ORDINANCE NO. 509-6 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, ~4ENDING ORDINANCE N0. 509, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING AN AMENDMENT OF THE LAND: USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO- VISIONS RELATING TO THE SUBJECT. WHEREAS, ANN SHIVER, Agent for KEITH LOSEE, Owner, filed September 4, 1986, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original application for amendment attached .hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 23rd day of September, 1986, a joint public hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit "B" said call and notice being in strict , conformity with the°provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 1st day of October, 1986, the Planning and Zoning Commission of the City submitted their report and recommendation to the City Council regarding the proposed amendment application of Ann Shiver, Agent for Keith Losee, Owner, whereby they recommended and approved a change of classification for the property described in Exhibit "A" from its existing'classification of Medium Density Single Family Dwelling District (R-2) to Commercial (C); and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this. application at their regular meeting on October 13, 1986; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, having been fully advised in the premises, finds that in the case of the.application of Keith Losee, 1 Owner, facts were presented which, in the judgment of the City Council would justify the approval of said application, it is therefore, 0RDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Medium Density Single Family Dwelling District (R-2) is hereby for all purposes changed and reclassified as Commercial (C): 10.00 acres of land, more or less, and being Lot No. Forty-nine (49) in Section Six (6),. H.T. & B.R.R. Co. Survey Abstract B44, Brazoria County, Texas as shown by the Allison-Richey Gulf Coast Home Company's Sub- division, plat recorded in Volume 186, page B00-B01, Deed Records of Brazoria County, Texas, and being more particularly described as follows: BEGINNING at a point in Hatfield Road for the southeast corner of the aforesaid Lot 49 which is also the northeast corner of Lot from which the'southeast corner of the aforesaid Section No. 6 bears south - 842.4 feet; THENCE West at 22.4 feet pass an iron rod for reference corner and continue for a total distance of 1086.7 feet to an~iron rod at the southwest corner of the aforesaid Lot 49; THENCE North along the west line of Lot 49, a distance of 420.2 feet to an iron rod for the northwest corner of same; THENCE East along the north line of Lot 49, at 1016.0 feet pass an iron rod on west side of Hatfield Road and continue for a 'total distance of 1036.7 feet to the northeast corner of Lot 49; THENCE South along the east line of Tract 49 and Hatfield Road, a distance of 420.2 feet to the PLACE OF BEGINNING and containing 10.O0 acres of land, more or less. II. _ The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. B09, and consistent with the approval herein granted for the reclassification of the hereinabove described property.
