A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS
DESIGNEE TO EXECUTE A CONTRACT WITH BROOKS & SPARKS,
INC. FOR THE PURPOSE OF PREPARING PLANS, SPECIFICATIONS,
AND COST ESTIMATES FOR THE PEARLAND CITY SERVICES
COMPLEX.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and
Brooks & Sparks, Inc., a copy of which is attached hereto as Exhibit "A" and made a part
hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest the original of the attached contract with Brooks & Sparks,
Inc. for the purpose of preparing plans, specifications, and cost estimates for the
Pearland City Services Complex.

Dear Allen:
Brooks & Sparks, Inc. is pleased to submit this proposal for providing engineering services for the
development of the Pearland City Services Complex. Based on our meetings to date, the purpose
of this assignment is to participate with the City and the architect in a preliminary phase to analyze
and configure the site, a design phaie consisting of the preparation of plans, specifications and cost
estimate. We will assist the City in bidding the project and provide construction services as
requested. The specific scope of services to be provided will include the following items of work:
Preliminary Phase
Acquire all pertinent plans, utility data and drainage data from the City of Pearland
required for the completion of the project. Coordinate with surveyor and acquire
topographic survey of the area requiring improvements.

Assist with coordinating geotechnical investigation once the location and details for
the utilities are determined. Geotechnical Services are not included in the lump sum
fee.

Contact utility and pipeline companies to determine the locations of all utilities
within the project area and the constraints to construction which those utilities
present.
Determine volume of storm water detention required and provide data to TEAM, Inc
engineers for incorporation into their design.
Assist Architect and City of Pearland with the preparation of the preliminary layout,
utility requirements and cost estimate.

Design Phase
Bid Phase
1.
Assist in the preparation of formal Contract Documents.
Prepare plans for sanitary sewer and water utilities for the project on CADD
background sheets provided by architect.
Prepare plans for onsite paving, grading and drainage improvements on CADD
background sheets provided by architect.
Prepare necessary details for the onsite drainage facilities, water and sanitary sewer.
Prepare plans for off site utilities consisting of approximately 1,300 1.f. of water line
for the project. It is anticipated that this construction will not be bid separately.
Prepare aft I~PDES Storm Water Pollution Prevention Plan for inclusion in the
Contract Documents.
Prepare necessary Traffic Control Plans for inclusion in the Contract Documents.
Prepare final cost estimate for construction.
Provide services and drawings to secure approvals from TxDOT and Brazoria County
Drainage District No. 4.
Assist the City of Pearland in the advertisement of the Project for bid. City of
Pearland will secure and pay for the Bid Advertisement.
Attend the Prebid Conference and issue addenda to the Bid Documents if necessary.
3. Review bids and recommend award of the contract.
Construction Phase
1. Attend the preconstruction conference.
Make periodic visits to the site (as distinguished from the continuous services of a
resident Project Representative) to observe the progress and quality of the executed
work and to determine in general if the work is proceeding in accordance with the
Contract Documents. In performing these services, Brooks & Sparks, Inc. cannot
guarantee the performance of the contractor, nor be responsible for the actual

supervision of construction operations or for the safety measures that the contractor
takes or should take.
Review change order requests, periodic payment applications, samples, catalog data,
schedules, shop drawings, laboratory, shop and mill tests of material and equipment
and other data which the contractor submits. (This task includes submitting plans for
review to utility companies).
Conduct, in company with City representatives, a final inspection of the Project for
compliance with the Contract Documents, review final payment request and submit
recommendations concerning project status, as it may affect final payment to the
contractors.
Additional Services
,
Platti~g:-ROW and Easement Acquisitions - It is anticipated that Platting will be
provided directly by the Surveyor on this project. Therefore, these items are not
included in the Scope of Services. Should these services be needed, they can be
provided as additional services.
Permit Fees, Bid Advertisements or Public Notices - Costs associated with permit
fees, bid advertisements or public notices are not included in the above costs. Should
those services be necessary, the associated engineering services will be considered
additional services.
Surveying Services - The City of Pearland shall employ and pay for the services of
the Surveyor. (Surveying is not included in the lump sum fee). Surveyor shall
identify all utilities and topographic information which would pertain to the design
and construction.
Geotechnical Investigation - The City of Pearland shall employ and pay for the
services of the geotechnical engineer. (Geotechnical engineering is not included in
the lump sum fee).
Easement Acquisitions - It is not anticipated that easements will be required for the
construction of the work, therefore, these items are not included in the Scope of Basic
.Services. Should these services be needed, they can be provided as additional
services.
Coordination with Pipelines and Utility Owners - Services associated with meetings
with utility and pipeline owners, inspections, and negotiations are not included in the
Scope of Basic Services. Should those services be necessary, the associated

engineering services will be considered additional services.
Negotiations. Contracts and Agreements - Services associated with negotiating and
securing utility district agreements, developer agreements, interlocal agreements and
other agreements outside of the basic scope of services will be considered additional
services.

Miscellaneous Fees - Costs associated with permit fees, bid advertisements or public
notices are not included in the Scope of Basic Services. Should those costs be
incurred, they will be invoiced as additional services.
Compensation
We can perform the Preliminary Phase, Design Phase and the Bid Phase services for a lump
sum fee of $19,600 which includes the water line design. The Construction Phase services
can be performed on an hourly basis in accordance with the attached hourly rate schedule not
to e~{cded $3,000 without written approval by the Owner.

We can complete the Preliminary Phase within three weeks of notice to proceed. The Design
Phase can be completed within six weeks after the Preliminary Phase acceptance by the City
or within the schedule required for the project.
