested R-3 zoning, however, they amended that request to an R-2 PUD because of the large number of people who spoke against the R-3 zoning. He explained that he has addressed the concerns of those people who spoke. He stated that they have made a special request to not tie in to Shadycrest streets. They will add another entrance on Dixie Farm Road. He also added that he has placed larger lots along the fence of Shadycrest Subdivision. In addition, he stated that he will place a T wood fence between the two subdivision. Mr. Wong showed a map showed a map with the traffic flow including an additional entrance off of Dixie Farm Road. Ken Caffey, 1013 N. Amy, Deer Park, expressed his support for this zone change. Renee West, 2401 Country Club Drive, stated that the price of the homes in this proposed section will exceed the price of other homes being built by 80%. She also explained that the townhomes in Green Tee have not depreciated the value of surrounding homes. IV. PERSONS WISHING TO SPEAK AGAINST PROPOSED REQUEST Paul Shaklovitz, 4009 Longherridge, submitted a letter in opposition to the proposed request. He expressed concerns with the additional traffic created by a more densely populated subdivision, the low number of remaining properties zoned R-1, school overcrowding and drainage. Patty Wells, 4016 Shadycrest, stated that she appreciates Mr. Wong addressing the traffic issues, however, her main concern is drainage. Adolf Hruzek, 3905 Longherridge, explained that this proposed zone change backs up to his residence. He expressed concern with the new development flooding his property. All Raska, 2107 Sprite Lane, stated that everything around Shadycrest is zoned R- 1. He explained that if this zone change is approved, others will follow. He also stated that he is concerned with everything that has already been said. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION '^ Mayor Pro -Tem William Berger asked who will oversee the project to be sure it is -3- built to the PUD plan and who will enforce it. Chief Building Official Gene Tumlinson stated that the Engineering Department will enforce the drainage and streets during the platting process and inspect the construction of the subdivision. He added that the Building Department will be responsible for building inspections and Code Enforcement. Mayor Pro -Tem William Berger reitterated the concern with the property being built up. Mayor Tom Reid stated that City Engineer John Hargrove is also a Flood Plain Administrator, therefore he will make sure that all FEMA requirements as well as City ordinances will be adhered to. A discussion ensued regarding the PUD documents and the requirements for different zones. VI. ADJOURNMENT The Joint Public Hearing to consider Zone Change Application No. 806 adjourned at 7:43 PM.
