Ord. 509-002 06-23-86ORDINANCE NO. 509-2 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING AN AMENDMENT OF THE' LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, ANTHONY F. AND VIRGINIA VENTO, Owners, filed April 23, 1986, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said prop'erty being legally describbed in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 19th day of May, 1986, a joint public hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit "B," said call and notice being in strict conformity with the provisionsof Section28.3 and 28.4 of Ordinance No. 5.09; and WHEREAS, on the 22nd day of May, 1986, the Planning and Zoning · Commission of the City submitted their report and recommenda-tionto the City Council regarding the proposed amendment application of Anthony F. and Virginia Vento, Owners, whereby they recommended and approved a change of classification for the property described in Exhibit "A" from its 'existing classification of Residential (R-l) to NS, Neighborhood Service District; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application at their regular meeting on May 27, 1986; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, having been fully advised in the premises, finds that in the case of the application of Anthony F. and 1 Virginia Vento, Owners, facts were presented which, in the judgment of the City Council would justify the approval of said application, it is therefore, ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Residential (R-l) is hereby for all purposes changed'and reclassified as NS, Neighborhood Service District: A 0,390 acre tract of land being a portion of Lot Two (2) out Of a 5.5 acre tract, partof an original called 27.09 acre tract in the W.D.C. Hall League, Abstract 70, Brazoria County, Texas, said 5.5 acre tract being described in Vol. 685, Page 660, and said 27.09 acre tract being described in Vol. 64, Page 70, both of Deed Records, Brazoria County, Texas and being more particularly described as follows: BEGINNING at a 1 inch iron pipe at the most southerly corner of the aforementioned 5.5 acre tract also being the most southerly corner of the herein described tract, said pipe also being in the north right of way line of F.M. 518 (100 foot R.O.W.); THENCE N 64° 06' West along the north right of way line of F.M. 518 a distance of 141.95 feet to the 1/2 inch iron rod for corner; THENCE N 45° 00' East a distance of 149.12 feet to a 1/2 inch iron rod for corner; THENCE S 45© 32' East a distance of 134.19 feet to a 1/2 inch iron rod for corner in the southeast line of said 5.5 acre tract; THENCE S 45° 00' West along the southeast line of said 5.5 acre tract a distance of 103.92 feet to the PLACE OF BEGINNING and containing 0,390 acres of land, more or less. II. The City Secretary is hereby directed to .cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509, and consistent with the approval herein granted for the reclassification of the hereinabove described property.
