AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING CHAPTER 17 OF THE CITY OF PEARLAND CODE
OF ORDINANCES, (ORDINANCE NO. 179), AS IT MAY HAVE BEEN,
FROM TIME TO TIME, AMENDED, BY ADDING A NEW SECTION 17.3,
TEMPORARY MOBILE HOMES, IN ORDER TO REGULATE THE
PLACEMENT OF MOBILE HOMES IN THE CITY; PROVIDING A PENALTY
FOR VIOLATION; HAVING A SAVINGS CLAUSE AND A SEVERABILITY
CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION AND AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That Chapter 17 of the City of Pearland Code of Ordinances, is
hereby amended to ADD a new Section 17.3, to read as follows:
"Section 17.3. Temporary Mobile Homes.
(a) A mobile home may be placed on property located within the City
provided the City Council has previously consented to the creation of a
proposed municipal utility district within said property. Any mobile home
placed on property in accordance with this section may remain on a
temporary basis until the proposed municipal utility district conducts a
confirmation election, or for a period not to exceed one year, whichever
occurs first. The number of mobile homes permitted within a proposed
municipal utility district shall not exceed three mobile homes at any given
time.
(b) Prior to placement of a mobile home in a proposed municipal utility
district, a temporary mobile home placement permit must be obtained
through the City's Permits Department. Any applicant for a mobile home
placement permit is subject to and must conform with all applicable City
ordinances regulating land use and mobile homes, including but not
limited to, all fees and permits required for such use, but shall be exempt
from the platting requirements set forth in the City's Subdivision
Ordinance.
(c) Subject to the approval of the City Building Official, a mobile home
placed on property in accordance with this ordinance shall be properly
skirted in conformance with applicable City ordinances."

Section 2. Penalty. Any person who shall violate the provisions of this
section shall be deemed guilty of a misdemeanor and shall, upon conviction by a court
of competent jurisdiction, be punished by a fine in any sum not exceeding
Five Hundred Dollars ($500.00).
Section 3. Savings. All rights and remedies which have accrued in favor of
the City under this Ordinance and amendments thereto shall be and are preserved for
the benefit of the City.
Section 4. Severability. If any section, subsection, sentence, clause, phrase
or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise
unenforceable by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining portions thereof.
Section 5. Codification. It is the intent of the City Council of the City of
Pearland, Texas, that the provisions of this Ordinance shall be codified in the City's
official Code of Ordinances as provided hereinabove.
Section 6. Publication and Effective Date. The City Secretary shall cause this
Ordinance, or its caption and penalty, to be published in the official newspaper of the
City of Pearland, upon passage of such Ordinance. The Ordinance shall then become
effective thirty (30) days from and after its publication, or the publication of its caption
and penalty, in the official City newspaper.
