R99-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR His DESIGNEE TO ENTER INTO AN INTERLOCAL AGREEMENT WITH THE CITY OF TEXAS CITY ALLOWING TEXAS CITY TO ENGAGE THE SERVICES OF ALLSTAR, INC. IN A SIMILAR MANNER AS PROVIDED TO THE CITY OF PEARLAND. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain interlocal agreement by and between the City of Pearland and the City of Texas City, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest the original of the attached agreement for and on behalf of the City of Pearland, to cooperate with Texas City in acquiring the services of AIIstar, Inc. in a similar manner as provided to the City of Pearland. COKER CITY ATTORNEY INTERLOCAL AGREEMENT BETWEEN THE CITY OF PEARLAND AND THE CITY OF TEXAS CITY This Agreement is dated as of the I'~'~ day of 12, ~ r ', i ,1999, by and between the City of Pearland, Texas, acting through its City Manager ("Pearland"), and the City of Texas City, Texas, acting by and through its Mayor ("Texas City"). Pearland and Texas City, for the mutual consideration and covenants hereinafter set forth, agree as follows: 1. Pearland, having engaged the services of Allstar, Inc. ("AIIstar"), for the purpose of providing laptop computers for the Pearland Police Department, has requested that AIIstar extend similar service to Texas City. 2. Pearland agrees that all expenses incurred by the City of Pearland shall be paid by Pearland. 3. Texas City agrees that all expenses incurred by the City of Texas City shall be paid by Texas City. 4. Pearland and Texas City agree that neither party shall be responsible for any expenses incurred by the other in the purchase of laptop computers. 5. Either party may terminate their agreement with Allstar upon compliance with the provisions of the agreement with AIIstar. 6. Nothing herein shall be construed to create any rights of third parties. 7. This Agreement shall be construed and enforced in accordance with and governed by the laws of the State of Texas. 8.
