AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING
ORDINANCE NO. 509, KNOWN AS THE LAND USE AND URBAN
DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS|
PROVIDING AN AMENDMENT OF THE LAND USE DISTRICT MAP;
PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PRO-
VISIONS RELATING TO THE SUBJECT.
WHEREAS, TOM J. HODGES, Agent for PEARLAND HOME ASSOCIATION,
Owner, filed July 7, 1989, an application for amendment pursuant to
Section 28 of Ordinance No. 509, the Land Use and Urban Development
Ordinance of the City, for approval of a change in the land use as
provided for in said Section 28, said property being legally described
in the original application for amendment attached hereto, and made a
part hereof for all purposes, as Exhibit "A"; and
WHEREAS, on the 81st day of July, 1989, a joint public hearing
was held before the Planning and Zoning Commission and the City
Council of the City of Pearland, Texas, notice being given by publica-
tion in the official newspaper of the City, the affidavit of publica-
tion being attached hereto and made a part hereof for all purposes, as
Exhibit "B," said call and notice being in strict conformity with the
provisions of Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 8th day of August, 1989, the Planning and
Zoning Commission of the City submitted their report and recommenda-
tion to the City Council regarding the proposed amendment application
of Tom J. Hodges, Agent for Pearland Home Association, Owner, whereby
they recommended and approved a change of classification for the
property described in Exhibit "A" from its existing classification of
R-2, Medium Density Single Family Dwelling District to GB, General
Business; and
WHEREAS, upon receipt of the report from the Planning and
Zoning Commission, the City Council considered this application at
their regular meeting on August 28, 1989; and
WHEREAS, the City Council having fully heard the testimony and
argument of all interested parties, having been fully advised in the
premises, finds that in the case of the application of Tom J. Hodges,

which, in the judgment of the City Council, would justify the approval
of said application, it is therefore,
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
The following described property located within the corporate
City limits of the City of Pearland, Texas, and presently classified
as R-2, Medium Density Single Family Dwelling District is hereby
for all purposes changed and reclassified as General Business (GB):
A 10.0005 acre tract of land being Lot 47 of the
Allison Richey Gulf Coast Home Company Subdivision
of Section 6, H.T. & B.R.R. Survey, Abstract 544,
Brazoria County, Texas, (Hatfield Road), and being
more particularly described by metes and bounds as
follows:
BEGINNING at an old 3/4 inch iron pipe at the Northwest corner of the
aforementioned Lot 47;
THENCE N 89° 55' 56" E, along the North line of said Lot 47, at a
distance of 1018.70 feet pass on old 3/4 inch iron pipe in the West
line of Hatfield Road, continuing in all a total distance of 1036.70
feet to a point for corner in the centerline of Hatfield Road, being
the Northeast corner of said Lot 47;
THENCE South along the centerline of Hatfield Road and the East line
of said Lot 47, a distance of 420.20 feet to a point for corner, being
the Southeast corner of said Lot 47;
THENCE S 89° 55' 56" W, along the South line of said Lot 47, at a
distance of 20.00 feet pass a 1/2 inch iron rod in the West line of
Hat field Road, continuing in all a total distance of 1086.70 feet to a
1/2 inch iron rod for corner, being the Southwest corner of said Lot
THENCE North along the West line of said Lot 47, a distance of 420.20
feet to the PLACE OF BEGINNING and containing 10.O005 acres of land,
more or less.
II.
The City Secretary is hereby directed to cause to be prepared
an amendment to the official Land Use District Map of the City,
pursuant to the provisions of Section 2 of Ordinance No. 509, and
consibtent with the approval herein granted for the reclassification
of the hereinabove described property.

III.
This Ordinance shal I become effective after its passage and
approval on second and final reading.
