R99-095 11-08-99RESOLUTION NO. R99-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CONFIRMING AND READOPTING ITS CONSENT TO THE CREATION OF MUNICIPAL UTILITY DISTRICT NO. 6. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Resolution No. R86-7, adopted on February 10, 1986, granted consent to the creation of Brazoria County Municipal Utility District No. 6 (the "District") to be located within the extraterritorial jurisdiction of the City. Section 2. It has now been determined that the District is in fact partly located within the 100 foot strip annexed by virtue of City of Pearland Ordinance No. 31 on June 30, 1960. Section 3. That the City Council hereby confirms and readopts its consent to the creation of Municipal Utility District No. 6, pursuant to the District's petition (attached as Exhibit "A"). COKER CITY ATTORNEY TOM REID MAYOR PETITION FOR RATIFICATION AND CONFIRMATION OF CONSENT TO INCLUDE LAND WITHIN A MUNICIPAL UTILITY DISTRICT TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF PEARLAND: WHEREAS, the City Council of the City of Pearland, Texas (the "City"), adopted Resolution No. R86-7 on February 10, 1986, pursuant to which the City of Pearland granted its consent to the creation of Brazoria County Municipal Utility District No. 6 (the "District") relative to 528.322 acres of land; and WHEREAS, at the time Resolution No. R86-7 was adopted and a Petition therefor was submitted to the City, it was believed by the petitioners for the creation of the District and the City that all the land to be included within the District was within the extraterritorial jurisdiction of the City of Pearland and none of the land was within the corporate limits of the City of Pearland; and WHEREAS, it has now been determined by the District and the City that by virtue of City of Pearland Ordinance No. 31 adopted on June 30, 1960, the City of Pearland annexed a 100-foot wide strip of land, said land being more particularly described therein, and that a 12.4 acre portion of the 528.322 acres of land originally included within the District, which 12.4 acres are located adjacent to the District's southern boundary, is in fact within said 100-foot strip and therefore within the corporate limits of the City of Pearland, Texas; and NOW THEREFORE, Petitioner respectfully prays that this Petition be granted in all respects and that, notwithstanding the fact that a portion of the District was, and remains, in the corporate city limits of the City of Pearland, Texas, the City of Pearland ratify, confirm and readopt its consent to creation of the District.
