1996-10-07 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - 6:30PM125 MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 7, 1996, AT 6:30 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The hearing was called to order with the following present: Mayor Tom Reid Councilmember/Mayor Pro Tem Jerry Richardson Councilmember Richard Tetens Councilmember Kevin Cole Councilmember Helen Beckman City Attorney Amy McCullough City Secretary Yolanda Benitez Others in attendance: Assistant City Manager Glen Erwin and Police Chief Mike Hogg. Absent from hearing: Councilmember Larry Wilkins. PURPOSE OF THE HEARING: To consider the proposed annexation of 321 acres of land located in George C. Smith Survey, Abstract No. 551; Section 29 of the H.T.&B. RR Co. Survey, Abstract No. 292; the A.C.H.&B. RR Co. Survey, Abstract No. 416, Section 36 of the H.T.&B. RR Co. Survey, Abstract No. 461; and W.T. Hughes Survey, Abstract No. 462 of Brazoria County, Texas. NUMBER SIGNING ATTENDANCE ROSTER: 15 STAFF REVIEW OF PROPOSED SERVICE PLAN Assistant City Manager Glen Erwin reviewed a map of the area involved in the proposed annexation. He stated that the boundaries follow along State Highway 35 and the statutes require that we annex an area of not less than 1000 feet at its narrowest point. Mr. Erwin pointed out that they had gone to the nearest property lines. Assistant City Manager Erwin reported that the services to be provided include water, sewer, garbage pick-up and recycling. The Emergency Services (Fire, Police and EMS) will be effective immediately upon annexation. The timeframe for completion of the utilities to this area is 4 to 4 '/a years. Mayor Reid explained the intent of the public hearing for the annexation, and outlined the procedures to be followed. He also stated that the annexation process is anticipated to be complete by the end of December. Mayor Reid asked that the citizens limit their comments to three minutes. PERSONS WISHING TO GIVE INPUT Brandon Wade - 216 W. Sealy, Alvin, Texas. Mr. Wade stated that he was representing the City of Alvin as its City Engineer and Acting City Engineer and entered into the record, Resolution No. 96R-27, passed by the Alvin City Council, affirming the city's intent to take appropriate steps to protect its corporate boundaries and Extraterritorial Jurisdiction and setting forth other provisions related thereto. He stated that since the City of Pearland had modified their map and it no longer contained area within the Alvin City limits and ETJ, as well as their industrial district, this cleared up any potential problems. However, he wanted the resolution entered into the record. 2. Jose G. Flores, III - 2841 Morenci Street. Stated he was probably at the wrong meeting; however, he wanted to inquire about the status of drainage and road improvements to Morenci Street which is in the area annexed last year. 3. John Collins - Rt. 3, Box 257, Dickinson, Texas. Mr. Collins stated that he does not live in the area, but has relatives who do and he owns property there. He was concerned with the timeframe in which the services will be provided, wanted to know if paving and blacktopping of the roads would be done, and if the city really needed the amount of property they were proposing to annex. 4. Rick Lane - 19356 N. Highway 35. Mr. Lane stated that they superb emergency services and are very happy with the Alvin School District. It was explained to him that his children would remain in the Alvin ISD. He wanted to go on record as being opposed to the annexation. 5. Johnnie Wallace - Hastings. Mr. Wallace inquired about the types of zoning this area would be given. He wanted to emphasize that this area is not going to grow any more and that it is full of pipelines, pollution and lawsuits. 6. Joe Durso - CR 414. Mr. Durso addressed Council with questions regarding the real purpose for the annexation, and inquired about the status of the state's widening of the road. 7. Lynn Williams - Alvin, Texas. Mr. Williams was concerned with the logical reasons for going South of Dixie Farm Road, how this would play into Dixie Farm Road, 12T and what the significant value of taking property alongside the road was. He also inquired with regard to how this annexation would help the intersection at Dixie Farm Road and SH 35. 8. Johnnie Wallace - Hastings. Mr. Wallace asked about the use of county road numbers instead of names as was done on the map. He stated this was rather confusing for those residents who live in the area and refer to the roads by their County Road number designation. 9. John Collins - Rt. 3, Box 257, Dickinson, Texas. Mr. Collins inquired about handicap facilities and other facilities which would be installed to make the area look like a city. 10. Sylvia Lane - 19356 N. Highway 35. Mrs. Lane stated that she is not interested in living in the city, does not want to be annexed, and wants her children to be able to have their animals. She also stated that they want all of their services now and not ten years from now. Councilmember Beckman explained that we are required by law to have the services put in within 4 1/2 years, not to start them within that timeframe. 11. Lynn Williams, Alvin, Texas. Mr. Williams asked the City Council how they would feel toward having a "live" pipeline running under his building, if that would disqualify his building, if they could get the water to his property, and how it would affect him if the city took in his property. 12. Renee West - 2510 Westminister. Ms. West provided information with regard to ground water contamination, horses and other animals being allowed in the city of Pearland, lower taxes, high crime rates for areas outside the city limits, and the benefits of being annexed into the city. 13. Vernon Smith - Rt. 3, Box 307, Alvin, Texas. Mr. Smith asked if it was possible for the City to provide the water that they will need for the residents of the area. 14. Sharon Culleson - Rt. 3, Box 317, Alvin, Texas. Ms. Culleson inquired about the number of feet which the city was going to take in off the highway towards 2351. 15. Lynn Williams, Alvin, Texas. Mr. Williams emphasized that he is not interested in lower taxes and that he did not have a problem paying for services rendered. He restated his question "Do you really need the area that far south?". He expressed the opinion that it is "a bad venture on the Council's part to try to jump out there and try to take in something that you have no knowledge of what's really there". He requested clarification with regard to school taxes and was advised that he would continue to pay Alvin school taxes and would not be subject to Pearland school taxes. 16. Renee West - 2510 Westminister. Ms. West pointed out several uses for the property, one of which was development of detention ponds. 17. Kim Smith - Rt. 3, Box 309, Alvin, Texas. Mrs. Smith stated that her property has been in the family since the early 1900's. She stated that if she is going to be annexed, she wanted all of the amenities, not just the water. Mrs. Smith noted that she was closest to Pearland schools and did not understand why her child would have to ride a school bus to the furthest school which would be in Alvin. Councilmember Cole provided clarification, once again, with regard to the fact that the school districts would not be involved in the annexation of this property, and that her child would have to go to an Alvin school, unless she wished to pay a transfer fee. Mrs. Smith emphasized out that she does not want new businesses in her area, that they want to continue to keep their doors unlocked at night and remain like a family. 18. Johnnie Wallace - Hastings. Mr. Wallace requested clarification as to the number of feet that the city could take in. Mayor Reid stated that the city is not limited to the amount that can be taken in, but had to take 1000 feet at its narrowest point. 19. Lynn Williams - Alvin, Texas. Mr. Williams asked about the process involved with the straightening of the curve at this intersection. 20. Vernon Smith - Rt. 3, Box 307, Alvin, Texas. Mr. Smith requested that the names of the property owners be inserted on the map in order to better distinguish whose property would be annexed. Assistant City Manager Glen Erwin stated that this was possible by researching the deed records. Mr. Smith asked if the oil field work would require a permit each time, to which Mr. Erwin responded that this issue was addressed in the Oil and Gas Ordinance. 21. John Collins - Rt. 3, Box 257, Dickinson, Texas. Mr. Collins stated that there are too many fires and too many explosions in the area. He requested that if the city can provide all of the services it promises to, then they should go ahead and annex the area. Otherwise, he stated, they should not attempt to do it if they cannot come across. He stated that the City already has water on O'Day R d and w&also have sewer, but it is south of Hickory Slough. Mr. Burdine also stated th this area is currently in the City's ambulance area, and the residents are currently recei 'ng a number of the city's benefits without cost to them.
