R98-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, WAIVING THE RIGHT TO APPLY FOR THE JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT FUNDS FOR THE CURRENT YEAR, REQUESTING THAT BRAZORIA COUNTY RECEIVE THE WAIVED FUNDS, AND AUTHORIZING THE CHIEF OF POLICE OR HIS DESIGNEE TO PARTICIPATE IN THE JUVENILE CRIME ENFORCEMENT COALITION CREATED BY BRAZORIA COUNTY. WHEREAS, juvenile crime is a serious problem wherever it occurs, and must be addressed by the appropriate authorities; and WHEREAS, the Texas Governor's Office Criminal Justice Division provides block grant funding for the improvement of local juvenile law enforcement; and WHEREAS, Brazoria County will apply for funding through the Criminal Justice Division Juvenile Accountability Incentive Block Grant; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The City waives the right to apply for Juvenile Accountability Incentive Block Grant funding for the current year. The City requests that Brazoria County receive the waived funds. That the Chief of Police or his designee is authorized to serve on Section 2. Section 3. the Brazoria County Juvenile Crime Enforcement Coalition. This may be done in two ways: 1. If the city or county simply does not want to apply, the Authorized Official (Mayor or County Judge)may send a letter to the Criminal Justice Division of the Governor's Office waiving the right to apply. Funds that would be allocated to that city or county become part of a statewide fund to provide eligible services to smaller cities and counties that are not eligible to receive separate grants. A "Waiver of Application"form is in the original application packet. 2. If the city or county wishes to waive its eligiblilty to apply for a separate grant, but would like to designate a neighboring city or county as the recipient of the allocated amount, the governing board of the city or county that is waiving the right to apply would pass a resolution that does three things: • waives the right to apply. • names the city, county or regional council of governments that they are requesting to receive the waived funds. • agrees to participate in the Juvenile Crime Enforcement Coalition created by the city or county that is to receive the waived funds. The resolution should specify one or more representatives to serve on the recipient city or county's Juvenile Crime Enforcement Coalition. The grant application submitted by the city or county that is to receive the waived funds must contain the following: • a copy of the resolution passed by the city or county that is waiving the right to apply for funds. • the appropriate match for all of the combined amount of funds for which application is being made. • an agreement to include the city or county that is waiving funds in the applicant's Juvenile Crime Enforcement Coalition. The intent of this process is to provide flexibility for cities and counties to combine funds to meet local needs.
