1993-04-05 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF A JOINT PUBLIC HEARING BY THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 5, 1993, AT 7:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The Hearing was called to order with the following present: Mayor C. V. Miller Councilmember Benny Frank Councilmember Joy Colson Councilmember David Smith Planning & Zoning Chairman Richard Tetens Planning & Zoning Vice Chairman Emil Beltz Commissioner Jack Womack Commissioner Pat Lopez Commissioner Helen Beckman Commissioner Mary Starr Commissioner James Garner City Manager Paul Grohman City Secretary Pat Jones Others in attendance were Division Director Richard Burdine and Chief Building Official Don Guynes. PURPOSE OF THE HEARING: SPECIFIC USE PERMIT NO. SP -24 REQUEST OF BILL WOOTTON, OWNER, FOR A SPECIFIC USE PERMIT IN AN R-1, SINGLE FAMILY DWELLING DISTRICT, TO RAISE AND SELL LIVESTOCK ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: 14.06 ACRES OF LAND, MORE OR LESS, OUT OF A 36.3870 ACRE TRACT, OUT OF THE EINAR HOIDALE SUBDIVISION, PERRY AND AUSTIN LEAGUE, A-111, BRAZORIA COUNTY, TEXAS (1325 E. BROAD- WAY) NUMBER OF SIGNATURES ON ATTENDANCE ROSTER: 10 Mayor Coppinger introduced Richard Tetens, Chairman of the Plan- ning and Zoning Commission, who introduced the members of the Commission. SPEAKING FOR THE PROPOSED REQUEST: 1. Bill Wootton, 1325 E. Broadway. Mr. Wootton stated he owned a 37 acre tract and wished to raise livestock on part of this acreage which is at a distance from any homes. Mr. Wootton pointed out that there are other livestock uses along FM 518. SPEAKING AGAINST THE PROPOSED REQUEST: 1. Dorothy Burgett, 2406 John. Mrs. Burgett presented a peti- tion to the City Secretary which she said contained approxi- mately 100 signatures against the proposed request for rezoning. Mrs. Burgett stated this area has been zoned residential and the petitioners request it remain so. 2. Frank Burgett, 2406 John. Mr. Burgett spoke voicing the same objections. 3. Donna Lunn, 2609 Mary. Mrs. Lunn asked that this area be kept residential. 4. Frances Denton, 2715 Hazel. Mrs. Denton stated she was opposed for the same reasons. 5. James Johnson, 1402 Paul. Mr. Johnson stated he wished the area to remain residential. 6. Curtis Spencer, 2723 Leroy. Mr. Spencer expressed the opinion that allowing this specific use request would lower property values. QUESTION AND ANSWER PERIOD: Council discussed the type of livestock to be raised and it was stated that it might be ostriches and emus. The location of the property was discussed. It was noted the animal control ordi- nance prohibits these type animals in the city limits and that a specific use permit should be "specific" in its request. ADJOURNMENT Hearing adjourned at 7:18 P. M. PURPOSE OF THE HEARING: SPECIFIC USE PERMIT NO. SP -25 REQUEST OF JAMES R. AND JANICE PASKET, OWNERS, FOR A SPECIF- IC USE PERMIT IN A COMMERCIAL ZONE TO ERECT A METAL BUILDING FOR USE AS A GENERAL MACHINE SHOP ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: LOTS 9 AND 10 OF THE THOMAS A. GILBERT INDUSTRIAL TRACT SUBDIVISION OUT OF TRACT 119 OF THE A.C.H. & B. SURVEY, SECTION 1, ABSTRACT 147, BRAZORIA COUNTY, TEXAS (3425 AND 3427 SWENSEN DRIVE) NUMBER OF SIGNATURES ON ATTENDANCE ROSTER: 2 SPEAKING FOR THE PROPOSED REQUEST: 1. James and Janice Pasket, 10429 Chambers, Houston. Mr. & Mrs. Pasket explained they have had a machine shop in anoth- er location since 1979 and would like to move their shop to this area. There will be no noise factor and discussed adjacent property uses. They stated there will be no out- side storage and manufactured pieces will be shipped by UPS. They presented a drawing of the proposed site, which will be climate controlled to meet inspection requirements, and stated the owners of adjoining property do not object. There will be only two employees at this site, Mr. & Mrs. Pasket informed, closing their remarks. PERSONS SPEAKING AGAINST THE PROPOSED REQUEST: None QUESTION AND ANSWER PERIOD: Council discussed noise, hours of operation, and type of machines to be used. Differences in zoning requirements for light manu- facturing, commercial, and general business were discussed. ADJOURNMENT Hearing adjourned at 7:33 P. M. PURPOSE OF THE HEARING: SPECIFIC USE REQUEST NO. SP -26 REQUEST OF SUZANNE S. STOREY, AGENT FOR CUELLAR, ET AL, 10 OWNERS, FOR A SPECIFIC USE PERMIT IN AN R-1, SINGLE FAMILY DWELLING DISTRICT, TO BUILD A CHURCH ON THE FOLLOWING DE- SCRIBED PROPERTY, TO -WIT: A 9.81470 ACRE TRACT OF LAND BEING LOT 25B, WILLITS SUBDIVI- SION, AND LOTS 32 AND 33, NARREGANGS SUBDIVISION OUT OF THE W.D.C. HALL SURVEY, A-70, BRAZORIA COUNTY, TEXAS. (PROPERTY ON E. BROADWAY (FM 518)) NUMBER OF SIGNATURES ON ATTENDANCE ROSTER: 4 SPEAKING FOR THE PROPOSED REQUEST: 1. Suzanne Storey, Agent for Cueller, et al. Ms. Storey stated she represented the Cuellars who were present in the audi- ence. She introduced Ken Gurley of the United Pentecostal Church. 2. Ken Gurley, Pearland Tabernacle. Mr. Gurley stated he pastors Pearland Tabernacle which is currently on McLean Road. Mr. Gurley stated his church would like to relocate to the east side of town as a large majority of the members reside on the east side of Pearland. 3. B. V. Barnett, Pearland Tabernacle. Mr. Barnett stated he is the retired pastor of this church. Their congregation is growing and they would like to be on the main thoroughfare. 4. Marcella Estrella, 1920 E. Broadway. Ms. Estrella stated she owns the land which adjoins the property in question and stated she felt it would enhance the value of the property. SPEAKING AGAINST THE PROPOSED REQUEST: None QUESTION AND ANSWER PERIOD: Council noted there are already churches in the area and dis- cussed the exact location of the property.
