A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, CONFIRMING AND READOPTING ITS CONSENT TO THE
CREATION OF MUNICIPAL UTILITY DISTRICT NOS. 2 AND 3.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That Resolution No. 80-5, adopted on January 28, 1980, granted
consent to the creation of Brazoria County Municipal Utility District Nos. 2 and 3
(the "Districts) to be located within the extraterritorial jurisdiction of the City.
Section 2. It has now been determined that the District is in fact partly located
within the 100 foot strip annexed by virtue of City of Pearland Ordinance No. 31 on
June 30, 1960.
Section 3. That the City Council hereby confirms and readopts its consent to
the creation of Municipal Utility District Nos. 2 and 3, pursuant to the District's petition
(attached as Exhibit "A").

TO THE HONORABLE MAYOR AND CITY COUNCIL
OF THE CITY OF PEARLAND:
WHEREAS, the City CounciZ of the City of Pearland,
Texas (the "City"), adopted ResoZution No. R-80-5 on January
28, 1980, pursuant to which the City of Pearland granted its
consent to the creation of Brazoria County Municipal Utility
District No. 2 and Brazoria County Municipal Utility District
No. 3 (.MUD Nos. 2 and 3") relative to 449.8473 acres of land
and 51S.0633 acres of land~ respectively; and
WHEREAS, at the time Resolution No. R-80-5 was
adopted and a Petition the=efor was submitted to the City, it
was believed by =he petitioners for the oreatLon of MUD Nos.
2 and 3 and the City that a~l the land to be included within
the Districts was within =he extraterritorial jurisdiotion of
the City of Pearland and none of the land was within the
corporate llmits of the City of Pearland; and
and the City that by vLrtue of City of Pearland Ordinance No.
31 adopted on June 30, 1960, the City of Pearland annexed a
lO0-foo= wide strip of land, said land being more paz~io~larly
described therein and that a 6.4060 acre potion of the land

originally included within MUD No. 2 and a 16.0102 acre
portion of the land originally included in MUD No. 3 are in
fact within said 100-foot strip and therefore within the
corporate limits of the City of Pearland, Texas; and
NOW, THEREFORE, Petitioners respectfully pray that
'this Petition be granted in all respects and that,
notwithstan4ing the fact that a portian of each cf the
Districts was, and remains, in the corporate city limits of
the City of Pearland, Texas, the City of Pearland ratify,
confirm, and readopt its consent to creation of MUD No~. 2 and
3.
