HELD ON APRIL 27,1998, AT 7:00 P.M., IN THE COUNCIL CHAMBERS, CITY HALL,
3519 LIBERTY DRIVE, PEARLAND, TEXAS.
The Joint Public Hearing was called to order with the following present:

OVERLAY DISTRICT
I. CALL TO ORDER
The meeting was called to order at 7:45 p.m.
H. PURPOSE OF HEARING - OVERLAY DISTRICT
Scott.
Request of City staff for the purpose of amending the Land Use and Urban Development
ordinance by creating a zoning overlay district on the following described property, to wit:
Pearland Parkway/Oiler Drive from the intersection of S.H. 35 (Main St.)
Northeast to F.M. 518 & across F.M. 518 to a point approximately 1000 ft. North
The purpose of the public hearing was read into the record by Vice -Chairman Tommy
Director of Planning & Community Development Dennis Smith presented the location of
the proposed zone change.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
City Manager Paul Grohman states that staff has been working on this project for 15 to
16 months. The goal of this project is to enhance commercial corridor where the city
controls development aesthetics. He explained that two separate drafts have been

fti presented to Council prior for any deletions and additions.

Director of Planning & Community Development Dennis Smith presented the Overlay
District. The items presented included:
*Building setbacks
*Building articulation
*Off street parking and landscaping
*Screening & buffering
*Signs
Judy Zavalla, President of Keep Pearland Beautiful, read a letter from the committee in
support of the Overlay District.
Mayor Pro -Tem Helen Beckman reads a letter from the Chamber of Commerce supporting
the plan. Both letters were submitted to Planning & Zoning secretary Karla Canada and
entered into the record.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
Renee West, West Development was present. Ms. West explained to Council that she had
been working on a tract of land for 4 to 5 months which is included in the Overlay
District. She stated that she has been to several meetings with City staff in regard to the
property and was never told about the Overlay District Plan in any of these meetings.
She feels staff and planning are becoming developers and are leaving the developers out
of any involvement with this issue. She feels they should seek more input from the major
developers in the are before proceeding. She feels that this will hold up the land that can
be used for other growth.
Thomas Kidd, Sterling Drive, said individual growth gets squashed when government
begins regulating.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Councilmember William Berger refers to page 3 and page 8 of the Overlay District where
is outlines that the City Manager would have the decision on certain issues. Mr. Berger
feels Planning & Zoning should have the final say. City Manager Paul Grohman states
that it says him or his designee, which would be a city official such as the Building
Official or someone more experienced in this area.
Planning & Zoning Commissioner Pat Lopez reminded everyone that Planning & Zoning
does land use only. It is not their job to pick colors. He suggested an architectural
review board be created as an option.
City Manager Paul Grohman stated that the intent is not to control the zoning, so much
as to control the vantage point. He said it would only heighten the uses that do come in.
Mayor Tom Reid said there will be a long process before this is adopted; they are only
looking for opinions at this time.
Mayor Pro -Tem Helen Beckman asked if the Overlay District is as it exists now, or as it r
is planned? City Manager Paul Grohman responded that it is up to Council. He would
like to see it extend to the Hwy 288/McHard Road development.
Mayor Pro -Tem confirmed that she prefers 8' sidewalks. Planning & Zoning
Commissioner Pat Lopez stated that would only leave 3' on each side and didn't feel this
is feasible.
VI. ADJOURNMENT
The meeting adjourned at 8:20 p.m.
