MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, HELD ON MAY 10, 1999, AT 7:30 P.M., IN THE COUNCIL
CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.
The meeting was called to order with the following present:

Grants Director Janet Berry, Planning and Community Development Director Dennis Smith,
Parks & Recreation Director Ed Hersh, Public Works Director Jerry Burns, Emergency
Management Coordinator David Smith, Assistant City Attorney Nghiem Doan, Project
Manager Michael Ross, Assistant Police Chief Johnny Spires, Purchasing Officer Gordon
Island, and Chief Building Official Gene Tumlinson.
CITIZEN'S:
Jeannie Littlefield, 255 E. Castle Harbour, asked the Mayor and Council if Ms. Gonzales
could speak in her place?
Connie Gonzales, 8330 Lenore, addressed Council and stated that she is a vendor and is
the spokesperson for other vendors at Cole's Flea Market at 1014 North Main. She stated
that the customers and vendors enjoy the open-air market. Ms. Gonzales further stated that
the Pearland Police Department has been at the entrance of the flea market for the past few
weeks, and it is hurting their business. She asked why is the police department, is present
at the flea market? She stated that she has three questions to ask, and she wants the City

to answer them. Number one, why are the Pearland Police stopping only the Hispanic
vendors and/or customers? Two, why do they feel it is necessary to tell the vendors and/or
customers coming into the Flea Market to get into the "Mexican Lane" and number three,
why do they only target Cole's Flea Market, and not WalMart or Kmart and any other
shopping center nearby? She further stated that she knows that an attorney has been in
contact with the City Manager and has requested a meeting with him. Ms. Gonzales also
stated that she has contacted L.U.L.A.C. (League of United Latin American Citizens)
regarding this matter. In closing Ms. Gonzales asked the City to respond to her questions
within five days.
Mayor Reid stated that he will refer this matter to the City Manager for further action.
Margaret McNulty, 2906 Castle Ct., addressed Council and stated that she has had
problems in her neighborhood with cats. Ms. McNulty said that animal control has worked
very close with them. Between her and her neighbors they have trapped 22 cats, and all of
the cats belong to one of her neighbors. She asked the Council what the City could do for
her?
The Mayor stated that he will ask the City Manager to have the Code Enforcement Officer
check into this matter.
Jerry Marsh, 3518 Whitestone Dr., addressed Council and asked for the City to assist the
Cobblestone Subdivision with the upkeep of the detention pond. He said that his wife called
the City and County regarding this matter and both entities placed the responsibility on the
other. He said that the detention pond will not hold water like it has in the past, and it could
not hold a five -inch rain. In closing he stated that they need help cleaning the detention
pond.
Mayor Reid commented that he noticed that the City Manager took notes regarding this
problem, and the City Manager will also check into this matter.

ABANDONING A CERTAIN SEVENTY FOOT (70') WIDE UNCONSTRUCTED
ROAD RIGHT-OF-WAY LOCATED BETWEEN THE GREENWOOD AND McGINNIS
SUBDIVISIONS, WITHIN THE CORPORATE CITY LIMITS OF PEARLAND,
BRAZORIA COUNTY, TEXAS, IN ACCORDANCE WITH ORDINANCE NO. 788;
HAVING A SAVINGS CLAUSE AND A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
B. FIRST READING OF ORDINANCE NO. 509- 311 - AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO.
509, THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY
OF PEARLAND, TEXAS, FOR THE PURPOSE OF CHANGING THE
CLASSIFICATION OF CERTAIN REAL PROPERTY LOCATED IN THE CITY
LIMITS OF THE CITY OF PEARLAND, BRAZORIA COUNTY,
TEXAS(APPLICATION NO'S. 611, 637, 687, 691, & 692) FROM CLASSIFICATION
SUBURBAN DEVELOPMENT DISTRICT (SD) TO SINGLE FAMILY DWELLING
DISTRICT (R-1) AT THE REQUEST OF THE OWNERS OF SUCH REAL
PROPERTY, PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT
MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN
EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT.
Councilmember Wilkins made the motion, seconded by Councilmember Beckman, to
approve Ordinance Nos. 904 and 509-311 on their second and final reading as presented
on the Consent Agenda.
Voting "Aye" Councilmembers Beckman, Tetens, Berger, Wilkins, and Seeger.
Voting "No" None.
Motion Passed 5 to 0.

Council adjourned into Executive Session under Texas Government Code at 8:32 p.m. to
discuss the following:

1. SECTION 551.072 - REAL PROPERTY: DISCUSSION REGARDING
THE SALE, PURCHASE, OR EXCHANGE OF REAL PROPERTY
FOR THE EXTENSION OF THE MCHARD ROAD RIGHT -OF- WAY
EAST OF HIGHWAY 35.
Council returned from Executive Session at 8:58 p.m.
NEW BUSINESS (CONTINUED):
COUNCIL ACTION - DIRECTION TO STAFF REGARDING THE SALE, PURCHASE, OR
EXCHANGE OF REAL PROPERTY FOR THE EXTENSION OF THE MCHARD ROAD
RIGHT -OF- WAY EAST OF HIGHWAY 35.
Councilmember Beckman made the motion, seconded by Councilmember Tetens, to direct
the staff to proceed regarding the sale, purchase, or exchange of real property for the
extension of the McHard road right of way east of Highway 35.
Voting "Aye" Councilmembers Beckman, Tetens, Berger, Wilkins, and Seeger.
Voting "No" None.
Motion Passed 5 to 0.
