1999-04-05 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES023 MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 5, 1999, AT 6:30 PM, IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. PURPOSE OF HEARING - APPLICATION NO. 661 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Heavy Industrial District (M-2) on the following described properties, to -wit: Legal Description: Being 2.4988 acres out of Lot 13, Allison Richey Gulf Coast Home Co. subdivision, Section 7, H.T. & B. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Fred Weimer, 3513 Plum, Pearland, Texas, 77581 stated that he is the owner of Weimer Construction and the company has been operating for 15 years. He then stated that he would like this zone change to be passed for his company to continue. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None V. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Light Industrial District (M-1) on the following described properties, to -wit: 1. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Application No. 575 - Paul Mulcahey, P.O.Box 218, Manvel, Texas, 77578, stated that he is a co-owner of Machine Specialist, the company on the property being requested. He then stated that the business has been in operation for 13 years and it is a clean organized business that employees around 20 people. Application No. 575 - Charles Upshaw, co-owner of Machine Specialist, added that the business will not create heavy truck traffic. Application No. 575 - Wayne Smith, of Wayne Smith Tree Farms, stated'that he is 100% for the shop next to his property. 026 IV. V. VI. - Mike Bowlin, 6315 Cottonwood, explained that he lives and works in the neighborhood. He added that this shop supplies good jobs and is a good use for the zoning. John Cole, 3520 East Circle, expressed concern about how this property zoning will affect his zone change application to General Business for the property next to it. PERSON WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember William Berger asked if there was anything on the property that requires industrial zoning. He expressed concern about having industrial zoning with residential surrounding it. ADJOURNMENT The meeting for Zone Change Application No. 655 adjourned at 6:55 PM. APPLICATION NO. 584 CALL TO ORDER The meeting was called to order at 6:56 PM. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and urban Development Ordinance of said City from Classification Single Family Dwelling District (R-1) and Neighborhood Service (NS) to General Business District (GB) on the following described properties, to -wit: Legal Description: Being 1.91 acres, more or less, out of the W.D.C. Spencer 1120 Nasa Road One #610 Houston, Texas 77058 - 027 The purpose of the public hearing was read into the record by Chairperson Mary Starr. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Ronald Stag, 1213 Gulfton, explained that he owns the property at 2014 Broadway. He stated that he purchased the property seven years ago and built the dance studio. He added that this zone change request would not be in the best interest of his business. Lisa Price, 3204 Hamm Road, stated that this property adjoins hers. She added that she strongly urges this property remain residential. It is surrounded by residences and three churches. Bela Toth, 3206 Hamm Road, stated that he supports those opposing this request. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION none VI. Circle, explained that this property is now an electrical contractor. He added that even though there is a lot of residential, there is also businesses in the area. He stated that the property next to his is the property being considered under Zone Change Application No. 315 for Mike Sanders to M-1. IV. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. Ill. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Application No. 588 - John Cole, 3520 E. Circle, explained that three years ago his goal was to develop small mobile home community. He stated that he has spent a lot of time and money on this property and would like to be able to replace the homes in case of fire or flood. He added that all of the homes are skirted and decked. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Application No. 590 - Roy Balch, 5913 Becky Lane, stated that he has a house onLots 7 & 8 and that he is against any mobile home park. He added that his property was just rezoned to R-1 a few months ago. Application No. 590 - Gary Crabb, 6219 Becky Lane, explained that he lives across from this property. He added that they have the nicest street in the area and they don't want to have any mobile homes. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember Richard Tetens stated that Zone Change Applications No. 565 and 590 should not be considered because they are not large enough to be considered as mobile home parks and that is all that the ordinance allows. Director of Planning & Community Development Dennis Smith agreed with Mr. Tetens that at this time, the ordinance only allows for mobile home parks. City Attorney Darin Coker stated that these applications were originally brought forward in the thought that a zoning designation would be created specifically for mobile homes, however, that may or may not happen. VI. ADJOURNMENT The meeting to consider Zone Change Applications No. 565, 588, 590, 580, 609, 610, 623 and 696 adjourned at 7:20 PM.
