Ord. 0110H 1999-07-26ORDINANCE NO. 110-H AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING CHAPTER 9, ELECTRICITY, OF THE CITY OF PEARLAND CODE OF ORDINANCES, AS IT MAY HAVE BEEN FROM TIME TO TIME AMENDED, FOR THE PURPOSES OF UPDATING CODE REFERENCES, INCREASING REQUIRED INSURANCE COVERAGE, CREATING A REINSPECTION FEE, AND ALLOWING THE LIMITED USE OF METAL -CLAD CABLE; PROVIDING A PENALTY FOR VIOLATION; CONTAIN- ING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AND A REPEALER CLAUSE; PROVIDING FOR PUBLICATION, CODIFICATION, AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Section 9-35 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, shall be amended to read as follows: "Section 9-35. Appointment. The board of electricians shall be appointed by the City Council." Section 2. That Section 9-69 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, shall be amended to read as follows: "Section 9-69. Bond and insurance. ...(c) Minimum insurance requirements. (1) Workers' Compensation Insurance in accordance with Texas state law. (2) Comprehensive general liability insurance coverage with limits of not less than seven hundred fifty thousand dollars ($750,000.00) per occurrence for bodily injury and two hundred fifty thousand dollars ($250,000.00) per occurrence for property damage with coverages extended as follows: a. Operations -premises liability; b. Independent contractor's liability -Broad form; c. Contractual liability -Broad form; d. Completed operations and products liability...." 1 ORDINANCE NO. 110-H Section 3. That Section 9-70 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, shall be amended to read as follows: "Section 9-70. Identification. Each holder of an electrical contractor's license shall display his company name or identification along with his Pearland Master Electrical License number (P.M.E.L. no.) on each vehicle used in conjunction with performing electrical work under this chapter. This identification shall be of a permanent type with letters of a minimum height of three (3) inches. No magnetic name plate signs are to be used on the vehicle." Section 4. That Section 9-82 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, shall be amended to read as follows: "Section 9-82. Duties generally. A master electrician shall supervise, direct and control all electrical work for whomever he works. He must physically inspect each job for which he has a valid permit to ensure that all work complies with the National Electrical Code and ordinances of the city. He must furnish a semiannual report to the city electrical inspection department including the names of all electricians who worked for him or his employer. The master electrician is held responsible for obtaining licenses for his employees. He must make sure that not more than two (2) apprentices for each journeyman are working on residential jobs and not more than one (1) apprentice for each journeyman is working on commercial jobs. An apprentice may not work without the presence of a journeyman. The master electrician must also be available to meet with the electrical inspector during the electrical inspector's regular work hours." Section 5. That Section 9-91 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, shall be amended to read as follows: "Section 9-91. Identification. Each holder of an electrical sign contractor's license shall display his company name or identification along with his Pearland Master Electrical License number (P.M.E.L. no.) on each vehicle used in conjunction with 2 ORDINANCE NO. 110-H performing electrical work under this chapter. The identification shall be of a permanent type with a minimum height of three-inch letters." Section 6. That Section 9-137 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, is hereby amended to read as follows: "Section 9-137. Reinspections. If, after the first visit to a job on written notice to inspect the same, it is necessary for the electrical inspector to reinspect the same, or it is necessary to reinspect any work whether from a defect or the work not being ready, the inspector will return only upon receipt of a written request for reinspection. Said reinspection shall take place as soon as the inspector's schedule permits, but shall not be given preference over inspections already scheduled. The inspector shall charge a reinspection fee of Thirty-five Dollars ($35.00) for each reinspection." Section 7. That Section 9-153 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, is hereby amended to read as follows: "Section 9-153. Adopted. (a) All electrical construction and all materials and appliances used in connection with the installation, maintenance and operation of electrical wiring, apparatus or equipment for utilization of the service for the supply company in providing electrical energy for Tight, heat or power, inside or attached to buildings or property within the jurisdiction of the city shall conform to such special rules and regulations as may be embodied in this or other ordinances of the city and to the 1996 Edition of the rules and regulations of the National Fire Protection Association (National Electrical Code) for the installation of wiring and apparatus for electrical purposes, as they are now established; and such rules and regulations are hereby adopted and approved as part of this chapter. (b) The 1996 Edition of the National Electrical Code is amended as follows: Delete (a) 230-70, Location." Section 8. That Section 9-157 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, is hereby amended to read as follows: 3 ORDINANCE NO. 110-H "Section 9-157. Wiring generally. (a) Approved rigid metal conduit or electrical metallic tubing or under -floor cast -in -place raceways, shall be required for all wires used to conduct current for light, heat or power, in the wiring of all new buildings and in all old buildings or additions thereof within the fire limits of the city, as they are now or may hereafter be established, and in churches, schools, hotels, theaters and commercial buildings within the jurisdiction of the city. (b) Gasoline filling stations will be wired according to the latest rules and regulations of the National Board of Fire Protection Association. (c) The use of metal -clad cable (MC cable), limited to eight -foot lengths, shall be allowed only where conduit or metal raceway is impracticable. ..." Section 9. That Section 9-159 of Chapter 9, Electricity, of the City of Pearland Code of Ordinances, is hereby amended to read as follows: "Section 9-159. Installation of service conduit, wires, etc. ...(h) Aluminum U.S.E. conductors are permitted for use only on underground residential service and shall be installed in conduit. The aluminum wire shall be allowed to extend only as far as the line side of the meter can. ..." Section 10. Repealer. All ordinances and parts of ordinances in conflict herewith are hereby repealed but only to the extent of such conflict. Section 11. Penalty. Any person who shall violate the provisions of this section shall be deemed guilty of a misdemeanor and shall, upon conviction by a court of competent jurisdiction, be punished by a fine in any sum not exceeding Two Hundred Dollars ($200.00). 4 ORDINANCE NO. 110-H Section 12. Savings. All rights and remedies which have accrued in favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. Section 13. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 14. Codification. It is the intent of the City Council of the City of Pearland, Texas, that the provisions of this Ordinance shall be codified in the City's official Code of Ordinances as provided hereinabove. Section 15. Publication and Effective Date. The City Secretary shall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City of Pearland, upon passage of such Ordinance. The Ordinance shall then become effective ten (10) days from and after its publication, or the publication of its caption and penalty, in the official City newspaper.
