CALL TO ORDER The Joint Public Hearing was called to order at 6:37 PM. if. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Commercial District (C) on the following described properties, to -wit: 1. Zoning Application No. 788 Legal Description: Being a 4.9794 acre tract out of Lots 76 & 77, Figland Orchard subdivision No. 1, Section 13, H. T. & B. R.R. Co. Survey, A-240, recorded in Vol. 3, pg 77, plat records of Brazoria Co., TX Owner: Clyde Williams/Brian Williams P.O. Box 1519 Pearland, TX 77588 1 a2S 2. Box 1519 Pearland, Texas 77588 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Planning and Community Development Dennis Smith showed the location maps. He explained that he had spoken to Mrs. Williams regarding Application No. 788. She informed him that they have an existing state permit for a wrecker service. She also advised Mr. Smith that even though the application states salvage yard, it is a wrecker service only. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS none IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS Don Ellis, 3306 Windsor, spoke in opposition to Zone Change Application No. 788. He stated that the property just next to this proposed zone change was his parents homesite. He stated that it has now been passed down to the sons and they are trying to sell it, however, the proposed buyer has backed out. Aubry Ellis spoke against both requests. He stated that his family owns land that he feels this zone change would devalue. Mrs. Fred Ellis, 5902 Fite Road, stated that she agrees with both of her brothers-in- law that the property should not be zoned Commercial. Mayor Pro -Tem William Berger read a letter submitted by Pamela Anselmo, 5833 Fite, opposing the zone change requests. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION none VI. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification General Business District (GB) to Commercial District (C) on the following described properties, to -wit: Legal Description: Lot A, Section 3, Garden Acres subdivision, as recorded in the plat records of Brazoria Co., TX (6117 Broadway) Owner: R. West Development 6302 Broadway Pearland, Texas 77584 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Renee West, 2401 Country Club Drive, explained that they originally built and zoned for Southwest Fertilizer. She added that the tenant began getting citations after when they started storing items outside of the building. She stated that the City was aware of what type of business was being built, however, it was still zoned General Business. Ms. West added that the property is fenced and is very well maintained. Mike James, owner of Southwest Fertilizer, explained that he only intends to store things outside during business hours. He stated that everything would be moved inside the building at night. He also added that they have a large warehouse in Bellaire, therefore, they would not be storing a large amount of items at this store. Nita Christian of West Development stated that Southwest Fertilizer has shown that they want to beautify the City. She added that they would never do anything ^. negative. 3 0 �V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember Richard Tetens stated that the zoning classifications really need to be changed. Mayor Tom Reid stated that Southwest Fertilizer definitely earned the beautification award. VI. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Charlie Watson, 2412 Sheila, stated that they are trying to relocate a barber shop 5 x 030 to this property. He explained that they have done extensive remodeling and plan to do more if the zone change is approved. Theresa Watson, 2412 Sheila, explained that the barber shop is currently located I at the corner of Walnut and McLean. She added that this location has become a safety hazard for her customers. Sherry Hoffman, 6138 Bryan, spoke in support of the zone change request. Clayton Young, 4801 Silsbee stated that he lives behind this property. He explained that it was previously an eyesore. He added that he supports the zone change if they will continue to maintain the property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none V. Director of Planning and Community Development Dennis Smith showed the location map. He explained that the duplex with a garage apartment requires Multi -Family zoning. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST none IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Cindy Evans, 2202 N. Grand, stated that her garage is located on the Plum Street side. She expressed concern that when the alleyway floods, the proposed tenants would park their vehicles on her property. She also stated that she thought the property was too small for three families. She expressed concern with the extra traffic three dwellings would create. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mayor Pro -Tem William Berger questioned whether she could prevent people from parking on her property. Director of Planning and Community Development Dennis Smith explained that she would need to contact the police department to have the vehicles removed if this occurred. Mr. Smith added that Mrs. Burkett has not attended a development meeting, however, if and when they do, drainage and off-street parking would be addressed. VI. ZONE CHANGE APPLICATION NO. 804 CALL TO ORDER The Joint Public Hearing was called to order at 7:16 PM. II. PURPOSE OF HEARING 7 032 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-2) to Mobile Home District (MH) on the following described properties, to -wit: Legal Description: Being Lots 36 & 36A out of Section 6, H. T. & B. R.R. Co. Survey, A-544, recorded in Vol. 136, pg 501, deed records of Brazoria Co., TX Owner: John David Hammond 5214 Braesvalley Drive Houston, Texas 77096 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Planning and Community Development Dennis Smith showed the location map. He explained that this is the existing Brazoria Place Mobile Home Park, located just North of the Country Meadows Mobile Home Park. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST John Hammond, 5214 Braesvalley, Houston, explained that he has put a lot of money into the park since he purchased it. He stated that he has put in new asphalt roads, new culverts, new driveways and drainage. He added that he has also evicted those tenants who have caused problems with the police. He also reitterated the fact that this is an existing mobile home park that he wants to continue to improve if he gets the zoning. Howard Rathbun of Country Meadows Mobile Home Park, 2241 O'Day Road, stated that he supports this zone change request. He added that is should have been zoned MH when it was annexed. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST F.L. Henney, 2208 Kelly Drive, explained that the trailer parks are an eyesore. He expressed concern with tenants that use drugs. Steve Harvey, 2229 Melanie, expressed concern that this park will eventually be like Country Meadows Mobile Home Park. He stated that the police and EMS are at the park too frequently. Tim Hayden, 6322 Kelly Drive, stated that the homes in Hickory Hollow subdivision are up to two hundred thousand dollar homes. He also stated that he does not see the improvements that Mr. Hammonds referred to. R Paula Pain, 2137 Melanie, explained that she can see this mobile home park from Q �� her back yard. She stated that this evening the police and EMS were there. Carl Eastburn, 6306 Marsha Lane, spoke in opposition to the request. Ralph Regal, 6405 Kelly Drive, stated that the population in the mobile home park is too dense for such a small area. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION none VI.
