R2003-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING WORK AUTHORIZATION #5 SUPPLEMENT//4 FOR ENGINEERING SERVICES ASSOCIATED WITH THE PEARLAND MOBILITY AND DRAINAGE BOND PROGRAM (CULLEN BOULEVARD PROJECT). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain contract by and between the City of Pearland and Turner, Collie and Braden, Inc., ("T C & B) for Program Management of the Pearland Mobility and Drainage Bond Program was authorized by the City Council on December 10, 2001. Section 2. That T C & B has developed work authorization #5 Supplement fl4, which is attached hereto as Exhibit "A". Section 3. That work authorization #5 Supplement #4 for engineering services associated with the Cullen Boulevard Project is hereby approved. COKER CITY ATTORNEY TOM REID MAYOR ATTACHMENT D WORK AUTHORIZATION NO. 5 SUPPLEMENT NO. 4 Exhibit "A" Resolution No. R2003-43 This Work Authorization is made pursuant to the terms and conditions of the Pearland Mobility & Drainage Bond Program, hereinafter idemified as the "Contract", entered into by and between the City of Pearland ("City"), and Turner Collie & Braden Inc. ("Engineer). PART 1. Work Authorization No. 5, is related to The Cullen Road Extension Project. The Engineer will perform Design Services.. PART 2. The maximum amoum payable for services under this Work Authorization No.5 Supplement No. 4 is $199,426.74. This amount is based on the attached fee proposal submitted by Freese and Nichols, Inc. for Engineering Design Services, dated February 20, 2003. PART 3. Paymem to the Engineer for the services established under this Work Authorization shall be "Lump Sum Basis". PART 4. This Work Authorization shall become effective on March 4, 2003 and shall terminate on November 12, 2005, unless extended by a supplemental work authorization. PART 5. This Work Authorization does not waive the parties' responsibilities and obligations provided under the contract. PART 6. This Work Authorization is hereby accepted and acknowledged below. (herein called Project Engineer) shall render the following professional services to the City of Pearland/Program Manager (herein called OWNER) in connection with the development of Cullen Boulevard Extension From Broadway (FM 518) to Northfork Drive, herein called the Project: I. General In general, and except as may be modified herein or directed by City of Pearland, engineering design, plans and specifications and construction procedures will follow the usual practices of the City of Pearland, and will be in conformance with City of Pearland Program Procedures and Design Criteria Manual and will conform to approved schematic layouts and profiles. The Project Engineer will perform all requisite engineering design services for the project, including engineering analysis, preparation of construction plans, specification and estimates of prob~tble construction costs. Design Services The engineering services to be performed by the Project Engineer are those services which are necessary for the preparation of design construction plans, specifications, and other items of work related thereto, all of which are hereinafter referred to as the "Design Phase Services." Design Phase Services will include but are not limited to the general type and classifications listed in the fOllowing: A. Roadway Design Controls 1. Prepare existing and proposed typical sections of all roadway elements. Prepare roadway plan and profile sheets showing horizontal and vertical geometric design including the necessary refining of the horizontal and vertical alignment shown on the preliminary layout. The plan and profile sheets shall have 1 inch = 20 feet horizontal scale and 1 inch = 2 feet vertical scale. Roadway design will be for four-lane divided concrete street with 6" curb and 6' wide sidewalk on both sides. Drainage Design Prepare overall and detailed drainage area maps and calculations necessary to perform the design of the storm sewer system, roadside ditches, roadside swales, culvert crossing, outfall pipe and outfall structure. All calculations, drainage areas, and outfall system will be in conformance with the Drainage Study. Ce o Prepare Drainage Plan and Profile sheets which will include plan and profile information on storm sewers, roadside ditches, roadside swales, outfall piping outfall structures, existing utilities, and cross culverts. Storm sewer design shall be shown on roadway plan and profile sheets. Prepare plan and profile drawings shOwing each culvert crossing. 4. Prepare the necessary drainage detail sheets. Signal Modifications Design Perform the design of modifications to the existing Cullen Blvd. Broadway (FM 518) signal including necessary loop detectors and related pavement marking modifications. 2. PrePare the necessary details and standards for the signal modification. Miscellaneous Roadway Design Compute and tabulate construction quantities and prepare construction cost estimate. In addition to individual quantity summary sheets, checked quantities for each pay item of work included in the proposal form for the construction contract shall be tabulated on a general summary sheet. The general summary sheet or sheets shall conform to standards furnished by the Program Manager. 2. Prepare estimates and submit, with each review submittal. Prepare roadway details sheets and modify construction standards as required. Prepare Title Sheet and Index Sheet. The Title Sheet will be in the format established by the Program Manager. The Index Sheet will include a listing of the required construction standards approved by the City of Pearland. o Prepare project layout sheets and general construction notes, and provide construction standards approved by the City of Pearland/Program Manager. 6. Prepare signing, pavement marking, and illumination conduit plans. 7. Submit 30%, 60%, 90% and Final Plans for review. to Ge Utility and Layouts and Agreements Prepare layouts and profile of existing utility crossings showing conflict of utilities with proposed improvements. These.utility plans will show the location, alignment, and grade of each utility crossing, including both aerial and underground lines, giving the project station, skew, elevations, owner, the type of line crossed, and all other pertinent data visible in the field or obtainable from local residents records. The utility plans will be submitted on or before the 30% plan submittal date so that all utility company relocations may be approved prior to awarding of the general construction contracts. Prepare the exhibits, text correspondence and meeting attendance records to ensure the completion of all necessary utility agreements. o In counsel with the Program Manager, coordinate with utility companies to expose potential conflicts and field ties to uncover utilities in potential conflict areas. Include the utility companies' construction plans and specifications for the utility relocations, to be made by the construction contractor, in the plans and specifications issued by Program Manager for construction of the Project in logical numbered sequence. Tabulate utility quantities in the quantity summary and bidding documents. Design of new and/or relocation of City owned water, gravity seWer, forcemain, and service lines not included in this project. However design of spot adjustments/relocation for conflict resolution with proposed pavement and storm sewer will be performed and included in appropriate roadway/storm sewer plan and profile sheets. Earthwork Cross Sections Sections showing existing and proposed sections will be prepared every 100 feet on tangent sections and every 50 feet on curves for all roadways showing cut and fill quantities. These cross-section sheets will be plotted to a scale of 1" = 10' both horizontally and vertically on cross-section sheets of the same size as the plans. Quantities will be tested for accuracy and reliability prior to including in the plans. Design Computations Design computations will be neatly recorded on 8-1/2 inch by 11 inch computation sheets or standard computer printout, fully titled, numbered dated, signed and sealed by the maker, checked and indexed. A copy of these computations, fully checked, will be submitted with the completed tracings. Computations will be available at all times for review by City of Pearland and Program Manager. Check prints of drawings will be maintained at all times and be available for review by City of Pearland. III. Ho Agencies Coordination The Project Engineer shall provide the necessary coordinations with Brazoria Drainage District No. 4, and TxDOT and assist the City of Pearland in acquiring approvals and/or construction permits. Project Specifications Prepare Project specifications using the City of Pearland Standard Specifications and general notes for construction bidding, based on Program Manager provided General Notes library and project specifications. Preparation of Supplementary Specifications, Special'Provisions, and Contract Documents · Fumish drafts of supplemental specifications and special provisions of the construction contract, modifying, augmenting, or deleting the provisions of the Standard Specifications. The Project Engineer will also furnish estimates, proposal quantities, and all other information and data reftuired to complete the construction contract documents.. For all construction contracts, the contract documents will be printed and published by, bids will be received by, and the award of the contract or the rejection of bids will be made by City of Pearland with the assistance of the Program Manager. K. Assistance During Advertising and Award of Construction Contract Assist city of Pearland during the bidding process by, responding to questions raised by potential bidders and clarify plans and specifications as required to provide clarification and assistance in evaluation of proposals as required. Design Services During Construction A. Shop Drawings Shop detail and construction drawings submitted by the construction contractors will be reviewed and checked in accordance with accepted standards of professional practice. These will include reinforcement details, form details, and details of all other items required to review and evaluate for compliance of the IV. construction to the standards required. The review shall be sufficient detail to assure that the materials furnished are of proper size and strength and conform to the construction plans and specifications. Clarification Assist the City of Pearland and the Program Manager in providing responses to the Contractor's "Requests for Information" and to provide clarification to the plans and specifications as required. Additional Services A. Stormwater Pollution Prevention Plan Prepare stormwater pollution prevention plan (SWPPP) and layout sheets showing temporary control measure during each phase of construction. Also, prepare permanent sediment filtration ponds as required by Texas Commission Environmental Quality. B. Traffic Control Plan- 1. Prepare construction traffic control plans which will include the following: bo The seqUence of construction and method of handling traffic during each phase. The existing and proposed traffic control devices that will be used to handle traffic during each construction sequence, including signals, regulatory sign, warning signs, construction warning sign, guide signs, route markers, construction pavement markings, channeling devices, portable changeable message signs, flashing arrow boards, barricades, barriers, etc. Co , The proposed traffic control devices (stop signs, flag person, etc.) at grade intersections during each construction sequence. Where detours or temporary widening are provided, typical cross sections will be shown. Road construction work hours will be developed based on traffic conditions. Vo Time of Completion The Project Engineer is authorized to commence work on the Project upon execution of this AGREEMENT and agrees to complete the Design Phase Services so as to deliver the Vii VII. complete plans, specifications, and quantities to the OWNER within 180 days. Review periods by Brazoria Drainage District No. 4 and TxDOT to acquire approvals and permits have not been accounted for. If Project Engineer's services are delayed or suspended in whole or in part by OWNER or if Project Engineer's services are extended by'the Contractor's actions or inactions for more than 90 days through no fault of Project Engineer, the Project Engineer may be entitled to equitable adjustment of rates and amounts of compensation. Responsibilities of the OWNER The OWNER shall perform the following in a timely manner so as not to delay the services of the Project Engineer. Ao Designate a person to act as OWNER's representative with respect to the services to be rendered under this Agreement. Such person shall have contract authority to transmit instructions, receive information, interpret and define OWNER's policies and decisions with re,qpect to the Project Engineer's services for the project. Bo Provide all criteria and full information as to OWNER's requirements for the Project, including design objectives and constraints, space, capacity and performance requirements. Assist the Project Engineer by placing at Project Engineer's disposal all available information pertinent to the Project including previous, reports and any other data relative to the project. Do Provide complete topographical information including 100-ft cross-sections along Fite Road and along the proposed preliminary roadway alignment. Above information shall be provided in AUTOCAD Release 2000 electronic format with a hard copy. E. Provide As-built Plans of the section roadway completed at Broadway (FM 518). F. Provide prOposed roadway alignment to be used for the Project. Go Arrange for access to and make all provisions for the Project Engineer to enter upon public and private property as required for the Project Engineer. Compensation Compensation to the Project Engineer for the services defined in this Attachment for the Cullen Boulevard Extension between Broadway (FM 518) and Northfork Drive shall be a lump sum of $199,427.00. If the Project Engineer sees the Scope of Services changing so that additional services are needed, the Project Engineer will notify OWNER for OWNER'S approval before proceeding with any additional services. Additional Services, if authorized, shall be invoiced per Schedule of Charges attached. Upon authorization from the OWNER, the Project Engineer shall proceed with services outlined in this Attachment. Monthly payment reqUests shall be submitted to the OWNER-for the portion of service which has been accomplished as evidenced by' monthly statements. Final payment for the services shall be due upon the completion of service. ("Engineer). PART 1. Work Authorization No. 12 is related to the improvement of Walnut Street improvements, Veterans to Houston.
