A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
CONVEY, BY QUITCLAIM DEED, CERTAIN REAL PROPERTY SITUATED
IN THE CITY.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a Quitclaim Deed for certain real property, more accurately
described in Exhibit "A" attached hereto, with the Texas Department of Transportation.

That, the City of Pearland of the County of Brazoria, State of Texas, hereinafter referred
to as Grantors, whether one or more, for and in consideration of the sum ofTen Dollars ($10.00)
and other good and valuable consideration to Grantors in hand paid by the State of Texas, acting
by and through the Texas Transportation Commission, the receipt of which is hereby
acknowledged, and for which no lien is retained, either expressed or implied, have Quitclaimed
and do by these presents Bargain, Sell, Release and forever Quitclaim unto the State of Texas all
of Grantors' right, title, interest, claim and demand in and to that certain tract or parcel of land,
situated in the County of Brazoria, State of Texas, more particularly described in Exhibit "A"
attached hereto and incorporated herein for any and all purposes.
TO HA VE AND TO HOLD for said purposes together with all and singular the rights,
privileges, and appurtenances thereto in any manner belonging unto the said State of Texas
forever.

Survey, Abstract Number 505 in Brazoria County, Texas, being a portion of a called
238.414 acre tract of land described in Warranty Deed from Peyton Martin, Trustee to MHI
Partnership, Ltd, executed July 29, 2003, as filed for record under Clerk's File Number 03
046549 of the Brazoria County Deed Records same being all of a 10 foot wide right-of-way
widening strip Dedicated to the City of Pearland as shown on the plat of Avalon TerracE~,
Section 1 as recorded in Volume 24, page 288 of the Brazoria County Plat Records, said
0.4747' acre tract is more particularly described as follows with all bearings based on the
Texas State Plane Coordinate System, South Central Zone (4204), North American Datum
of 1983 (NAD 83) as determined with Global Positioning Satellite Equipment;
BEGINNING at a 2 inch pinch top pipe round for the southwest corner of said 238.414 acrE~
tract and being on the existing north right-of way line of F. M. 518 (Broadway) (called 100'
wide) from which a 1/2 inch iran rod found for the northwest corner of said 238.414 acre
tract bears North 02052'26" West, 5,240.11 feet;
THENCE, North 02c52'26" West. 10.00 feet along the west line of said 238.414 acre traci to
a 3/4 inch iron rod with ca.p stamped "Cotton Surveying" set for comer on the proposed
north right-of-way line of FM 518;
THENCE, North 87017'54' East, 2067.70 feet along the proposed north right-of-way line of
FM 518 to a 3/4 inch iron rod with cap stamped "Cotton Surveying" set for corner on the
common east line of said 238.414 acre tract and the west right-of-way line of County Road
wa (Max Road) (called 60' wide);
THENCE, South 02052'03" East, 10.00 feet along said common line to a 2 inch pinch top
pipe found for the southeast corner of said 238.4 '14 acre tract and being at the intersection
of the west right-of-way line of said County Road 108 (Max Road) and the existing north
right-or-way line of the aforesaid F.fv1. 518;
THENCE, South 87017'54" West, 2067.70 feet along the common south line of said 238.414
acre tract and the existing north right-ot-way line of said FM 518 to the POINT OF
