Ord. 509-028 11-04-91ORDINANCE NO. 509-28 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING AN AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAINING OTHER PROVI- SIONS RELATING TO THE SUBJECT. WHEREAS, C. Davis Wilson, agent, for Federal Deposit Insur- ance Corporation, owner, filed on September 13, 1991, an applica- tion for amendment pursuant to Section 28 of ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use and provided for in said Section 28, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A;" and WHEREAS, on the 7th day of October, 1991, a joint public hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 9th day of October, 1991, the Planning and Zoning Commission of the City submitted their report and recom- mendation to the City Council regarding the proposed amendment application of C. Davis Wilson, agent, whereby they recommended and approved a change of classification for the properties de- scribed in Exhibit "A" from its existing classification of R-4 Planned Unit Development to R-3, Single Family Dwelling District; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application at their regular meeting on October 14, 1991; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, having been fully advised in the premises, finds that in the case of the application of C. Davis Wilson, agent, facts were presented which, in the judgment of the City Council, would justify the approval of said applica- tion; Now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: rate classified as R-4, Planned Unit Development is hereby purposes 'changed and reclassified as R-3, Single Family The following described property located within the corpo- City limits of the City of Pearland, Texas, and presently for all Dwelling District: A 50.154 Acre of Land being the Southerly Portion of a 63.956 Acre Tract being a Portion of a 12.12 Acre Tract and a Portion of a 67.88 Acre Tract in Section Number 15 of the H. T. & B Railroad Company Survey, A-241. II..
