1993-08-23 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON AUGUST 23, 1993, AT 7:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The hearing was called to order with the following present: Mayor C. V. Coppinger Mayor Pro Tem/Councilmember Joy Colson Councilmember D. A. Miller Councilmember Benny Frank Councilmember Randy Weber Councilmember David Smith Planning & Zoning Chairman Richard Tetens Commissioner Helen Beckman Commissioner Jack Womack Commissioner Patsy Eilers Commissioner Rob Larsen Commissioner Pat Lopez City Manager Paul Grohman City Attorney Lester Rorick City Secretary Pat Jones Absent from the meeting: Planning & Zoning Vice Chairman Emil Beltz. Others in attendance: Division Directors Glen Erwin and Richard Burdine and City Engineer John Hargrove. NUMBER OF SIGNATURES ON THE ATTENDANCE ROSTER: 48 PURPOSE OF THE HEARING: SPECIFIC USE NO. 27, REQUEST OF ANN SHIVER, AGENT FOR AUTRY L. AND CHARLOTTE F. MCMILLAN, OWNERS, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE FOR A SPECIFIC USE PERMIT IN A MF, MULTI -FAMILY DWELLING DISTRICT, TO ALLOW SECURITY QUARTERS AND DAY CARE NURSERY AND/OR KINDERGARTEN SCHOOL ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Lots 1 - 5, Block 40, Pearland Townsite (2501 S. Austin) Mayor Coppinger asked Planning and Zoning Chairman Richard Tetens to introduce his fellow Commissioners. Mr. Tetens announced the Commission would consider this request at its meeting scheduled for tomorrow night. SPEAKING FOR THE PROPOSED REQUEST: 1. Sharon Hernandez, 4901 Silsbee. Mrs. Hernandez stated she is interested in buying the property to establish a day care center for children. Mrs. Hernandez cited her qualifications and stated the need for a child care center in this part of the town. Closing her remarks, Mrs. Hernandez commented on other home sites which were turned into day care centers. 2. Dean DeKerlegand, 2412 Parkview. Mr. DeKerlegand stated Mrs. Hernandez presently keeps his child and he is very pleased with the care his son receives. 3. Rodney Tanner, Bethany Assembly of God, 3011 Yost. Mr. Tanner spoke highly of Mrs. Hernandez's integrity and stated he felt the day care center would be a benefit to the City. 4. Debbie Sitler, 1139 Woodbridge. Mrs. Sitler stated Mrs. Hernandez has kept her children for several years, teaching them needed values. 5. Charla Reynolds, 2508 Julie. Mrs. Reynolds stated that even though she does not work outside the home, she feels it beneficial for her child to be under Mrs. Hernandez's care twice a week. 6. Arthur Jennings, 4010 Spring River. Mr. Jennings stated he and his wife have worked in the child care field and they know Mrs. Hernandez to be an excellent child care provider as their child is under Mrs. Hernandez's care. 7. Jack McGuff, III, 14834 Westchester Circle. Mr. McGuff stated he has two children under Mrs. Hernandez's care and he, until recently, lived in the same neighborhood where Mrs. Hernandez presently has her operation. The business was run in an unobtrusive manner, Mr. McGuff stated. SPEAKING AGAINST THE PROPOSED REQUEST: 1. Fay Hickey DeSale, Property Owner, Old Townsite. Mrs. DeSale presented a petition containing signatures of those opposing this proposed specific use permit. Mrs. DeSale cited decreased property values, increased traffic and wear on the recently repaired street. Mrs. DeSale noted there are other commercial areas available and discussed area zoning sites. Closing her remarks, Mrs. DeSale commended Mrs. Hernandez for the type of care she provides and stated the petitioners were not against day care, but did not want it in their area. 2. Rusty Rhodes, 2504 Ray. Mr. Rhodes spoke in opposition to the change, citing traffic problems and noting that when there is a railroad tie-up many people cut through their area in an attempt to get to Walnut Street. Two other persons, who could not be identified either by tape or the attendance register, spoke against the proposed change. QUESTION AND ANSWER PERIOD: The Commissioners asked they be given a copy of the petition for their meeting tomorrow night. ADJOURNMENT The hearing adjourned at 7:23 P. M.
