A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING A DESIGN BUILD CONTRACT FOR
CONSTRUCTION OF THE PUBLIC SAFETY BUILDING.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City reviewed Requests for Qualifications ("RFQ's") for
construction services associated with construction of the Public Safety Building ,and such
RFQ's have been reviewed.
Section 2. That the City Council hereby awards the contract for construction of
the Public Safety Building to J E Dunn, in the amount of $19,880,518.
Section 3. The City Manager or his designee is hereby authorized to execute a
contract for construction services associated with the construction of the Public Safety
Building.

6.5 The proposer agrees that this Proposal will not be withdrawn for a period of sixty (60)
days from the date of receipt of this offer by the Owner.
6.6 The Design-Build Contractor further agrees to pay, as Liquidated Damages, the sum of
One Thousand Five Hundred dollars ($1,500.00) per calendar day for failure to complete
the work within the contracted time in accordance the Construction General Conditions
and as established in the Contract.
6.7 Failure to complete all portions of this Proposal form may cause the entire Proposal to
be rejected.

conditions of the Request for Proposal, and based on the latest proposal documents developed
for this project, the following SFP construction price proposal:

3. A not-to-exceed amount for Contingency which is available for the Design-Build Contractor's
use for costs incurred in performing the work that are not included in a specific project cost
line item and could not be reasonably anticipated as a cost associated with this project and
would result in a Change Order under the Contract Documents. Such cost include trade
buy-out differentials, Owner requested overtime and/or acceleration. This contingency is not
available to Owner for changes in scope or other items which would.enable the Design-Build
Contractor to otherwise increase the SFP under the Contract Documents. Any unused
contingency amount will be deducted from the SFP by Change Order. The Design-Build
Contractor shall provide Owner with notice of all anticipated charges against the
Contingency.

STATEMENT OF PRINCIPLE FOR NAMING MAJOR SUBCONTRACTOR(S):
The City of Pearland has determined it is the best interest of the City (Owner) to require the
Design-Build Contractor to stipulate that the work covered by this proposal will be performed by
either the Contractor's own employees or by Subcontractor's which are expressly named in the
proposal. Such requirement is made only for the categories of Work stated on this proposal
form. The Owner assumes Subcontractor(s) named in this Proposal (being only one for each
category) is the Subcontractor whose price was used in calculating the proposed SFP.
NAMING SUBCONTRACTORS:
A Subcontractor must be named for each of the categories of Work listed below. Specify if work
will'be performed by the Design-Build Contractor's own employees. Failure to name one or
naming more than one Subcontractor for each category of work listed may cause the total
proposal to be rejected.
After receipt of proposal, substitutions(s) of the Subcontractor(s)listed may be made only with
written approval of Owner.

Dear Mr.Eisen:
.During the past few weeks, Huitt-Zollars, Inc. has performed extensive evaluations of the overall
qualifications of firms submitting for the Design-Build of the City of Pearland Public Safety
Building. These evaluations have included: verification of client recommendations; performance
on previous projects; expertise in;this type of project; and overall, reputation of the firm in the
'industry. Also included were evaluations of their cost proposals.
JE Dunn's proposal'for $1.9,8 million appeared to be the best value. However, discussions with.
JE Dunn indicated that we might be able to reduce the cost.soinewhat by modifying the program.
To that end, we worked with JE.Dunn in an,attempt to refine the program, thereby lowering the
building square footage and.presumably lowering the price. Despite such efforts,we were unable
to achieve an acceptable facility at a significantly lower price.
As a result of these evaluations and subsequent actions, we have identified JE Dunn's proposal.
for$19,880,518 as the apparent best value. We therefore recommend Council approve a design-
build contract with,IE Dunn for design and construction of this project.

No. We are using a non-standard contract format for this project due to the structuring and type of
agreement, i.e. Design/Build. For that reason we are using the AIA 141 which is a specialized
agreement format that Council approved the use of for this project and confirmed the use of in November.
Because we are having to modify that standard contract format it will take a few weeks to put that
document together. I will forward those on to you as soon as that process is completed.
